Hardship being the unique shape of the applicant’s property. Minneiota i MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT October 3,1996 The Otter Tail County Board of Adjustment met Thursday, October 3, 1996, with the following persons in attendance; Craig Anderson John Everts Cecil Femling Randall Mann Robert Schwartz George Walter Wayne Roisum, Land and Resource Management Wally Senyk, County Attorney Call to Order - The meeting was called to order at 6:30 p.m. by Chaimian George Walter. Minutes Approved - Hearing no corrections or additions the minutes of the September 12, 1996, meeting were approved as mailed. The following variance requests were heard: Michael J. Muellner - Tabled Michael J. Muellner, Papillion, NE, requested a variance to subdivide, by metes and bounds description, an unimproved 2.11 acre tract, with 300 feet of water frontage, into a 1.06 acre tract, with 150’ of water frontage, and a 1.05 acre tract, with 150’ of water frontage. The minimum size required for metes and bounds parcels within the shoreland area is 5 acres. The property is described as part of Government Lot 4, Section 21 of Hobart Township by Rose Lake. Dennis Happel, Attorney, represented Michael J. Muellner, the applicant, as well as. Gale Peterson, a potential purchaser, at the public hearing. The audience was polled with Jim Marcy and Larry Urback expressing concerns with the public road access, the filling that may be necessary, the drainage from the parcel after the filling has occurred and the building site locations. Gale Peterson addressed questions to the Board of Adjustment regarding the process to obtain the proper road access. Gale Peterson also informed the Board of Adjustment that she is currently working with the Planning Commission to receive the approval necessary before undertaking any filling of the property. A letter from Michael J. Muellner was read for the record. Michael Muellner requested that action on his variance application be tabled until such time that he is personally able to appear before the Board of Adjustment. After much discussion and consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to table this variance application, per the property owner’s request, until the property owner is able to personally represent himself at the Board of Adjustment meeting. Bryan S. Lonski - Approved Bryan S. Lonski, Battle Lake, MN, requested a variance of 103’ from the required ordinary high water level setback of 200, a variance of 52’ from the required ordinary high water level setback of 200’ and a variance to construct a two story garage having a height of less 18’ and being 97’ from the ordinary high water level on the south side and 148’ from the ordinary high water level on the north side. The property is described as Sub Lot 1 of Government Lot 3, Section 29 of Everts Township by Elbow (Bass) Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a variance of 108’ from the required ordinary high water level setback of 200’, a variance of 57’ from the required ordinary high water levelsetback of 200’ for the construction of a one story garage having no more than 1,220 square feet of area and being at least 92’ from the ordinary high water level on the south side and at least 143’ from the ordinary high water level on the north side.
