You will recall that in the mid 1970's, Ed Savoy, Owner of the Bonanza Beach Resort, constructed a sewage treatment mound on the property servicing his resort. The mound was constructed by LeRoy Feldt of Frazee, MN. 1 The mound was constructed to meet the requirements of the Minnesota IDepartment of Health regulations. ^ Feldt submitted plans to our office, they were forwarded to the State Department of Health for approval. We no longer retain a copy of those plans. If you have further questions relative to this matter, please feel free to contact me. He said that since the system was installed before the Shoreland Ordinance was passed^the Health Department inspected and accepted it. However, I noticed two outhouses sitting by the dirt piles toward the back of your resort. Due to the elevation of your resort, if you wish to use these outhouses, they must be placed on sealed chambers. If you do not plan to use them as outhouses, they can be used for storage providing their seats are removed and the pits, if there are any, are filled. It may be easier to destroy them. Thank you for your cooperation during our septic snooper survey which has now been completed. A map showing the locations of plumes is in our Perham office. W. Savoie, Perham, Minnesota 56573 and is located on Big Pine Lake, No. 56-130, Section 31, Township 137N, Range 38W, Otter Tail County, Minnesota.Said sewage system was constructed according to Minnesota Department of Health approved plans and completed after May 22, 1972.The above mentioned system does not comply with the minimum requirements of the Otter Tail County, Minnesota Shoreland Management Ordinance that became effective on October 15, 1971 and said plans were never approved by Otter Tail County. The Minnesota Departm.ent of Health further agrees to assume all financial and other responsibilities that may accrue as a result of mandamus proceedings which may be instituted by any taxpayer or taxpayers of Otter Tail Coimty, Minnesota against any Otter Tail County board, Commission or individual employee charged with enforcing Section IV A 7 of the Otter Tail County Shoreland Management Ordinance and in no way shall the County of Otter Tail, Minnesota or any Otter Tail County Board, Commission or employee charged with enforcing said Ordinance be liable therefor. Savoie Bonanza Beach Resort Perham, Minnesota 56573 Dear Mr. Savoie: I regret to Inform you that the soil absorption system you are currently installing does not meet the minimum requirements of the Otter Tail County Shoreland Management Ordinance and cannot be approved by this office. Thia decision was reached after careful and thorough review of the Ordinance in conjunction with three on-site investigations of your system. The ground water table was five (5) inches below ground surface at the soil absorption area. The Ordinance specifically states that "Where it is necessary to fill an area for construction of tile laterals, the bottom of the tile trenches shall extend not less than one foot into the original soil."V It also states that "no soil absorption system shall be installed in an area where the water table is at any time less than 6^ (six and one-half) feet below the ground level or four (4) feet below the bottom of the drain field trench. (We require 3 foot elevation even for constructing a dwelling). 2.What is our position if a land owner in the lake would like to construct an Individual sewage system by adding 2^ feet of fill to land that is only 18 inches above water table (Lake level). 3.Please note that approval was granted three days before our Ordinance took effect.
