Motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to approve the variance as requested with the following conditions: 1. a registered surveyor’s drawing must be provided, 2. no residential dwellings can be placed on these tracts, 3. the parcels must be permanently attached to the lake lots in North Shore, and 4. the area contained within these tracts cannot be considered when making the 25% impervious surface caiculation for front iot development. Hardship is extremely substandard lake lots and the need of this property for the upgrading of septic systems and for off-road parting. Jenne - Approved with conditions. Jeffrey A. Jenne, Et. AL., Dent, MN, requested a variance to subdivide 11 tracts by metes and bounds description from an existing 35.33 acre parcel for the purpose of permanently attaching the proposed tracts to corresponding lots in the recorded subdivision of North Shore. It should be noted that these existing lake lots are extremely substandard and need this additional land for upgrading septic systems and for parking. It should also be noted that the proposed 11 tracts will be recorded as they are transferred with the balance to remain a part of the farm. The property is described as part of Government Lot 3, Section 35 of Star Lake Township by Dead Lake. Clem Hendrickson, Surveyor, represented the applicant at the public hearing. The audience was polled with Jeannine M. Whitman asking questions regarding the proposed subdivisions and how this property could be used. After consideration motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to approve the variance as requested with the following conditions; 1. a registered surveyor’s drawing must be provided, 2. no residential dwellings can be placed on these tracts, 3. the parcels must be permanently attached to the lake lots in North Shore, and 4. the area contained within these tracts cannot be considered when making the 25% impervious surface calculation for front lot development. Joan and Gordon Jackson - Approved as modified and as conditioned. Joan and Gordon Jackson, Woodbury, MN, requested a variance of 30’ to 52’ from the required ordinary high water level setback of 75’ and a variance of 15’ from the required road right-of-way setback of 20’ for the construction of a 28’ by 36’ garage/storage building 23’ from the ordinary high water level at the nearest point, 45’ from the ordinary high water level at the greatest separation point and 5’ from the road right-of-way. The property is described as part of Government Lot 5, Section 27 of Lida Township by Lake Lida. The audience was polled with no one speaking for or against the request. After consideration motion was made by Randall Mann, second by Cecil Femling and carried with John Everts voting no, to approve the construction of a storage building subject to the following conditions; 1. the structure can have a height of 18’ or less, 2. an existing 20’ by 24’ house, on Lot C, and an existing 14’ by 22’ structure, on Lot B, must be removed before a site permit can be issued, 3. the proposed structure must be at least 5’ from the road right-of-way, 4. the structure must be a single story structure. 5. the proposed structure must be at least 37.5’ from the ordinary high water level, and 6. the proposed structure must be at least 10' from the lot line. Hardship is the terrain features of the applicant’s property.
