This greenhouse idea was something we were trying to do to supplement our income due to the low resort bookings for 2009. Or business is taking a big hit in this economy and we need to come up with something else to drive some revenue so we can pay our bills. As of now we £ire seeing about a 30% decline in bookings for 2009. This is going to be catastrophic, if things do not turn around. Because of this, we have to be creative and do something else to make money and this was one option. Our intention was to try it this year and see if it works. It is a temporary business and is only open from mid-May to mid-June so it fits into the resort when we are not full of people. We are running the whole operation under the Weslake Resort business so we can pay our sales tax under this name. I apologize for not knowing I had to have a conditional use permit to do this and put up a temporary structure on my property for this short period of time. As I mentioned earlier, we will remove the structure and discontinue the sales on or before June 15, 2009. If we decide this is a good strategy and we would like to do this more permanently or every year, we will complete the proper application process through your office. Bill as you know I have always been open and honest with you and I am not trying to do anything improper. Please accept my apology and know that I will follow the proper channels in the future. On October 17, 2006 the County Board of Commissioners passed a motion to approve the request as recommended by the Planning Commission. \ As you can see, there is a condition placed on this approval. Sincerely, ^ Marsha Bowman Office Manager ^t)TC Board of Commissioners’ Minutes * October 17. 2006 % Page 6 ConditionsWse Permit- Wes Lake Resort/Tom Masloski: J Motion by Froemming, second by Nelson, and carried with Mosher abstaining, to approve a Conditional Use Permit to increase dwelling units on-site from 13 to 15 and construct a 40 X 80 storage building, and replace cabin #12 with a new cabin within 5 years with a condition as recommended by the Planning Commission. Conditional Use Permit - Homeland Investment Co. #1: Land & Resource Director, Bill Kalar, reported that the Planning Commission recommended tabling this Conditional Use Permit because a citizen's petition had been filed with the Environmental Quality Board requesting that an Environmental Assessment Worksheet be completed for this road and driveway project. Mr. Kalar advised the Planning Commission that they had three choices as follows: 1) the project could be recommended for denial, 2) the project could be tabled for the preparation of an Environmental Needs Determination, or 3) the project could be tabled for preparation of an EAW. Commissioner Lee asked if building 800 ft. of road to County specifications requires an EAW. Mr. Kalar stated that, typically, it would not require an EAW; however, the reason, in this case, is because a citizen’s petition has been filed with the EQB and the County is required to respond to the petition. A final approval for the Conditional Use Permit request cannot occur until after it is determined whether or not an EAW is needed. Attorney for the Applicant, Paul Jenson, asked to address the Board on several points. He stated that the applicant was given no notice and the rules of the EQB to file a petition require specific notice to the applicant or developer. His opinion is that the citizen’s petition is defective because the rules regarding notice were not followed. His second point was that the Governmental Unit’s decisions are to require an EAW or deny the petition not the application. It was not presented this way at the Planning Commission. Mr. Jenson explained that the Applicant, Mr. Morken, requested that an EAW be completed at the Planning Commission because he had no advance notice of the petition and an EAW has already been prepared for the initial large project, so it seems that with a scaled back project only to build the roads, the current EAW would be sufficient. Thirdly, the petition is assuming and anticipating things that are not being requested in the CUP. County Attorney, David Hauser, responded to several points. First, the petition goes to the EQB and the EQB has directed the County to deal with the petition. If the developer did not receive notice, that is an issue for the EQB, not the County. He stated that the County is required to look at cumulative impacts of what might be anticipated. His opinion is that the County must require an EAW, deny the application, or complete a Needs Analysis to determine whether an EAW is necessary. Mr. Jenson disagreed with the County Attorneys’ determination. He read the following rules from the EQB: The RGU must make a decision about the petition within 30 working days of the day it was received. The RGU either grants the petition and requires the proposer to complete an EAW or denies the petition and decides that the Environmental Review is unneccessary. WesBake Resort Conditional Use Permit Application This request is for multiple improvements to Weslake Resort. We would like to do this in projects with a final completion within five years. Project A: Construct a new owner’s home that will also house the office in the lower level walkout. This will require additional drain-field lines to be added to the existing drain-field. Project B: Convert the existing owners home into a cabin. Project C: Construct a 40 x 80 pole shed to be used for storage of resort equipment. Project D: Add on to the existing office and convert it into a cabin. This addition will only be 15’ x 20’ and will be necessary so we can bury the water and electric so they come up in the middle of the addition. He provided a handout showing the total grant amount of $102,700.00 and the distribution of usage of the dollars. Mr. Kalar requested that some of the funds from the block grant be used for the salaries of two temporary summer positions to work on the sewage system abatement program. Motion by Lee, second by Froemming, and unanimously carried to authorize two summer, temporary positions to help with the sewage system abatement program and to approve the funding of the 2004 Natural Resources Block Grant as presented by the Land & Resource Director. The grant will increase the Intergovernmental Revenue Budget by $102,700.00 and increase budgeted expenditures by the same amount. Recess & Reconvene At 11:50 a.m.. Chairman Nelson recessed the meeting of the Otter Tail County Board of Commissioners for a Personnel Committee meeting and lunch break. The meeting was reconvened at 1:45 p.m. Eagle Display Motion by Block, second by Lee, and unanimously carried to authorize Rud Wasson to move the Eagle Display currently in the former Commissioners’ Room in the Courthouse subject to a written approval from the Osander Family (original owners of the display) and that the U.S. Fish & Wildlife Service is responsible for moving the display to the Prairie Wetland Center at no expense to the County. This permit expires on September 19, 2004. Cabin A was built during the winter of 2002/2003 and is currently generating revenue with sales and property tax benefits being paid to the state and county. My wife and I did a large portion of the work ourselves which caused us to have a very busy and non­ stop winter. Cabin B has not been built as we discovered the enormous amount of time and energy required to build the first cabin simply drained us of accomplishing such an ambitious goal of completing two cabins in two years. Therefore, we are requesting an extension of 2 years to our Conditional Use Permit #5981 which would allow us ample time to build this second cabin. The success of bookings in the first cabin has excellent, so we are confident a second cabin can and will be equally successful. We just need a large enough window of time to build this second unit without draining our energy levels.
