Olson and unani­ mously carried, to uphold the decision of the Otter Tail County Plan­ning Commission and deny the application of Ralph Roforth, Rush Lake Township, to cut a ramp area to lake. CONDITIONAL USE PERMIT DENIED Motion was made by Sydney Nelson, seconded by Hub Nordgren and unani­ mously carried, to schedule a hearing to be held Wednesday, June 1, 1988, at 2:00 p.m. in the County Commissioners Room, Courthouse Fergus Falls, MN for the purpose of hearing from various interested parties, on the proposed surface water ordinance for Round Lake in Rush Lake Township. HEARING - ROUND LAKE WATER SURFACE ORD. Fred Moen of Corporate Risk Management, the County's insurnace con­ sultant, appeared before the Board and discussed the contract with the County, stating an additional provision has been inserted in the contract to include a 30 day cancelation clause. Motion was made by Mel 0. Olson, seconded by Sydney Nelson and unanimously carried, to approve the contract, subject to review and approval by the County Attorney. CORP.RISK MANAGERS A request from Sverdrup Township for reimbursement in the amount of $315.00 for the taking of 21 beavers was presented to the Board. Motion was made by Andy Lindquist to approve payment, but the motion died for lack of a second. BEAVER CONTROL SVERDRUP TOWNSHIP Erwin Siems, County Assessor, discussed with the Board assessing for Leaf Lake Township, stating a check in the amount of $1 ,600 had been received from Leaf Lake Township, which is $500.00 less than the amount the county had agreed upon. Motion was made by Andy Lindquist, seconded by Mel 0. Olson and unanimously carried, to accept the check as partial payment, instructing the County Attorney to write to the township requesting the additional $500.00 as previously offered by the County Board. LEAF LAKE ASSESSING Siems also informed the Board additional townships are requesting assessing to be done by the County Assessor's staff, which he indicated would require additional part-time help. No formal action taken. Court House, Fergus Falls, Minnesota 56537. Members Present: Mike Ackley, Cecil Femling, Noble Hatling, Frank Lachowitzer, Reba Lee, Bert Olson, Victor Petterson, Jr Robert Schwartz, Tom Stringer, David Trites. Mike Kirk. County Attorney; Wally Senyk, Assistant County Attorney and Bill Kalar, Land & Resource Management were also present. • • Members Absent:None A motion by Petterson, second by Lachowitzer to approve the minutes of the March 2, 1988 meeting as mailed. Approved: Voting: Motion carried. A motion by Lee, second by Femling to deny the conditional use application of Ralph Roforth, Marion Lake, 56-243, GD, on the W 200' of N 225' of Lot 3 & Road, Section 5, Rush Lake Township, reason being that there would be erosion that would be detrimental to the lake and it would be a difficult project to stabilize, and that there is a public access nearby. Frank Lachowitzer abstained from this motion, he represented the applicant. Denied: Voting: Motion carried. Motion Failed; A motion by Schwartz, second by Lee to approve the conditional use application of Paul I. Thompson & Robert Marx, Otter Tail Lake. 56-242, GD, in a Tract in G.L. 3 (AKA Square), Section 31, Otter Tail Township providing that the Board of Adjustment grants a variance on the number of units. Reason being that it is compatible with the surrounding area, example being the Balmoral Condos. Gary Oster, Balmoral Estates Homeowner's Association expressed concerns as did Janet Johnson regarding this project. Balmoral Voting: Motion failed. Planning Commission April 6, 1988 Page 2 A motion by Stringer, second by Olson to reconsider the prior motion on the conditional use application of Paul I. Thompson and Robert Marx. Reconsidered! Voting; Motion carried. A motion by Femling, second by Stringer to amend the original motion for Paul I. Thompson & Robert Marx, approving up to 7 condo units and up to 7 garages providing that the Board of Adjustment grants a variance on the number of units allowed. Amended; Voting; Motion carried. The Amended Motion for the conditional use application for Paul I. Thompson & Robert Marx is to approve a maximum of 7 condo units and 7 garages; also to permit the construction of the addition as requested on the drawing. Approved; A motion by Olson, second by Stringer to deny the conditional use application of Richard & Dorothy Neudahl, Spitzer Lake, 56-160, NE, in Pt. of G.L. 7, Section 17, Leaf Mountain Township as requested. Reason being it would create a tunnel effect and this request is not condusive to the area. Motion was withdrawn. Withdrawn: A motion by Olson, second by Stringer to deny the conditional use application request of Richard & Dorothy Neudahl and to approve (using as a reference the grid sketch attached to the application) to allow a maximum cut of 4' on the Nly approximately 1/2 of the home - lakeside; any grade in the excavation must have a 3-1 slope and the lakeside excavation can be no more than 35' lakeside of the home; the disturbed area must be stabilized by use of sod - and done as soon as possible. Reason being this permitted use would create a minimum change in the topography. Approved; Voting; Motion carried. A motion by Stringer, second by Olson to approve the conditional use application of Verlyn Dornburg, South Turtle Lake, 56-377, RD, on Lot 3, Block 2 and Lot 6, Block 1 of Lakeside's Rolling Woodlands, Section 36, Sverdrup Township allowing a maximum of 200 yards of dirt to be removed from E 1/2 of Lot 3, Block 2 and use for top dressing on Lot 6, Block 1; the excavation shall be allowed from April 15, 1988 to April 15 , 1989 for the removal of the dirt and to allow until June 1, 1989 for the placement of the dirt.
