Preliminary Plat & Conditional Use Permit - “Bixbv Acres":
A Preliminary Plat request of “Bixby Acres” consisting of 15 residential lots, and a Conditional Use
Permit application to construct approximately 2,800 feet of road to service the proposed plat was
tabled in December to allow for the Planning Commission members to view the proposal. The
property is described as PT of GL 1 & 2 & Pt of the SW% of the SE% in Section 33 of Dead Lake
Township: Dead Lake (56-383) & Indian Lake (56-327). On March 13, 2002, the Planning
Commission approved the plan because there had been a reduction in the number of lots on
Indian Lake. Motion by Block, second by Nelson, to deny the Preliminary Plat because it does not
provide access. After much discussion. Nelson withdrew his second and Lee offered a second to
the motion. Chair Mosher called for a roll call vote:

as approved in the plan dated March 13, 2002, and contingent upon a dedication of a road on
Indian Point to access the northwest corner. Additionally a Conditional Use Permit was approved
to construct a road to service the proposed plat. Chair Mosher called for a roll call vote:

Lot 61. The property is described as GL 4 ex trs (36.15 AC) in Section 14 of Elizabeth Township:
Long Lake (56-784).
Conditional Use Permit - Mark K. Johnson & Mary E. Johnson:
Motion by Lee, second by Nelson, and unanimously carried to approve a Conditional Use Permit to
replace an unstable wood stairway to the lake with a no maintenance stairway. The property is
described as Lots 7&8 of Meyer’s Second Addition, Section 24 of Dora Township: Big McDonald
Lake (56-386).

Provide documentation that verifies the Helen Well’s property will have access. 7.
Dedicate a road right-of-way from the proposed cul-de-sac to the David Hagen property.
Milt Paulson (developer) and Jim Peterson & David Anderson represented the
Application.
Eric Gronner (Township Member) read a letter (on file at Land & Resource Management)
from the Township regarding the vacation of the existing Township Road. Bruce Leitch
indicated that as far as Lot 1 Block 2 becoming a public access, it is not yet final; he
expressed concerns regarding the density on the lakes and stated that the tax system
forces development. Bev Johnson stated that the lake is too small to have more density.
Phyllis Berqem stated that ecology, environment & aesthetics need to be addressed and
asked about an environmental study.
Motion: A motion by Estes, second by Maske to approve the revised plan (dated March
7, 2002) provided: 1. The road is vacated by the Township at their April 10, 2002
meeting. 2. The developer meets the conditions of the March 12, 2002 Township Letter.
3. The Wetland Technical Evaluation Panel’s concern in their January 3, 2002 letter is
addressed. Voting: All members in favor, except Schwartz.
Bixbv Acres - Approved as Presented:

Applicant’s request) to March 13, 2002 (providing it is viewable) to allow the Commission
members a chance to view the proposal.
Robert & Della Bjornstad and Jim Peterson & Dave Anderson represented the
Application.
Dave Nagel had questions regarding the type of structure that would be built across the
creek.
Motion: A motion by Lachowitzer, second by Sha to approve the plan dated March 13,
2002 as presented. Reason for approval being that there has been a reduction in the
number of lots on Indian Lake. Voting: All members in favor.

