This permit is granted subject to the following GENERAL and SPECIAL PROVISIONS:
GENERAL PROVISIONS
This permit is permissive only and shall not release the permittee from any liability or obligation imposed
by Minnesota Statutes, Federal Law or local ordinances relating thereto and shall remain in force subject to
all conditions and limitations now or hereafter imposed by law.
2. This permit is not assignable except with the written consent of the Commissioner of Natural Resources.
3. The Regional Hydrologist shall be notified at least five days in advance of the commencement of the work authorized I
hereunder and shall be notified of its completion within five days thereafter. The notice of permit issued
by the Commissioner shall be kept securely posted in a conspicuous place at the site of operations.
A. No change shall be made, without written permission previously obtained from the Commissioner of Natural Resources,
in the dimensions, capacity or location of any items of work authorized hereunder.
The permittee shall grant access to the site at all reasonable times during and after construction to authorized
representatives of the Commissioner of Natural Resources for inspection of the work authorized hereunder.
This Permit may be terminated by the Commissioner of Natural Resources at any time he deems it necessary for
the conservation of water resources of the state, or in the interest of public health and welfare, or for violation
of any of the provisions of this permit, unless otherwise provided in the Special Provisions.
Construction work authorized under this permit shall be completed on or before date specified above. Upon written
request to the Commissioner by the Permittee, stating the reason therefore, an extension of time may be obtained.
8. ■ The excavation of soil authorized herein shall not be construed to include the removal of organic matter (as
indicated above) unless the area from which such organic matter is removed, is impervious, or is sealed by
the application of bentonite after excavation.
In all cases where the doing by the permittee of anything authorized by this permit shall involve the taking, -
using, or damaging of any property rights or interests of any other person or persons, or of any publicly owned
lands or improvements thereon or interests therein, the permittee, before proceeding therewith, shall obtain
the written consent of all persons, agencies, or authorities concerned, and shall acquire al 1 .property, rights
and interests necessary therefore.

J 10.This permit is permissive only. No liability shall be imposed upon or incurred by the State of Minnesota or
any of its officers, agents or employees, official y or personally, on account of the granting hereof or on
account of any damage to any person or property resulting from any act or omission of the permittee or any
of its agents, employees, or contractors relating o any matter hereunder. This permit shall not be construed
as estopping or limiting any legal claims or right of action of any person other than the state against the
permittee, its agents, employees, or contractors, for any damage or injury resulting from any such act or omission,
or as estopping or limiting any legal claim or righ' of action of the state against the permittee, its agents,
employees, or contractors for yiolation of or failure to comply with the permit or applicable proyisions of
law.
11. No material excavated by authority of this permit nor material from any other source, except as specified herein,
shall be placed on any portion of the bed of said waters which lies below (as indicated aboye).
12. Any extension of the surface of said waters resulting from work authorized by this permit shall become protected
waters and left open and unobstructed for use by the public.
13. This permit does not obviate any reguirement for federal assent from the U.S. Corps of Engineers, 1135 U.S,
Post Office and Custom House, St. Paul, Minnesota 55101.
SPECIAL PROVISIONS
The permittee shall comply with all rules, regulations, requirements, or
standards of the Minnesota Pollution Control Agency and other applicable
federal, state, or local agencies.
I.
Spoil material shall not be placed on the beds of protected waters, and
wherever possible, such material should not be placed anywhere within areas
subject to flooding.
II.
Upon completion of construction, the bed of the protected water shall be
restored as nearly as practicable to the original cross-section.
III.
The permittee shall cover or protect all exposed soil resulting from the
construction authorized by placing riprap, sod, and/or seed on banks and slopes
of said construction for the prevention of soil erosion, sedimentation, and
lake/stream discoloration.
IV.
The permittee is authorized to place additional sand at the same location in
the future, for maintenance purposes, provided he does not exceed the
dimensions specified in this permit. Prior to commencing this maintenance, the
permittee shall advise the Department of Natural Resources of the volume of
sand to be placed. This sanding shall not commence until permittee's receipt
of the Department's approval.

1. APPLICATION FOR PERMIT TO place fill for a sand blanket on the northeast
shore of Pelican Lake in Otter Tail County, Minnesota. The applicant proposes
to place a 6-inch thick layer of sand over an area 600 feet along the shore and
10 feet lakeward of the ordinary high-wSter mark. Approximately 10 feet of
riprap would be placed between the sand blanket and an existing retaining wall
to the east.
The stated purpose of the project is to reduce shore erosion and provide a
more suitable swimming area.

QUANTITY AND TYPE OF FILL: Approximately 110 cubic yards of clean sand
would be spread on the shore by using a front-end loader and then leveled by
hand-raking. Approximately 3 cubic yards of fieldstone would be used for the
riprap transition area between the sand blanket and retaining wall.

This application is being coordinated with the U.S. Fish and Wildlife
Service and the National Marine Fisheries Service. Any comments they may have
concerning endangered or threatened wildlife or plants or their critical habitat
will be considered in our final assessment of the described work.
3. JURISDICTION: Pelican Lake is a tributary to the Bois De Sioux River, a
navigable water of the United States.
REGULATORY AUTHORITY: The application will be reviewed according to the
provisions of Section 404 of the Clean Water Act. Therefore, our public
interest review will consider the guidelines set forth under Section 404(b) of
the Clean Water Act (40 CFR 230).
NATIONWIDE PERMIT
Placement of riprap is authorized by an existing nationwide permit at 33
CFR 330.5(a)(13).
THE APPLICANT HAS STATED THAT THE FOLLOWING STATE AND COUNTY PERMITS HAVE

4. This Public Notice has been sent to the Minnesota Pollution Control Agency
and is considered by the District Engineer to constitute valid notification to
that agency for water quality certification. The Minnesota Pollution Control
Agency has indicated that it intends to review this project to determine the
appropriate action under Section 401 of the Clean Water Act. Any comments

5. HISTORICAL/ARCHAEOLOGICAL
This public notice is being sent to the National Park Service, the State
Archaeologist, and the State Historic Preservation Officer to determine if
there are known cultural resources which may be affected by the described
work. Any unknown archaeological, scientific, or historical data could be
lost or destroyed by the work described in the permit application. However,
the latest version of the National Register of Historic Places has been
consulted and no listed properties (known to be eligible for inclusion, or
included in the Register) are located in the project area.

6. PUBLIC INTEREST REVIEW
The decision whether to issue a permit will be based on an evaluation of the
probable impact, including cumulative impacts, of the proposed activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the proposal must be balanced
against its reasonably foreseeable detriments. All factors which may be
relevant to the proposal will be considered, including the cumulative effects.
Among those are conservation, economics, aesthetics, general environmental
concerns, wetlands, cultural values, fish and wildlife values, flood hazards,
floodplain values, land use, navigation, shoreline erosion and accretion,
recreation, water supply and conservation, water quality, energy needs, safety
and fiber production and, in general, the needs and welfare of the people.
7. REPLIES/COMMENTS
Interested parties are invited to submit to this office written facts,
arguments, or objections within 20 days of the date of this notice. These
statements should bear upon the suitability of the location and the adequacy
of the project and should, if appropriate, suggest any changes believed to be
desirable. Comments received may be forwarded to the applicant.
8. PUBLIC HEARING REQUESTS
Any person may request, in writing, within the comment period specified in
this notice, that a public hearing be held to consider this application.
Requests for public hearings shall state, in detail, the reasons for holding a
public hearing. A request may be denied if substantive reasons for holding a
hearing are not provided or if there is otherwise no valid interest to be
served.
