Motion
Lynn J. Johnson - Approved with conditions.
Motion was made by David Holmgren, second by Cecil Femling and unanimously carried, to approve a variance of 35'
from the required side lot line setback of 50’ for an 18’ by 30’ addition to an existing cabin located 15’ from the side lot
line with the condition that before a site permit can be issued an existing 8’ by 30’ trailer must be removed and with the
condition that, if necessary, appropriate approval must also be received from the planning commission. The granting
of this request made an existing substandard situation less substandard and is considered an overall net improvement
to the property.

Lynn J. Johnson - Approved with conditions.
Lynn J. Johnson, Battle Lake, MN, requested a variance of 35’ from the required side lot line setback of
50’ for a 15’ by 30’ addition to an existing dwelling located 15’ from the side lot line. The property is
described as Lots 3 and 4, Pleasure Beach Resort, Otter Tail Lake in Everts Township. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by
David Holmgren, second by Cecil Femling and unanimously carried, to approve a variance of 35’ from
the required side lot line setback of 50’ for an 18’ by 30’ addition to an existing cabin located 15’ from
the side lot line with the condition that before a site permit can be issued an existing 8’ by 30’ trailer
must be removed and with the condition that, if necessary, appropriate approval must also be received
from the planning commission. The granting of this request made an existing substandard situation
less substandard and is considered an overall net improvement to the property.
Darrel Stuart and Colleen Flaherty - Approved with conditions.
Darrel Stuart and Colleen Flaherty, S. St. Paul, MN, meet all minimum shoreland ordinance standards
for lakes with the exception of lot area and structure setback from the ordinary high water level. We
request a variance from standards be granted for the lot area and structure setback, (30’ from high
water). We would like to replace a trailer that is now on the property with a three season, one level, two
bedroom, one bath cabin, which will improve the appearance of the property. The property is
described as Lots 21 and 22, Silver View Park, Silver Lake in Everts Township. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, second by Randall Mann and unanimously carried, to approve the placement of the
applicants’ proposed structure approximately 30’ from the high water mark as depicted on the
applicants’ drawing with the following conditions;
1. The existing trailer and deck must be removed before the issuance of a site permit,
2. Only a deck having a height of 36” or less can be placed on the lakeside of the proposed
structure, and
3. The proposed structure can be placed no closer to the ordinary high water level than the
existing trailer (assumed to be approximately 30’ from the high water mark).
It was noted that the existing building line in the area is maintained by this variance and it was also
noted that the application of the string line test would not be appropriate in this situation as the property
to the west is vacant and will no be developed. The granting oHhe requested variance will provide a
reasonable use of the applicants’substandard property.
Trygve and Cheryl Olson - Original request denied. Application of string line approved.
Trygve and Cheryl Olson, Moorhead, MN, requested a variance to add a screen porch to the lakeside
of the cabin. The maximum outside dimensions of the addition would be 27’ wide, 9’ deep and 10’ high.
Setbacks Would be as follows: ordinary high water level 5T, does not hneet the standard request a
variance of 49’, west lot line 10’, east lot line 13’, road 70’ and structure height above ordinary high
water level 4’. The property is described as Sub Lot 4 of GovernmentTot 3, Section 20 of Dunn
Township by Lake Lizzie. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by David Holmgren, second by Cecil Femling and unanimously
carried, to deny the variance as requested as no adequate hardship had been shown and to allow
development by the applicants’ up to what would be permit by the string line.
