After consideration and discussion, Terry Marthaler made a motion, seconded by Darren Newville and carried to
approve the variance to replace the existing dwelling being 30 feet from the lake and 8 feet from the road right of
way with the modification that there will be no designated parking in the road right of way and the maximum
coverage allowed on the property is 1,472 sq.ft, which is approximately 28.9% of impervious surface coverage.
This decision is based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the
Board’s fmdings have been attached to and incorporated as an official part of the minutes which have been
placed on file with the Land & Resource Management Department. The variance granted shall expire five (5)
^ years from the date of approval. The expiration date of this variance approval is July 14, 2027.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:

The Board of Adjustment rhay impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.
Troy & Ericka Wambach - Variance Application Approved with Modification (8:31 p.m.)
Troy & Ericka Wambach, Lot 8 Blk 2 of Engstrom Beach, Big McDonald Lake (56-386) in Edna Township requested the following:

The audience was polled with Dennis Sazama, Edna Township addressing the parking in the road right of way. An email from Dale &
Jeanne Janssen was sent in support of the variance request.
After consideration and discussion, Terry Marthaler made a motion, seconded by Darren Newville and carried to approve the variance
to replace the existing dwelling being 30 feet from the lake and 8 feet from the road right of way with the modification that there will
be no designated parking in the road right of way and the maximum coverage allowed on the property is 1,472 sq.ft, which is

Harry & Angie Wood - Variance Application Approved as Requested (8:41 p.m.)
Harry & Angie Wood, Lot 8 Ex W 10’, Lot 9 & Lot 10 of Viken Bay Beach, Pelican Lake (56-786) in Dunn Township requested the
following: We are requesting a variance from the Shoreland Management Ordinance - Section 6, Subpart 4 - Setback from OHWL.
We wish to place our new home at a setback distance of 37.5 feet from the ordinary high water line which is a 37.5 foot variance from
the normal 75 foot setback. The existing home is within 24 feet of the OHWL.
Harry & Angie Wood, property owners, and Chris Heyer, Moore Engineering represented the variance application.
The audience was polled with Chris Heyer, Moore Engineering speaking regarding the shore impact zone impervious surface
coverage.
After consideration and discussion, Rick West made a motion, seconded by Thomas Lee and carried to approve the variance to replace
the existing dwelling being 37.5’ from the ordinary high-water level. This decision is based on the Findings of Fact and Decision
Form, which contains the criteria reviewed and the Board’s findings have been attached to and incorporated as an official part of the
minutes which have been placed on file with the Land & Resource Management Department. The variance granted shall expire five
(5) years from the date of approval. The expiration date of this variance approval is July 14, 2027.
Bradley Booth - Variance Application Approved with Condition (8:51 p.m.)
Bradley Booth, Lot 3 A1 Peach’s First Addition to A1 Peach’s Lakeshore, Star Lake (56-385) in Dora Township requested the
following: Adding a pitch roof over the existing attached garage (flat rooO raising the roof line of the garage by 12 feet, creating a
storage loft above the existing garage with approximate dimensions of 11 ’ x 24’ with a 4’ overhang on the southside. Garage is 8’
south of the roadway and 64’ from the water line. Rebuilding the lakeside shed increasing the dimensions from 5’xl5’ to 8’xl6’ with
3’ overhang on east side and moving it 1 ’ to the east, off the property line and away from the lake 3’-5’.
Bradley Booth, property owner, represented the variance application.
The audience was polled with Heather Klovstad speaking in opposition to the variance request with concerns about the height of the
garage and their view being impacted as well as parking concerns. Amie Schenck spoke in support of the variance as requested. An
email from Bob & Linda Dimitrijevich was submitted in support of the variance. Aden Kolstad mailed a letter in opposition to the
variance as requested.
After consideration and discussion, Darren Newville made a motion, seconded by Thomas Lee with Rick West and Mark Johnson
voting no to approve the variance request to construct an 11 ’ x 24’ loft addition to the existing attached garage being 8 feet from the
road right of way and 64 feet from the ordinary high water level and approving the replacement of the shed being 8’ x 16’ in size and
moving it 3’-5’ off of the lake with the condition that it is located 5 feet from the lotline. This decision is based on the Findings of Fact
and Decision Form, which contains the criteria reviewed and the Board’s findings have been attached to and incorporated as an
official part of the minutes which have been placed on file with the Land & Resource Management Department. The variance granted
shall expire five (5) years from the date of approval. The expiration date of this variance approval is July 14, 2027.
