' If the person doing the measuring comes up with 20' plus another 20' puts in a stake it is hard to believe you can be 4' 6" off? , .The owner and contractor got the house and garage how they wanted it and now ask that they must have measured wrong? The Land and Resource along with Township and County have made these set back laws and must be followed or why r have them? 1 There may be exceptions some times before something is built but not after being built. With this it says build what you want, where you want then plead you made a mistake. I do not know what the variance law says but must say, "That part of structure needs to be taken down to meet the ■ set back law, or whole structure torn down and go by set back laws. If this owner gets this variance will there be another variance for the driveway? How many variance can a person ask I believe they got one for the deck or house to be closer to water already? (April 2022) The address is 38589 South Eagle Lake Rd Battle Lake MN. I have owned the property 2 houses east of this since 1980. 38645 S. Eagle Lake Rd. The garage/house is on the right-of- way which should be denied. They need more than a fine, they need to demolish the part that is in the right-of- way. My other concern is that years ago there was a water channel from the pond on the south side of the road with a culvert under the road (the culvert is still under the road) and water and fish went between the pond and Eagle Lake. That waterway was filled in with dirt many years ago. I don't know who did it? It seems that property should be in the DNRs name. My next question: what kind of sewer system are they putting in? Learn why this is important i' I would ask that you have all 7 on the board read this. I watched the variance meeting on thursday June 9,2022. When it got to the Erickson variance on Eagle Lake they had enough people talk and then got all of you off track of what was supposed to be the 4 1/2 foot that the house is in the right of way. They got you thinking about the retaining wall that is in the right of way, it seemed you guys didn't care it is further in the right of way. I guess when you have money and a Doctor in front of your name you get what you want? The second guy from the end must be a friend or relative? One dumb thing he said "there is a curve in the road?" I don't think you can have a straight road around a round lake? What does the curve in the road have to do with not measuring for the right of way? He just made more positive comments for them. Did the builder have the footings inspected before building? If I would come to the office would you have a record of the date of that? Ericksons didn't even ask for variance for retaining walls and you just gave them the variance. I don't understand your way of thinking? It was about the end of the meeting and then opps, I guess we are supposed to do something about the variance they wanted for being 4 1/2 feet off? This is what the meeting was for and you didn't even talk about it, just give them the variance. I don't want your job but you must do a better job. The one lady wanted 4 inches variance and you talked a long time about that? People used to have to pay a fine when something was done wrong? One more thing, why wasn't the building stopped on that house till this variance was decided? I welcome any phone call or email from this board.
