X 19_^_A ^ Y^ M//- /VDate of hearing: _____ MOTION AS FOLLOWS: Time: Motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to approve a variance of 125’ from the required ordinary high water level setback of 200’ on the north side of the applicant’s property and a variance of 113’ from the required ordinary high weter level setback of 200’ on the south side of the apjilicant’s property for the construction of a 26’ b'f^ garage 75’ from the ordinary high water level on the north side and 87’ from the ordinary high water level on the^outh side. It should be noted that this is the same location as previously approved on October 3, 1996, but the interpretation of the measurements in the first application was incorrect. Williams, Perham, MN, requested a variance of approximately 17’ from the required ordinary high water level setback of 75' for the partial enclosure of an existing deck approximately 58’ from the ordinary high water level. The property is described as Lot 28, Birchwood Subdivision, Little McDonald Lake in Edna Township. The audience was polled with no one speaking for or against the request. After consideration motion was made by John Everts, seconded by Cecil Femling and unanimously carried to deny the variance as requested. It was noted that there was not a substantial change from the request previously heard on September 5, 1996 and that the granting of the variance would make a substandard situation more substandard. After additional consideration, motion was made by John Everts, seconded by Cedi Femling and unanimously carried, to approve the enclosure of any part of the existing deck that does not extend past the front of the existing house. Duane Seifert - Approved Duane Seifert, Pelican Rapids, MN, requested a variance to subdivide a parcel of less than 5 acres from an existing 13.69 acre parcel for the purpose of conveyance to the property owner of Lot 30, Seifert Beach. The property is described as part of Government Lot 4, Section 29 of Dunn Township by Lake Lizzie. The audience was polled with no one speaking for or against the request. After consideraiton, motion was made by Cecil Femling seconded by Randall Mann and unanimously carried, to approve a variance to subdivide a parcel of less than 5 acres from an existing 13.69 acre 'cel with the condition that the parcel must be permanently attached to Lot 30, Seifert Beach. ryan S. Lonski, Battle Lake, MN, requested a variance of 125’ from the required ordinary high water level setback of 200’ on the north side of the applicant’s property and a variance of 113’ from the required ordinary high water level setback of 200’ on the south side of the applicant’s property for the construction of a 26’ by 46’ garage 75’ from the ordinary high water level on the north side and 87’ from the ordinary high water level on the south side. The property is described as Sub Lot 1 of Government Lot 3, Section 29 of Everts Township by Elbow Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to approve a variance of 125’ from the required ordinary high water level setback of 200’ on the north side of the applicant’s property and a variance of 113’ from the required ordinary high water level setback of 200’ on the south side of the applicant's property for the construction of a 26’ by 40^ garage 75^ from the ordinary high water level on the north side and 87’ from the ordinary high water level on the south side. It should be noted that this is the same location as previously approved on October 3, 1996, but the interpretation of the measurements in the first application was incorrect. Frank Donald Randall - Approved Frank Donald Randall, Underwood, MN, requested either a variance of 5’ from the required septic tank setback of 10’ and a variance of 7’ from the required drain field setback of 10’ for the construction of a garage 5' from the holding tank and 3’ from the drain field or a variance of 9’ from the required septic tank setback of 10’ and a variance of 7’ from the required drain field setback of 10’ for the construction of a garage T from the septic tank and 3’ from the drain field. The property is described as Lot 13, Basswood Ridge, South Turtle Lake in Tordenskjold Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Cecil Femling an unanimously carried, to approve Plan “A” as submitted by the applicant and as modified by the granting of the following variances: a variance of 3’ from the required septic tank setback of 10’ and a variance of 5’ from the required drain field setback of 10’. It was noted that the garage will be 7’ from the septic tank, 5’ from the drain field and 10’ from the side lot line. Hardship being a substandard lot of record. It was noted that the variances granted will provide the applicant with a reasonable use of his property.
