The Shore Impact Zone Impervious Surface Coverage is 1344 sq. ft., and we are proposing to add 1960 sq. ft. for a total of 3304 sq. ft. of impervious surface coverage in the Shore Impact Zone. Impervious Surface Calculation Worksheet 04-11*2016 Signature: SUMMARY OF VARIANCE The reason this variance permit was initiated is due to the request of,the Minnesota Health Department. These reasons are outlined in the Variance Request Checklist included in this document. This variance will allow the establishment to operate with better and safer conditions for both the patrons and the employees. In addition, this establishment's struggling along with others in their industry to survive and operate during these times of required restriction due to COVID-19. To summarize this variance, including other construction improvements to be permitted upon approval of the variance include: • Extend the structure to the north to the beverage hub/center to be inside the building. This new addition currently consists of shed roof extensions and decking that is part of the lot's impervious coverage. • A portion of the kitchen will be extended five (5) feet westward to improve the efficiency and allow for better safety preparation of food. • A square shaped open pergola will be constructed on the northwest corner of the outside deck area - see the drawings. • A square ‘tower’ will be constructed within the existing footprint of the building to improve the aesthetics and provide a focal point. • A retractable awning system will be installed on the roof to cover the outside,seating deck on the east side of the building. This will allow patrons to remain outside during light inclement weather, providing better social distancing as the restaurant industry continues to work under COVID-19 restrictions. VARIANCE REQUEST CHECKLIST 1. Is the variance in harmony with the general purposes and intent of the official control? (The board shall consider the purposes and intent of the official control). Yes, the variance will allow the property owner to update portions of the existing building both aesthetically and structurally. These improvements are being driven by the request of the Minnesota Department of Health. The addition over the coolers and beverage hub are requested by the Health Department, the bump-out addition to the kitchen improves the efficiency of the business operation. The building of a new entrance tower is for aesthetic reasons. These construction projects do NOT affect the percentage of impervious surface area. 2. Is the property owner proposing to use the property in a reasonable manner not permitted by the official control? (The board shall consider what reasonable use of the property is lost (practical difficulties) by the strict enforcement of the official control). Yes, the use of the property will continue d be a restaurant and gathering place for members Of the community. No additional seating is being added. An awning system on the lakeside deck will allow for better social distancing during times of light rain. 3. Is the need for a variance due to the circumstances unique to the property not created by the landowner or prior landowners? (The board shall consider what circumstances are unique to the property, such as lot size, lot configuration, wetland, steep slope, shore impact zone, bluff, floodplain, floodway, etc. One or more should be stated on the record. Yes, As mentioned in #1 abpve,'the Minnesota Department of Health has requested that improvements be made for the safety and health of both the patrons and the employees of the restaurant establishment. The Health Department is requesting that the beverage hub and lines be under a roof inside the building. By adding this building addition, there is no change to the total impervious surface, as that area is already impervious. In addition, the coolers will be brought up to date, and the kitchen plumbing will be brought up to current state plumbing standards. 4. Will the issuance of the variance maintain the essentiai character of the locality? (The board shall consider and state for the record why the request does or does not maintain the character of the area. Is this request similar to what others have, what are near shore conditions of neighbors, similar sized or number of structures adjacent or in area, etc.) Yes, the character of the locality will not change from, the existing conditions. Although not a reason for the variance, the exterior aesthetics will be improved for the benefit of the locality. 5. Does the need for the variance involve more than just economic considerations? (The board shall consider if economics played a role in the request. The fact that coming into compliance with the ordinance requirements may cost considerable more does not constitute a practical difficulty). Yes, Again, some of the proposed changes are being required by the Minnesota Department of Health. In addition, by having a retractable canvas roof system on the outside deck will allow for patrons to socially distance themselves better than with the current situation. ADDITIONAL CRITERIA 1. Whether the variance will secure for the applicant a right or rights that are enjoyed by other owners in the same area. The applicant has the goal of always being a good corporate neighbor and this variance request is in line with that philosophy. 2. Whether existing sewage treatment systems on the property need upgrading before additional development is approved. The proposed modifications do NOT-include any changes to the bathrooms in the restaurant and will have no effect on the sewer system. The system was tested in the fall of 2020 and was compliant. See the recent attached MPCA Compliance Inspection Form for the existing subsurface sewage treatment system. The proposed modifications will have NO adverse effect on neighbors. The changes will actually enhance the existing aesthetics of the area. 3. Whether granting the variance will be contrary to the public interest or damaging to the rights or other persons or to property values in the neighborhood. The reasons for requesting this variance is two-fold. First, changes must be made based upon recommendations of the Minnesota Department of Health; and secondly, in light of the challenges restaurants have experienced as a result of COVID-19, changes are being made to allow for better social distancing, and a safer work area for the employees. 4. No variance will be granted simply because there are no objections or because those who do not object outnumber those who do. My grandparents owned it prior to them. This has been our little slice of heaven for over 50 years. Ever since Zorbaz has arrived, we have had to accommodate the abundance of vehicles and boats that Zorbaz brings to our oasis. We have picked up Zorbaz cups, pizza boxes, plates, and other garbage from our property steadily. We have had to have guests of ours park houses away from us. We have had our cars blocked in by Zorbaz patrons. We have had many pontoons and boats come between the shore and our swimmers to dock at that last available opening. We have had to wait many times to dock our own boat due to the boat traffic at Zorbaz. We have had the highway down to one lane due to patrons parked on both sides of the road and vehicles trying to get through. I'm sure I do not have to explain why this is the most concerning problem by far. The variance Zorbaz is requesting is not compatible to the amount of parking they can handle. To add more room for customers without more room for their vehicles is ridiculous. We beg of you to please take the area occupants into consideration. Please do NOT allow this variance for Zorbaz to expand. They have already taken away so much of our paradise. We tolerate the noise, commotion, vehicle & boat traffic and parking that Zorbaz brings to the neighborhood already. Please do not allow any more. We are property owners too. Thank you for your time.
