After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried,
to approve a variance of 10’ from the required road right-of-way setback of 20’ and a variance of 25’ from the required
ordinary high water level setback of 75’ for the placement of a 6’ by 8’ or smaller walk-in cooler 10’ from the road right-
of-way and 50’ from the ordinary high water level with the following conditions: 1.) the walk-in cooler must be placed
behind the existing fence, 2.) the fence must remain in its current location, 3.) the walk-in cooler must be used as a

Ken McDevitt- Denied. (7:20 p.m.)
Ken McDevitt, Lot 3 Deschane Beach, Dead Lake in Dead Lake Township, requested a variance of 18’
on the west and 14’ on the east for the placement of a 32’ by 40’ structure 100’ from the ordinary high
water level. The building line (string line) between my neighbor’s structure to the west and my
neighbor’s structure to the east implies a setback requirement of 118’ at the west end and 114’ at the
east end. The audience was polled with Barry Tanner speaking for the variance as requested. A
letters from Robert F Deutschman, Sr., President of the Dead Lake Association, opposing the variance
as requested was read for the record. Letters form Barry Tanner and Randy Schwartz in support of the
variance as requested were read for the record. After discussion and consideration, Paul Larson made
a motion, second by Steve Schierer and unanimously carried, to deny the variance as requested as no
adequate hardship unique to the property had been shown that would allow for the granting of the
variance as requested and noting that there is adequate room at the string line setback for deveiopment
(construction) purposes.

10’ from the required road right-of-way setback of 20’ and a variance of 25’ from the required ordinary
high water level setback of 75’ for the placement of a 6’ by 8’ walk-in cooler 10’ from the road right-of-
way and 50’ from the ordinary high water level. Trevor Windel represented the applicant at the public
hearing. The audience was polled with no one speaking for or against the variance as requested. An
email from Don and Jeanette Hoppes expressing concerns with existing parking issues was read for
the record. A letter from Richard West, Otter Tail County Highway Engineer, in opposition to the
variance as requested was read for the record. After discussion and consideration, Randall Mann
made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 10’ from
the required road right-of-way setback of 20’ and a variance of 25’ from the required ordinary high water
ievel setback of 75’ for the placement of a 6’ by 8’ or smaller walk-in cooler 10’ from the road right-of-
way and 50’ from the ordinary high water level with the following conditions: 1.) the walk-in cooler must
be placed behind the existing fence, 2.) the fence must remain in its current location, 3.) the walk-in
cooler must be used as a cooler, and 4.) no structural footprint changes can be made to the existing
structure.
Ronald and Mary Heskett - Approved the requested variance as modified and with a condition.
(7:50 p.m.)
Ronald and Mary Heskett, Lot 7 and part of Lot 6 Roy Ell Acres First Addition, Stalker Lake in
Tordenskjold Township, requested a variance of 10’ from the required lot line setback of 10’ for the
placement of a holding tank 0’ from the lot line. Dan Ness represented the applicant at the public
hearing. The audience was polled with Mark and Julia Mosman expressing concern with the proposed
location for the new holding tank. After discussion and consideration, Randall Mann made a motion,
second by Steve Schierer and unanimously carried, to approve a variance of 5’ from the required side
lot line setback of 10’ for the placement of a holding tank 5’ from the lot line with the condition that the
applicants’ must obtain a letter of approval from the neighboring property currently owned by Darlene
Mosman.

We are the property owners @ lot 17 Ottertail River
park.
It is our observation that rather than increasing
hazards upon Hwy 72, this business should be required
to construct more parking.
We would recommend a parked vehicle space count be
made for the number of cars that can be parked on
their property and put a limit on the total number of
people in the building at ony one time. A closeur and
cash fine if caught over this amount.
Red lines should be painted on one side of the road
because the cars park on both sides of the road,
creating a traffic hazzad.
We enjoy their presence on the lake, but the traffic
problem MUST be addressed SOON.
We are against ANY additional hazards on this road.
Please Reply to this varience upon completion of the
meeting.

Reviewed the Variance Application materials submitted by Tom Hanson, Zorba’s. The application form was ^ incomplete. Also, the Variance Request was not specific as to the type of Variance needed. In reviewing the
drawing submitted with the application I determined that the proposed location of the cooler will be less than
“ 75 feet from the OHWL. It also appears that it may be less than 20 feet from the ROW on Highway 72. I also
reviewed the Impervious Surface Calculation sheet that Mr. Hanson submitted. He incorrectly used the area
“ of both the front (lake) and back lots to calculate his Impervious Cover at 13.1%. The Impervious Cover Ratio
_ of the front (lake) lot stands at 45% based on the figures he provided. Mr. Hanson will need to request an
increase in the impervious cover also. I discussed the application with Bill Kalar, because he is familiar with
- this property. He said that my assessment of the application was correct and I should return it with a letter
requesting clarification of the Variance Request (including impervious) and completion of the application form.
~ He told me that one of the inspector’s had been in his office not long ago asking about this very situation with
_ regard to Zorba’s. He could not remember which inspector it was. I told him that I could find no file notes
regarding anyone’s conversation with Mr. Hanson or anyone from Zorba’s recently.

Variance Application for Zorba’s of Otter Tail Lake, Inc., Lot 4 Otter Tail River Park, Otter

I have reviewed your application materials. Lam unable to process the application because there is
information missing from the application fprm. I also believe you will need to clarily your Variance
Request. Therefore l am returning your application materials and check #7813 ($300.00).
Please provide the following information (as highlighted) on the form:
1. Lake Number (56-242) and Lake Class (GD)
2. Section (4) Township (133) Range (40)
Your Variance Request should provide as much detail of the proposed project as possible to allow
the Board of Adjustment Members (Board) a complete picture. The request should specify the
Variance or Variances you are asking for. It appe^s^that the proposed location of the cooler will be
less than 75 feet from the lake; it also appears to be less than 20 feet from the right-of-way (ROW) to
Highway 72. If this is the situation please give the specific Variance distances from each of these
setbacks.
Also, your calculation of the. Impervious Surface was not correctly applied. The calculation would be
done using only the area of the front (lake) lot which you indicate as 7,792 square feet. The area of
the back lot is not used for the impervious calculation. According to the information you provided it
appears that the lot is currently at 45% Impervious Cover. Since that is the situation you will also
need to request a Variance to increase the impervious surface.
