Preliminary Plat - “Wall Estates”A/Vendell Wall, et al & Thomas Gedde:
Motion by Froemming, second by Lee, and unanimously carried to approve the Preliminary Plat of
“Wall Estates” consisting of 3 single-family residential lots. The property is described as Part of
GL 2 (1.78AC), Section 29 of Otter Tail Township: Otter Tail Lake (56-242).
Preliminary Plat & Conditional Use Permit - “Oaks At Sand’7 Boqenbrook. Inc:
Motion by Lee, second by Block, and unanimously carried to approve the Preliminary Plat of “Oaks
At Sand” per the revised plan dated June 4, 2001, and a Conditional Use Permit to construct a
road to service the plat with conditions as recommended by the Planning Commission. The
property is described as Lots 4, 5, & SE% and Lot 6, SE%SW% & SWViSE’/i, Section 36 of
Scambler Township: Sand Lake (56-942).
Conditional Use Permit - Charlotte & Richard Burns:
Motion by Froemming, second by Lee, and unanimously carried to deny a Conditional Use Permit
as recommended by the Planning Commission. The property is described as Residential Lot A,
Hatfield Addition, Section 32 of Maine Township: West Lost Lake (56-481).
Conditional Use Permit - Riverfront Lounge
Land & Resource Director, Bill Kalar, reported that he has received a letter from
Beatrice Richardson, owner of the Riverfront Lounge, requesting that her name be removed from
the Conditional Use Permit allowing tube rentals from the business. County Attorney,
David Hauser, researched the issue and reported that the language of the statute states that once
granted, the Conditional Use Permit exists unless conditions are violated. The Conditional Use
Permit runs with the land and it is not issued to the individual. The County Attorney will draft a
letter in response to her request.
Recess and Reconvene
At 12:05 p.m.. Chair Froemming recessed the meeting of the Otter Tail County Board of
Commissioners for lunch break and a committee meeting. The meeting was reconvened 1:28
p.m. with Commissioner Nelson, Lee, Froemming, and Block present and Commissioner
Dennis Mosher absent.
Approval of Payment
Motion by Nelson, second by Block, and unanimously carried, to approve payment to the Otter Tail
County Humane Society, in the amount $557.50, for costs incurred under Minnesota
Statute 343.23 (Compliance checks and removal costs - Ken Teeters).
Authorization for Exemption for Lawful Gambling Application
A motion by Nelson, second by Froemming, and unanimously carried, to approve, with a 30 day
waiting period, the St. Lawrence Church’s application for exempt permit for an event scheduled for
August 5, 2001.
Approval of License Applications
Motion by Nelson, second by Lee, and unanimously carried, to approve the following applications
for license:

retire but would like to keep our home and live there. We feel that this would be an
amicable solution for us and the buyers we have found. Please consider this as a

P.M. in the Commissioner’s Room, Courthouse, Fergus Falls, Minnesota.

Members Present: Linda Bergerud, Rod Boyer, Les Estes, Frank Lachowitzer, Joe
Maske, Bert Olson, Robert Schwartz, Richard Sha, David Trites and Leona Zimmerman. Max D. Bovie - Approved With Conditions:
A Conditional Use Permit Application stating: Bakery offering “made from scratch” bread,
sweet rolls, pies, cakes, cookies, etc. Workforce permitting, plan to serve ice cream.
Emphasis will be on “to go”. Minimal seating. Plan to have seating for approximately 20.
Open 6:00 a.m. to 8:00 p.m., Thursday through Sunday plus Monday holidays. The
property is described as GL 16, Section 35 of Maine Township; Mud Lake (56-445), GD.
Member Absent: None.
Michelle Eldien represented the County Attorney’s Office and Bill Kalar represented the
Land & Resource Management Office.

Minutes of April 11. 2001: A motion by Schwartz, second by Lachowitzer to approve
the April 11, 2001 Minutes as corrected (Pleasant Grove First Addition, Otter Tail Lake
(56-242) should read “second by Trites”). Voting: All members in favor.
Motion: A motion by Lachowitzer, second by Bergerud to approve as presented with the
following conditions: 1. There must be 6 designated parking spaces (one of which must
be for handicap parking) onsite. 2. The signs (2) must not exceed 4’ x 8' in size, 12’
maximum height. 3. The signs may be lit only between the hours of 6:00 a.m. and 8:00
p.m. The Applicant may sell trailers onsite.
Minutes of April 18. 2001: A motion by Boyer, second by Schwartz to approve the April
18, 2001 Minutes with an addition of “for two cluster developments’, (the motion should
read - “to deny the request as presented since the request exceeds the Ordinance
standards for two cluster developments.”! to the motion on Scenic Point Resort, Clitherall
Lake (56-238). Voting: All members in favor.

Sunset Bay Resort/ Mark & Jocelvn Kerr-Tabled to July 11. 2001:
A Conditional Use Permit Application to request the addition of 6 campsites as shown on
the drawing (available at the Land & Resource Office, Courthouse, Fergus Falls MN).
Four campsites are cun-ently operational as allowed without state license. The additional
sites will permit us to accommodate the increasing numbers of requests we receive for
campsites - some of which are family groups also renting cabins. The additional
campsites will not crowd the area, as plenty of open, natural space remains. The resort
property is approximately 12.2 acres, or 531,432 fp . Buildings, roads and other
impervious spaces account for approximately 27,893 fp, or only about 5.25% of the total
grounds. If approved, the resort would consist of 1 residence, 7 rental cabins, and 10
campsites. The property is described as S 550’ of GL 4, Section 16 of Dead Lake
Township; Dead Lake (56-383), NE.
No Formal Action: Bill Kalar informed the Planning Commission of the following:
1. After the last Meeting, he contacted Bruce Winterfelt, DNR Trails & Waterways
and found that there are 25 public accesses on lakes of 51 to 289 acres
(Belmont Lake (56-237) is 275 acres) in Otter Tail County.
2. After the last Meeting he contacted Russ Schultz, DNR Shoreland Hydrologist
and found that when the density calculations for cluster developments are
calculated in Otter Tail County, our Shoreland Management Ordinance is more
restrictive than the State standards. Mr. Schultz informed Mr. Kalar that he does
calculate the density correctly (requiring the doubling of lot size for the 2’*' and
beyond tiers on all lakes).
