motion was made by David Holmgren, second by Steve Schierer and carried with Mark Steuart abstaining, to approve
a variance of 40’ from the required lot line setback of 50’ for the construction of a 26’ by 40’ building, having a height of
16’, 10’ from the property line. It was noted that the property to the north cannot be developed due to the topography
and terrain of that property. It was also noted that placing the structure in this location would not restrict the view from
the neighboring properties. The applicant’s proposal will clean up the immediate area and will enhance the business.

Debra A. Troje, Richville, MN, requested a variance of 40’ from the required lot line setback of 50’ for
the construction of a 26’ by 40’ building 10’ from the property line. The property is described as the
North 260’ of the South 734’ of Government Lot 3, Section 16 of Dead Lake Township by Dead Lake.
The audience was polled with no one speaking for or against the request. Letters from Senter Seven,
Inc. and Don Krippner in support of the applicant’s request were read for the record. After
consideration, motion was made by David Holmgren, second by Steve Schierer and carried with Mark
Steuart abstaining, to approve a variance of 40’ from the required lot line setback of 50’ for the
construction of a 26’ by 40’ building, having a height of 16’, 10’ from the property line. It was noted that
the property to the north cannot be developed due to the topography and terrain of that property. It was
also noted that placing the structure in this location would not restrict the view from the neighboring
properties. The applicant's proposal will clean up the immediate area and will enhance the business.
George E. and Margaret A. Gouette - Approved
George E and Margaret A Gouette, Dent, MN, requested a variance to extend kitchen 5’ to east,
currently a deck by dedicated road, and extend deck to end of house 6’. Deck will be 13’ from road and
addition 5’ from road. It should be noted that road means road surface and not the road right-of-way.
The property is described as the East 67’ of Lot 1 and that part of Lot 6 across the road and South of
same. Evergreen Glen, Star Lake in Star Lake Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Cecil Femling, second by
Joe Maske and unanimously carried, to approve a variance which would allow for the extension of the
kitchen 5’ to the east and which would allow the extension of the deck to the end of the house as
depicted on the applicant’s drawing dated April 28, 2000. It was noted that the applicants’ proposal is
behind the home away from the lake and will be no closer to the road then the existing structure.
Wallace A. and Pearl M. Simunds - Denied
Wallace A. and Pearl M. Simunds, Fargo, ND, requested a variance of 52 to 54’ from the required
ordinary high water level setback of 75’ for the placement of 12’ by 12' screen porch, having an overall
height of 15.5’, approximately 21 to 23’ from the ordinary high water level and 10’ from the side lot line.
The applicants’ lot is 75’ by 105’. The property is described as Lot 5, Anderson Beach Addition, Pelican
Lake in Scambler Township. A letter from Terry R. Lejcher, Area Hydrologist with the Department of
Natural Resource, opposing the applicant’s request was read for the record. Mr. Lejcher’s letter
indicated that other options may be available to the applicant and that the hardship required by
Minnesota Statutes necessary for the granting of a variance is not evident. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, second by David Holmgren and unanimously carried, to deny the variance as requested as no
adequate hardship had been shown unique to the property that would allow for the granting of the
variance as requested, noting that the proposed development is within the shore impact zone and
noting that it appears that a deck has been reconstructed without a permit.