Prairie Point” / Angela Berqe - Approved with Conditions:
A Preliminary Plat of "Prairie Point” consisting of 11 Single Family Residential Lots, 1 BIk
and construct approximately 1400’ of road to County standards to service proposed plat.
The property is described as Pt of GL 3 in Section 4 of Dane Prairie Township: Wall Lake
(56-658), GD.
Motion - December 12. 2001: A motion by Trites, second by Lachowitzer to table (at the
Applicant’s request) the proposal to the first meeting next spring to allow the Applicant to:
1. Identify building sites (meeting the minimum 3’ elevation above the ordinary high
water level) onsite. 2. Identify building sites (meeting the minimum 3’ elevation above the
ordinary high water level) on the map. 3. Reduce the number of lots (i.e. 1-4). 4.
Dedicate a road right-of-way from the proposed cul-de-sac to Mound Road. 5. Drill test
holes and verify the ground water level separation in the building sites (include these test
hole sites on the map).
Richard Nepple had questions regarding the lot size requirements and the proposed
number of residents. Jeff Wachlarowicz expressed concerns regarding environmental
impact (fish spawning & bald eagles), he questioned the goals of the County in regards to
the development of all of the shoreline of lakes. Dave Thompson stated that this is a
spawning area and that he saw a bald eagle in this area yesterday. Joe Merz reiterated
the points that were just made and indicated that the Planning Commission could set
some perimeter and give the County Board encouragement in regards to preserving our
lakes.
Motion: A motion by Schwartz, second by Lachowitzer to approve the revised plan
(dated March 12, 2002) provided: 1. There must be a reduction of 2 lots, allowing a total
of 9. 2. Proposed lots 1, 2, 3, & 4 must be reduced to 3 lots and proposed lots 6, 7, 8, 9
& 10 must be reduced to 4 lots. 3. There may be a maximum of 5 common (joint) lake
accesses, these are to be shown on the final plat. Voting: All members in favor.
Break: at 8:15 P.M., the Commission took a 10 minute break.
“Pleasant Pointe” / Robert F. & Karen Perry - Approved with Conditions:
A Preliminary Plat of "Pleasant Pointe” consisting of 18 Residential Lots, 2 BIks and
construct approximately 3,500’ of road to Otter Tail County specs to service proposed
plat. Part of existing road (Pleasant Lake Road) is to be vacated prior to filing Final Plat.
The property is described as GL 10,11,12, & 13 in Section 5 of Sverdrup Township:
Pleasant Lake (56-449), RD, Little Anna Lake (56-450), NE, Little Pleasant Lake (56-
1127), RD.
Motion - December 12, 2002: A motion by Estes, second by Trites to table (at the
Applicant’s request) to March 13, 2002 to allow the Applicant to: 1. Provide
documentation from the Township verifying their approval for the vacation of the
Township Road. 2. Provide a plan showing what will be done with the vacated road. 3.
Provide a plan showing the proposed work that would be done on the Township Road
from County Flwy 35 to the Public Access. 4. Provide a map showing the location of the
proposed wetland mitigation. 5. Provide a map showing less lots (less density). 6.

Jerry Lovell indicated that traffic and safety is a big issue and requested denial. H.R, Lund
(speaking for neighbor, Vic Horn) expressed concerns regarding safety (traffic); stating that
the County need to address 2"*^ tier development.
Motion: A motion by Bergerud, second by Trites to deny due to concerns for safety and the
inappropriateness of this use in this residential area. Voting: All members in favor.
Olson’s Big Pine Get-A-Wav / Phillip T. Olson - Approved as Presented:
A Conditional Use Permit Application - Removed 2 cabins and in place of 2 cabins add 1
attached garage and addition to existing Lodge and make it our home. The now existing
home will be rented out as a cabin. Currently: 7 Recreational Camping Units, 3 Rental
Cabins and 1 Dwelling (residence). Proposed: 7 Recreational Camping Units, 4 Rental
Cabins and 1 Residence. The property is described as Jackson McKee’s Addition Lots 32,
33 & 34 & pt of Lot 35 & 36 BIk 1 in Section 14 of Pine Lake Township: Big Pine Lake (56-
130), GD .

Mark K. Johnson & Mary E. Johnson - Denied:
Currently the stairway to the lake is very dangerous. It makes it very difficult for our family
and parents: 1. Due to the unstable stairway to the lake we need to replace the existing
stairway. Currently the wood stainvay is dug into the hillside and is falling apart. We would
like to replace it with a permanent no maintenance stairway. To replace with retaining brick,
this would also help further erosion and be permanent and no maintenance. 2. Sod hillside
and plant various trees, shrubs and foliage to help erosion. Currently we are having a
problem with erosion due to the sandy soil on the hillside, there are many areas that are
washing out. This makes it very unstable and difficult to maintain. The property is described
- as Lots 7 & 8 of Meyer’s Second Addition, Section 24 of Dora Township; Big McDonald Lake
(56-386), RD.
There was not anyone present to represent the Application.
Motion: A motion by Estes, second by Lachowitzer to deny due to lack of representation.
