Requested Variance: The ordinance requires lots located on lakes classified as "natural environment" be a minimum of
200 feet wide to build a residential dwelling. Our proposed house with garage would be on a 2.49 Acre lot that is 150
feet wide. Requesting to have the lot buildable for single family residential use. Important note is County Highway 32
separates the Mud Lake shoreline from the proposed site for the new house with garage.

Ordinance Section Citation: Section 6, Subp. 2.
A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: Want to relocate to this area. When the lot was created it was not large
enough in meeting the lot width setback. Property owner gave a recap of working with Land & Resource Management.

1. Is the variance in harmony with the general purposes and intent of the official control? (The board shall consider the purposes
and intent of the official control).

The Board of Adjustment may impose, conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the jmpact created by the variance. (Mitigating impervious surface with storm water management, deep
roofed vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.
Jon & Rhonda Ellerbusch - Variance Application Approved as Requested (7:38 p.m.)
Jon & Rhonda Ellerbusch, Pt GLs 1 & 9 Com El/4 Cor., Mud Lake (56-381) and Pickerel Lake (56-475) in Maine Township
requested the following: The ordinance requires lots located on lakes classified as “natural environment” be a minimum of 200 feet
wide to build a residential dwelling. Our proposed house with garage would be on a 2.49 Acre lot that is 150 feet wide. Requesting to

The audience was polled with Bernard Mackowicz speaking in support of the variance as requested. Erw in & Marilyn Wahlgren
submitted an email in opposition to the variance as requested.
After consideration and discussion, Darren Newville made a motion, seconded by David Wass with Terry Marthaler voting no to
approve the variance request for the lot to be considered buildable for single family residential use. This decision is based on the
Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s findings have been attached to and
incorporated as an official part of the minutes which have been placed on file with the Land & Resource Management Department.
Fisherman’s Village Resort - Dave Thompson - Variance Application Approved as Requested (7:52p.m.)
Fisherman’s Village Resort - Dave Thompson, Lots 5, 6 & 7 of Beauty Beach on Deer Lake and Part of GLs 1 & 2, Deer Lake (56-
298) in Everts Township requested the following: To meet the requirement of “adequate” parking for a PUD, we have to create
additional parking which increases our impervious from 42.2% to 46.8%. We are asking for a variance for this increase. Please note
that 1600 sq.ft, of new parking will be grass but has to be considered impervious per ordinance.
Fisherman’s Village Resort - Dave & Bev Thompson, property owners, and Dave Anderson, Anderson Land Surveying, represented
the variance application.
The audience was polled w ith no one speaking for or against the variance as requested
After consideration and discussion, Thomas Lee made a motion, seconded by Rick West and carried to approve the variance request to
increase the impervious surface from 42.2% to 46.8% of impervious surface coverage for additional parking to meet the “adequate”
parking requirement for a PUD. This decision is based on the Findings of Fact and Decision Form, which contains the criteria
reviewed and the Board’s findings have been attached to and incorporated as an official part of the minutes which have been placed on
file with the Land & Resource Management Department.
Warren & Deborah Tunwall - Variance Application Denied (8:02 p.m.)
Warren & Deborah Tunwall, Lot 32 of San Dee Cove Beach & Pt of NWl/4, Lida Lake (56-747), Lida Township requested the
following: Tunwalls plan to build a 2-story shed on back lot. Property survey (5/25/22) revealed neighbor’s 24’ garage to the east is
5’-8’ onto Tunwalls property . Shed can be built with 10’ setbacks (no variance) but would only be 4’-5’ from this garage (roof eaves
closer). This is a fire safety concern. Tunwalls request a variance to build the shed 3’ from west property line (instead of 10’ setback),
which allows II’- 12’ separation from neighbor’s garage to the east, and still 26’ to the neighbor’s garage on the west side. TunwalTs
existing non-complaint garage to be removed (is over west property line 3’-4’). Also request to build shed 15’ from edge of back road,
currently there is no easement (existing garage is 11 ’ from road).
Warren & Deborah Tunwall, property owners, represented the variance application.
The audience was polled w ith Jeffrey Aga does not oppose the proposed structure but oppose the request for the lotline setback, Bev
Aga Schmidt does not oppose the structure however, she does oppose the lotline setback request. Glen Aga has concerns w ith the road
and having legal access maintenance. Beverly Aga Schmidt submitted an email in opposition to the variance as requested. Jeffrey Aga
submitted an email in opposition to the variance as requested. Glenn Aga submitted an email in opposition to the variance as
requested. An email from Carol McCamy was submitted in opposition to the variance as requested.
After consideration and discussion Michael Donoho made a motion, seconded by Tliomas Lee to approve the variance to construct a
shed (28’ x 44’) being 9 feet from the west property line. This motion has failed (4 to 3 vote).
After further discussion Darren New ville made a motion, seconded by Terry Marthaler with Michael Donoho and Mark Johnson
voting no to deny the variance as requested as there is adequate room to meet the lotline setbacks of the Shoreland Management
Ordinance. This decision is based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s
findings have been attached to and incorporated as an official part of the minutes w hich have been placed on file w ith the Land &
Resource Management Department.

