Minnosota MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, April 11, 2002 The Otter Tail County Board of Adjustment met Thursday, April 11,2002, with the following persons in attendance: Cecil F.emling , Randall Mann Steve Schierer Pat Eckert, Land and Resource Management Paul Larson Berton-Olson Mark Steuart Call to Order- Randall Mann, Chair, called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - ■^ffeahng no corrections or additions the minutes of the April 4, 2002 meeting was approved as mailed. The following variance requests were heard: Duane and Mary Lee Gubrud - Approved as requested. (6:31 p.rn.) Duane and Mary Lee Gubrud, Henning, MN, requested a variance of 3T from the required ordinary high water level setback of 75’ for the raising, by 48^ of a portion of a roof located approximately 44’ from the ordinary high water level. The property is described as Lot 3, Grace Etta Beach;:West Battle,;Lake in Girard Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Steve Schierer, second by Paul Larson and unanimously carried, to approve a variance of 31’ from the required ordinary high water.level setback of 75’, for the raising, by 48”, of a portion of a roof located approximately 44' from the ordinary high water level noting that the proposed project does not obstruct the view from the adjacent properties. It was also noted that the footprint of the existing structure is not changing. Twin Pines Resort - Approved with conditions. (6:37 p.m.) Twin Pines Resort; Richard C. and Charlotte Burns, Underwood,,MN„ requested a variance to subdivide a two-acre parcel from an existing 29.82-acre parcel. These two acres will be donated to Tingvold Lutheran Church for the purpose of expanding their existing cemetery. If-the variance application is approved the proposed subdivision will be surveyed and the resort will continue to operate as it currently does. The property is described as Reserve Lot A, Hatfield Addition, West Lost Lake in Maine Towriship. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Bert Olson, second by Steve Schierer and unanimously carried, to approve the proposed subdivision of a two-acre parcel from an existing 29:82 acre parcel with the condition that a registered surveyor’s drawing must be provided and with the condition that the property will be used as a cemetery. i. April II, 2002 Page # 2 Dean and Sandra Larson - Approved with condition. (6:40 p.m.) Dean and Sandra Larson, Elizabeth, MN, requested the following; " Our home sits on a ten acre plot of land that edges an unnamed lake. We have been paying taxes on ten acres for 19 years. When we applied for a permit to move Dean’s father into a mobile home on our land, we needed to have our land surveyed so it could be divided into 2 -5 acre plots. Anderson Surveyors found a 5-acre plot and a 4.98- acre plot. We are asking for a variance of two hundredths of an acre.” The property is described as the East Half of the East Half of the Northeast Quarter of the Northeast Quarter, Section 36 of Qscar . Township. The audience was polled with no one speaking for or against the request. After consideration, motion V(/as made by Cecil Femling, second by Bert Olson and unanimously carried, to approve the variance as requested with the condition that a registered surveyor’s drawing must be provided at the time of conveyance. Hardship is the fact that the legal description of the property, before the proposed subdivision, describes a 10-acre parcel, however, the survey determined that the parcel actually contained only 9.98 acres. William J and Della M. Nystrom - Approved as modified and with condition. (6:42 p.m.) William J. and Della M. Nystrom, Fargo, ND, requested a variance of 60’ from the required ordinary high water level setback of 100’, a variance of 10’ from the required shore^impact zone setback of 50’ and a variance of 5 to 7’ from the required side lot line setback of 10’ for the placement of a 12’ by 16’ storage shed 40’ from the ordinary high water level and 3 to 5’ from the side lot line. It should be noted that an existing 12’ by 22' storage shed located approximately 3 to 5’ from the ordinary high water level and 3 to 5’ from the side lot line will be removed. The property is described as Lot 8 and part of Lot 9, Hoffman’s Beach, West McDonald Lake in Dora Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 60’ from the required ordinary high water level setback of 100’, a variance of 10’ from the required shore impact zone setback of 50’ and a variance of 5’ from the required side lot line setback of 10’ for the placement of a 12’ by 16’ storage shed 40’ from the ordinary high water level and 5’ from the side lot line with the condition that the existing 12’ by 22’ storage shed located by the waters edge must be removed on or before August 31,2002. Hardship is a substandard lot of record. It was noted that this is a substantial improvement to the applicants’ property and that the granting of the variance is a good trade off which results in the removal of a 12’ by 22’ storage shed located 3 to 5’ from the ordinary high water level. Maurice R and Heidi J Schwartz - Approved as requested. (6:52 p.m.) Maurice R. and Heidi J. Schwartz, Wayzata, MN, requested a variance of 112’ from the required ordinary high water level setback of 200’ and a variance of 12’ from the required shore impact zone setback of 100’ for the construction of a 32’ by 12’ addition to an existing dwelling 88’ from the ordinary high water level. It should be noted that the addition would be on the backside of the existing dwelling. The property is described as Lot 34, Block 1, Brightwood Shoreline, Dead Lake in Star Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to approve a variance of 112’ from the required ordinary high water level setback of 200 and a variance of 12’ from the required shore impact zone setback of 100’ for the construction of a 32’ by 12’ addition to an existing dwelling 88’ from the ordinary high water level. It was noted that the proposed addition is to the rear of the existing dwelling and away from the water. Effective February 1, 1991, prior to the Shoreland Management Office Issuing the required permit, you will need Co provide them with a complete plan review form from the Health Department. The addition of permanent rooms and screened porches to recreational vehicled is not consistent with the Otter Tall County Recreational ■ Campground Ordinance, however this construction has been permitted by the Shoreland Management Office. This policy Interpretation error has . resulted In recreational camping vehicles being altered to the extent that they no longer meet the definition of a recreational camping vehicle. (Copies Enclosed). The existing construction will be allowed to remain as Is and will be evaluated by the County Health Department on an Individual basis during routine inspections. This Department will work with the campground owners in an effort to bring these structures Into compliance with current regulations.
