Request for Forgiveness of Penalty
Perham Economic Development Director, Chuck Johnson, submitted a letter and requested,
on behalf of Barrel O'Fun, forgiveness of penalty of $535.20, due to a misunderstanding
regarding a JOBZ parcel. Motion by Froemming, second by Lee, and unanimously carried to
deny forgiveness of penalty, in the amount of $535.20, for parcel no. 77-000-99-0253-001,
because the error was not the fault of the County.
Correction of Typographical Error - Resolution No. 2005- 51A
Motion by Nelson, second by Lee, and unanimously carried to correct the spelling in Otter
Tail County Resolution No. 2005-51A (contained in the September 6, 2005 Board minutes)
from "Corbin Richer Excavating” to “Corbin Pickar Excavating.
Civil Process Fee-for-Service Schedule
Motion by Lee, second by Froemming, and unanimously carried to approve the Otter Tail
County Sheriffs Office Civil Process Fee-for-Services Schedule as presented by the Sheriff.
The change in the fee schedule is the addition of the following;
Under the Notes Section:
#1: Automatic increase to $.50 per mile if retail gas prices rise above $1.50 per gallon or $.55
per mile if prices rise above $2.00 per gallon; $.60 per mile if prices rise above $2.50 per
gallon: $-65 per mile if prices rise above $3.00 per gallon (and to keep adding an additional
$.05 per mile with eadi additional $.50 per gallon)
Bailiff Positions/Dispatch Services
Motion by Lee, second by Mosher, and unanimously carried to approve two additional, part
time Bailiff positions in order to increase the pool of people for this job. The Sheriff also
discussed dispatch services with the County Board.
Required Cell Phone Communications
GIS Coordinator, Brain Armstrong, and Physical Plant Manager, Rick Sytsma, discussed
various needs for cell phone communications, which are different for the various departments
and within departments based on the empioyees’ job description. A motion was offered by
Lee and seconded by Nelson to approve reimbursement to employees for required cell phone
coverage on a monthly auditor’s warrant, with the amount of the stipend and names of
eligible employees given to the Auditor’s office by the Department Head. Commissioners
requested a report on the policy in three months. Motion carried with Mosher opposed
because he is in favor of a flat monthly fee.
Final Plat - Ouren’s Beach
Motion by Mosher, second by Froemming, and unanimously carried to approve the Final Plat
known as “Ouren’s Beach", which is a two lot subdivision, part of GL 2, Section 26,
Township 133N, R. 40W, Everts Township, West Battle Lake.
Extension Requests
Land & Resource Director, Bill Kalar, presented a Conditional Use Permit extension request
for Woodland Beach Resort on Otter Tail Lake because of problems resulting from the
June 20*'’ storm and with the State of Minnesota concerning the proposed Resort Association.
Motion by Mosher, second by Lee, and unanimously carried to approve the extension of CUP
#5161 for Woodland Beach Resort until February 27, 2007, as requested.

Motion by Froemming, second by Lee, and carried with Nelson opposed, to approve the
original request for the Preliminary Plat known as “Squires Acres" consisting of 20 lots for
single family residential use and a Conditional Use Permit to construct a road to serve the
plat. The property is described as NE% NW% (39.5 AC) & Gov’t Lot 3 except tracts (.43 AC),
Section 13 of Rush Lake Township: Rush Lake (56-141).
Preliminary Plat & Conditional Use Permit - “Big Pine Resorf’/Alpine Assets, LLC:
Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat
known as "Big Pine Resort” consisting of 12 lots for single family residential use and a
Conditional Use Permit to construct a road to serve the plat with conditions as recommended
by the Planning Commission. The property is described as Part GL’s 1 & 2, Section 15 of
Pine Lake Township; Big Pine Lake (56-130).
Preliminary Plat - “Quiet Creek Estates’/Dennis & Maureen Richter:
Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat

Motion by Froemming, second by Nelson, and unanimously carried to approve the

recommended by the Planning Commission. The property is described as Part GL 3 Com

CUP #6151 Amended - Woodland Beach Resort. Otter Tail Lake (56-242):
Motion by Froemming, second by Lee, and unanimously carried to clarify that CUP #6151
allow additions to existing cabins and also, allow a single roof as presented in a drawing
received by Land & Resource Management March 31, 2005.
Amend 1/12/05 Approval - “North Turtle Lake Shores”/ Bothun Properties LLC:
Motion by Froemming, second by Lee and unanimously carried to amend the 1/12/05
approval to include the construction of the driveway (between Lots 1 & 2) as shown on the
Preliminary Plat Map, at the time of construction of the road.
Shoreland Management Ordinance Revision Discussion
Land & Resource Director, Bill Kalar, asked the Board if they wished to revise the SMO.
Discussion followed regarding the need to make some changes. Commissioner Lee stated
his opinion that major changes shouldn’t take place until a decision is received from the
Supreme Court. Continued discussion will take place.
Training for Planning Commission
Motion by Froemming, second by Nelson, and unanimously carried to approve per diem
($47.50 for CY2005) and mileage reimbursement ($.405 per mile) for Planning Commission
members interested in shoreland management training available in Alexandria, MN.