We are definitely opposed to approving their request to build a single family residential home on the back lot which is
located across from 33888 Pickerel North Dr, Richville MN 56576.
When the back lots were originally plotted for sale, we were assured that they were going to be used for storage buildings
and none of them would be used for a campground or individual homes. We feel that the original intent should be
maintained.

This management plan will identify the operation and maintenance acth/fties necessary to ensure long-term performance
of your septic system. Some of these activities must be performed by you, the homeowner. Other tasks must be
performed by a licensed septic service provider.
Homeowner's Management Tasks - Should Be Checked Every 6 months:
Lealcs - Check (look, listen) for leaks in toilets and dripping faucets. Repair leaks promptly.
Surfacing sewage - Regularly check for wet or spongy soil around your soil treatment area.
Effluent filter (if appBcoblel - Inspect and clean twice a year or more.
Pump Tank Alarms - Alarm signals when there is a problem. Contact a service provider any time an alarm signals.
Holding Tank Alarms — Can be either an electronic or a manual float, when activated, service (pumping) is
required.

Vegetative Cover - Establish and maintain a vegetative cover over the sewage system.

Variance Guidance Series OHWL Setbacks

Why are setbacks from the OHWL important?
The Ordinary High Water Level (OHWL) is a dynamic area of high biodiversity and ecological function,
as well as the regulatory line that separates local land use and state public waters jurisdictions. Setbacks
from the OHWL are established in statewide rules and administered through local ordinances to ensure
adequate spacing between structures and public waters to
protect against runoff and pollution, and to preserve the natural
shoreline. Local governments have limited discretion to deviate
from - or grant a variance to - a required setback. They may do
so only if all of the variance criteria established in state statutes
and their local ordinances are met. In evaluating such requests,
local governments must examine the facts, determine whether
all statutory and local criteria are satisfied, and develop findings
to support the decision. If granted, local governments may
impose conditions to protect resources. An example OHWL
variance request, with considerations, is provided below.

Example OHWL Setback Variance Request
A property owner requests a variance to construct a 1000 square foot
addition on an existing home on a lake. The proposed addition would
be located 75 feet from the OHWL of the lake instead of 100 feet as
required by the local shoreland ordinance. The property owner claims
that the addition is needed to provide extra space for a growing
family, that it will improve the value and appearance of the property,
and that there is no other reasonable location on the property due to
the design of the home and an adjacent wetland.

