Motion was made by Cecil Femling, second by Steve Schierer and carried with Mark Steuart and Paul Larson voting
no and with Richard Sha abstaining, to approve a variance of 18’ from the required side lot line setback of 50’ for a 16’
by 20’ addition to cabin number 9, which is located 32’ from the east lot line. It was noted that there are other
structures, which are closer to the lot line. It was also noted that Planning Commission approval is also required.

Luella D Knuttila - Approved as requested. (9:20 p.m.)
Luella D. Knuttila, Perham, MN, requested a variance in order to obtain a site permit to repair the roof on
existing cabin, which sits 68 to 77’ from the ordinary high water level and is 1 to 2’ in front of the string test
line. The cabin has a flat roof, which is leaking badly. A 4-12 pitched roof will be erected over the present
flat roof. The highest point of the pitched roof will be 17’ from the ground. No alterations will be made to
the size of the cabin. That will remain as is. The property is described as the south 10’ of Lot 10 and all of
Lots 11 and 12, Rose Lake Beach, Rose Lake in Hobart Township. The audience was polled with no one
speaking for or against the request. After discussion and consideration, motion was made by Cecil
Femling, second by Paul Larson and unanimously carried, to approve the variance as requested and as
depicted in the applicant’s application and drawing. Hardship is a substandard lot of record.

side lot line setback of 50’ for a 16’ by 20’ addition to cabin 9, which is located 32’ from the east lot line.
The property is described as Lots 8 through 13, Martin’s Perfect Beach, Big Pine Lake in Corliss Township.
The audience was polled with no one speaking for or against the request. After discussion and
consideration, motion was made by Cecil Femling, second by Steve Schierer and carried with Mark Steuart
and Paul Larson voting no and with Richard Sha abstaining, to approve a variance of 18’ from the required
side lot line setback of 50’ for a 16’ by 20’ addition to cabin number 9, which is located 32’ from the east lot
line, it was noted that there are other structures, which are closer to the lot line. It was also noted that
Planning Commission approval is also required.
Cheryl Boche - Tabled. (9:32 p.m.)
Cheryl Boche, Woodbury, MN, requested the following; “a variance of the 10’ setback requirement for a
sewage holding tank. The proposed cabin addition of 6’ would leave the dwelling 6’ 5” from the outside
edge of the holding tank. The present roofline does not allow for expansion in any other direction without
major rebuilding and cost." Request a variance of 3’ 7” from the required septic tank setback of 10’ for the
placement of a 6’ by 22.5’ addition to an existing dwelling 6’ 5" from the septic tank. The property is
described as Lot 79, Nedberg-Nye Survey Lots of Government Lots 1, 2 and 3, Section 1 of Edna
Township by Devils Lake. The audience was polled with no one speaking for or against the request. After
discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and
unanimously carried, with the verbal consent of the applicant, to table this variance request until the
October meeting of the Board of Adjustment for additional review and consideration by the applicants.
Other Business -
Letters from Clarence Johnson and from Bruce Faulken, Attorney for Clarence Johnson, regarding the
Bengston variance requests on Eagle Lake were provided to the members of the Board of Adjustment for
their consideration and review. Mr. Faulken also addressed the Board of Adjustment. After a period of
discussion and by general consent the Board of Adjustment decided that at this time the Board of
Adjustment had no authority to act on this matter. It was noted that the appeal period has passed. The
outcome of the previously granted variance may not be what some members of the Board expected, but
there does not appear to be any action the Board can take at this time.
Pat Eckert, Land and Resource Department brought forth the James and Linda Matter variance application
of Thursday, August 8, 2002. The proposed addition as requested in the variance application was 16’ wide
and 14’ 2” deep. The applicants were questioning whether or not the size of the proposed structure would
be varied. By general consent the Board of Adjustment informed Pat Eckert that the proposed size could
be changed.
With no further business, Randall Mann, Chairman declared the meeting adjourned at 10:00 p.m.