Additional Items:
Woodland Beach Resort Otter Tail Lake (56-242) - CUP #6151 Amended:
Bill Kalar discussed with the Commission a request from E.B. Floerish Jr. to amend
CUP#6151. This Permit allowed additions to existing cabins, and he is requesting that his
Permit also allow a single roof.
Motion: A motion by Wilson, second by Maske to allow the roofline as requested (drawing
received by Land & Resource Management March 31, 2005). Voting: All Members in
favor.
“North Turtle Lake Shores” Bothun Properties LLC - Amend 1/12/05 Approval:
Bill Kalar discussed with the Commission a request from Mr. Bothun requesting permission
to construct the driveway (as shown on the Preliminary Plat Map) at the time he constructs
the road (this was not requested on the Conditional Use Permit Application).
Motion: A motion by Trites, second by Boyer to include the construction of the driveway
(between Lots 1 & 2) as shown on the Preliminary Plat Map, at the time of construction of
the road. At the time of approval, it was the Commission’s intention that the driveway
would be constructed when they considered the request. Voting: All Members in favor.
Update on Otter Tail County’s Moratorium on Cluster Development:
Bill Kalar gave an update to the Commission indicating that next Tuesday (April 19, 2005),
the County Board needs to decide if they are going to revise the Shoreland Management
Ordinance and if they are going to extend the Moratorium on Cluster Development.
Adjourn: At 9:50 P.M., Chairman Olson set the Meeting. The next Meeting is scheduled
for 6:30 P.M. on April 20, 2005

Motion by Lee, second by Nelson, and unanimously carried to approve, with no waiting
period, the LG220 Application for Exempt Permit, as submitted by Pelican Rapids Area

Planning Commission Recommendations
Preliminary Plat & Conditional Use Permit - “South Shore’/BluebiU Shores, LLC:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Preliminary
Plat known as “South Shore” consisting of 11 lots for single family residential use and a
Conditional Use Permit to construct a road to service the plat, with conditions as
recommended by the Planning Commission. The property is described as GL 2 ex trs (16.19
Ac) & pt of GL 3...(3.98 AC) Section 7 of Otter Tail Township; Long Lake (56-210).
Conditional Use Permit - Woodland Beach Resort Assoc.. LLC:
Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional
Use Permit to install new footings and foundation under an existing cabin and install new roof
as presented. The property is described as Pt GL 3, Section 2 of Everts Township; Otter Tail
Lake (56-242).
Amendment of Conditional Use Permit- Woodland Beach Resort Assoc.. LLC:
Motion by Mosher, second by Block, and unanimously carried to allow a rotation of the roof
lines to run east and west to match the previously approved request and approve this
amendment to CUP #6151. The property is described as Pt GL 3, Section 2 of Everts
Township; Otter Tail Lake (56-242).
Preliminary Plat and Conditional Use Permit - “Johnson Lake Estates First Addition’YPinnacle
Land Deyelopment Inc:
Land & Resource Director, Bill Kalar, stated that this request was recommended for denial by
the Planning Commission for various reasons as documented. Glen Freeland, President of
Pinnacle Land Development, LLC, stated that, contrary to the Planning Commission’s
problems with the storm water drainage plan, he felt it was a very well done plan that follows
all Shoreland Ordinance regulations and stated that there is adequate building area on Lot 4.
He requested approval of the plan as presented. Motion by Mosher, second by Lee, to deny,
as recommended by the Planning Commission, the Preliminary Plat known as “Johnson Lake
Estates First Addition” and the Conditional Use Permit to service the plat for the reasons as
stated in the May 10, 2006, Planning Commission minutes. Chris McCann of Interstate
Engineering, stated that the MPCA rules must be followed in the erosion control plan and the
plan was acceptable to them. Mr. Kalar expressed concern with the erosion control plan and
the buildability of Lot 4 and the likelihood of a buyer of the property actually building in the
area(s) indicated. Chairman Froemming called for a vote on the motion for denial. Motion
carried unanimously. The property is described as Lot 2 ex tr. Lot 3 & pt SVi NE% lying
NWLY of Twp Rd ex N 6 rds of W 20 rds & ex tr. Section 9 of St. Olaf Township; Johnson

be 15 feet wide, 3 to 1 slope, est. cubic yards to be moved: 4000 (grade/cut/fill). The
proposed road originates from owner’s existing driveway and is not visible to any existing
residence, right-of-way or from the water. The property is described as Lot 1 ex trs & Lot 2
(54.22 Ac) and SW1/4 NW1/4 & Lots 2 & 3 ex tr (121.46 Ac) and Lots 4 & 5 ex tracts &

drainage ditch and place fill over the tiles to keep leaves and swamp material from going
into Big Pine Lake. We have enough fill from our house project (Permit #20391) to use so
we shouldn’t have to bring in any extra fill. The property is described as Pt of GL 4,
Section 15 of Pine Lake Township: Big Pine Lake (56-130), GD.
Frank & Bev Holzer represented the Application.
Dale Hendrickson indicated that the ditch takes the water from the north and it needs to be
maintained. Rachel & Larry Griegor expressed concerns regarding the need for the
drainage ditch.
Motion: A motion by Sha, second by Maske to deny, discussion has determined that
natural vegetation and landscaping could be an alternative. Voting: All Members in favor.
