Lundeen 324855 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, August 2, 2007 The Otter Tail County Board of Adjustment met Thursday, August 2, 2007, with the following persons in attendance: Michael Harris Randall Mann Robert Schwartz Kurt Mortenson, Assistant County Attorney Mark Ronning, Land and Resource Management Paul Larson Steve Schierer Carl Zick Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the July 5, 2007 meeting as mailed. The Board of Adjustment considered the following applications for variance: Woodland Beach Resort Association, LLC - Approved the variance as requested. (6:30 p.m.) Woodland Beach Resort Association, LLC, part of Government Lot 3, Section 2 of Everts Township by Otter Tail Lake, requested a variance of 30’ from the required side lot line setback of 50’ for the following proposed development; We plan to remove the existing 28’ by 42’ single story cabin in it’s entirety and replace it with a 28’ by 42’ cabin with an "A” frame type loft 28’ by 21’. The structure would be placed on the precise footprint of the existing cabin but rather than being 13’ high to the peak of the roof, the new peak would be 21’ high. Woodland Beach Resort Association, LLC currently has 44 units. There will be 44 units remaining after the proposed development. Terri Tschakert, President of Woodland Beach Resort Association and Greg Norman, Owner of Unit 10, represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Robert Schwartz and carried with Paul Larson voting no, to approve a variance of 30’ from the required side lot line setback of 50’ for the proposed development as described in the Application for Variance dated June 13, 2007. Those voting in favor of the variance application noted that this action is consistent with other action taken by the Board in this immediate area. pws" ":mm 7-18-07: Woodland Beach Resort, Otter Tail Lake (56-242) Greg Norman called regarding the Conditional Use Permit that was approved regarding the replacement of his unit at Woodland Beach Resort. He had questions regarding the need of a Site Permit, the removal of his existing structure, and the Variance Application which will be considered in August. I informed Mr. Norman the following; 1. As stated in the information received with the Conditional Use Permit, the replacement structure could not be started with a valid Site Permit (posted onsite). 2. A Site Permit could not be processed until the Variance has been considered and approved. 3. He could remove the existing structure without a Site Permit. 4. He could not do any excavation without a valid Site Permit for the replacement structure. 5. The Variance request is scheduled for the 8-2-07 Meeting. Mr. Norman appeared to understand our conversation, including the fact that once a Variance has been considered it may be a week or better before notification of the results; and it is at that time, a Site Permit may be filed. . .a otter Tail County;'Planning Commission \^ne 13, 2007; Pane 3' “Lattimore Beach” / Phyllis Morton Nichols - Tabled To August 8, 2007; A Preliminary Plat of “Lattimore Beach” consisting of 3 Single Family Residential Lots, 1 Block. Jeff Thompson expressed concerns regarding the ownership of property. Merilyn Fischer indicated that the culvert should remain. Motion: A motion by Estes, second by Boyer to table (at the Applicant’s request) to August 8, 2007, to allow the Applicant to: 1. Address the issue (overlapping of ownership of land) identified in the Jeff Thompson Letter dated June 7, 2007. 2. Provide details (i.e. information from the County Highway Department) regarding access to proposed lot 3. All information must be received by Land & Resource Management no later than July 20, 2007. Voting: All Members in favor. “Sisters Three” / Jane R Meads et al - Approved With Conditions: A Conditional Use Permit Application (as stated by the Applicant): Proposing a 3 unit Common Interest Community Plat called Sisters Three on an existing 7.84 acre parcel on Stuart Lake including a topographical adjustment and construction of two proposed driveways occurring no closer than 350 feet from the shoreline. Motion: A motion by Trites, second by Estes, to approve as presented provided: 1. Cabin 3 must be removed when unit 1 is built or no later than 5 years. 2. Cabin 4 must be removed when unit 2 is built or no later than 5 years. 3. All other structures must be removed as stated on the plan. 4. The water-oriented-accessory structure (WOAS) must be legally relocated. 5. The well(s) must be legally sealed. 6. The septic system(s) must be properly abandoned. Voting: All Members in favor.