Considerations for Findings
A good record and findings help keep communities out of lawsuits and help them prevail if they find
themselves in one. In evaluating the facts and developing findings for this variance request, all of the
following statutory criteria must be satisfied, in addition to any local criteria:
• Is the variance in harmony with the purposes and intent of the ordinance?
Considering a variance request is a balancing test that requires weighing the need of an individual
property owner against the purposes of the local shoreland regulations - in this case a setback from
the OHWL - for protecting public waters. Statewide Shoreland Management Rules establish structure
setbacks from the OHWL for several reasons, including but not limited to managing the effects of
shoreland crowding, preventing pollution of surface water, and maintaining property values and
natural characteristics of shorelands. These regulations are implemented through local ordinances.
Considerations: What are the purposes of the OHWL setback as established in the local shoreland
ordinance - what is it intended to prevent or protect? Will deviating from the required OHWL
setback on this property undermine the purposes and intent? Why or why not?
• Is the variance consistent with the comprehensive plan?
The local comprehensive plan establishes a framework for achieving a community’s vision for the
future. Most plans contain goals and policies for protecting natural resources and shorelands, as well
as maps that identify areas of high risk or with high ecological value where development should be
avoided. The variance request must be considered with these goals and policies in mind. Maps should
be consulted to determine if the property is within any areas identified for protection.
Considerations: Which goals and policies apply? Is allowing structural encroachment within the
OHWL setback area on this property consistent with these goals and policies? Why or why not?

• Are there unique circumstances to the property not created by the landowner?
Unique circumstances relate to physical characteristics of the land such as lot dimensions, steep
slopes, poor soils, wetlands, and trees that prevent compliance with the required setback. These do
not include physical limitations created by the property owner or personal circumstances such as a
grow ing family or design preferences. Consider what distinguishes this property from other shoreland
properties to justify w hy the applicant should be allow'ed to deviate from the required setback when
others must comply. Considerations: What physical characteristics are unique to this property that
prevent compliance with the setback requirement? Were any difficulties in meeting the setback
created by some action of the applicant? Has the applicant demonstrated no other feasible
alternatives exist that would not require a variance?
• Will the variance, if granted, alter the essential character of the locality?
Consider the size of the proposed structure, the extent of encroachment, and how' it relates to the
shoreline and hydrology of the riparian area. A large addition and associated grading close to the
shoreline can detract from the natural appearance and character of the lake and its riparian areas and
degrade water quality by altering topography, drainage, and vegetation in the riparian area, negatively
affecting recreational, natural, and economic values. Considerations: Does the variance provide
minimal relief or a substantial deviation from the required setback? Does it affect the natural
appearance of the shore from the lake? Does it affect the hydrology of the area?
• Does the proposal put property to use in a reasonable manner?
Examine the reasons that the variance is requested and evaluate them in light of the purposes of the
local shoreland ordinance and the public water resource at stake. The OHWL setback is generally
intended to keep development away from the w'ater’s edge and to maintain the natural characteristics
and function of the shoreline. As such, development within the setback area should only be
considered w'hen no other alternatives exist, particularly if the public w ater at stake is impaired or at
risk of becoming impaired. Considerations: Has the applicant demonstrated that the proposed
addition is reasonable in this location given the sensitivity of the riparian area, any known water
quality impairments, and the purposes of the setback regulations? How or how not?
Note: The last three criteria address practical difficulties. Economic considerations alone cannot create practical difficulties.
Range of Outcomes
Based on the findings, several outcomes can occur;
• If the applicant fails to prove that all criteria above are met, then the variance must be denied. For example,
the local government may find the proposed size and design of the addition creates the circumstances
necessitating a variance rather than unique physical characteristics of the property.
• If the applicant demonstrates that all criteria are met, then the variance may be granted. For example, the
local government may find that the circumstances are unique given the adjacent wetland, that the
encroachment of the addition within the setback is reasonable given its orientation, that it won't alter the
hydrology and natural characteristics of the riparian area, and that there would be no other impacts.
• If the variance is granted and the addition in any way affects the setback area or public water, then conditions
may be imposed to mitigate the impacts. For example, the local government may find that the addition
increases the home's visibility from the water and that the associated grading alters the hydrology of the area,
and impose conditions such as reducing the size of the addition, decreasing the amount of grading involved,
requiring tree protection measures, and requiring rain gardens to infiltrate additional runoff.
Conditions on Variances
If findings support granting the variance, consideration must be given to the impacts on the lake or river
and the riparian area, and appropriate conditions to mitigate them. Conditions must be directly related and
roughly proportional to the impacts created by the variance. Examples are provided below:
• Additional imperx ious coverage within the setback area - require a smaller addition, rain garden, riparian
buffer, or other method to reduce and/or infiltrate additional runoff before entering the lake;
• Increased crow'ding and visibility of structures from the lake - require the planting of native trees, shrubs,
and grasses to reduce the visibility of the structure and maintain natural characteristics; and/or
• Reduced natural characteristics and habitat - require protection of existing trees during construction and/or
restoration of an equivalent area within the setback to native vegetation to maintain the natural
characteristics and ecological functions of the riparian area (which also treats stormwater).

VARIANCE REQUEST CHECKLIST
While considering a variance request from an official control (a County Ordinance), the Board of Adjustment is
required by Minnesota Statute 394.27, Subp. 7 to determine if a practical difficulty exists by measuring the
variance request against the following 5 criteria. All five criteria must be answered in the affirmative for the
variance to be granted.
As the applicant, you should come to the variance hearing prepared to demonstrate that your variance
request meets the following criteria:
1. Is the variance in harmony with the general purposes and intent of the official control? (The board shall
consider the purposes and intent of the official control).

others? Does this lot have a feature that does not affect all parcels similarly?)

The 2.5 acre lots were divided into substandard lots. Instead of 150 ft width they should have each
been 200 feet.
4. Will the issuance of the variance maintain the essential character of the locality? (The board shall
consider and state for the record why the request does or does not maintain the character of the area.
Is this request similar to what others have, what are near shore conditions of neighbors, similar sized
or number of structures adjacent or in area, etc.)

The long-range strategic planning process for Otter Tail County has three major goals:
1. Provide an opportunity to engage with residents and stakeholders to understand current
opportunities and concerns.
2. Review existing county systems (natural resources, housing, etc.) and opportunities and challenges
for the future.
In addition to the five criteria required in MN Statute 394, the Otter Tail County Shoreland Management
Ordinance allows the Board of Adjustment the option to consider the following while deciding on a variance
request:
Whether the variance will secure for the applicant a right or rights that are enjoyed by other owners in
the same area.
1.
Yes - A 2.5 acre lot in the country is best used as a single-family dwelling
Whether existing sewage treatment systems on the property need upgrading before additional
development is approved.
2.
No - It will be a new system
3. Whether granting the variance will be contrary to the public interest or damaging to the rights or other
persons or to property values in the neighborhood.
No - The value of the dwelling will be as much or higher than many houses along North Pickerel Drive.
The properties along North Pickerel Drive are for single family homes. It is NOT for suited for
commercial, park or farmland.
4. No variance will be granted simply because there are no objections or because those who do not
object outnumber those who do.
The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly
related to and must bear a rough proportionality to the impact created by the variance. (Mitigating impervious
surface with storm water management, deep rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances
are meant to be an infrequent remedy where an ordinance imposes a unique and substantial burden.

environment lakes are more vulnerable and negatively impacted by human
pollution than recreational lakes requiring 150 feet.
> The proposed dwelling/home and all site-work on the property is between Hwy 32
and North Pickerel Drive. The shorelands of Mud Lake and Pickerel Lake will never
be impacted by an owner-occupied single-family home.
Ordinance Purpose
> The requested variance is consistent with the spirit, purpose, and intent of the
ordinance. The peculiar characteristics of the property should completely
resolve any potential concerns regarding an adverse ecological effect on Mud
Lake. Highway 32 separates the "Shore Impact Zone" on Mud Lake from the
proposed building site.
