Motion by Nelson, second by Lee, and unanimously carried to approve an after-the-fact
Conditional Use Permit to fill in driveway for access for larger vehicles with conditions as
recommended by the Planning Commission. The property is described as Buchanan Oaks
Lots 6 & 7, Block 1, Section 35 of Rush Lake Township, Buchanan Lake (56-209).
Conditional Use Permit - Mark & Barb Lenius:
Land & Resource Director, Bill Kalar, reported that this CUP request to build a road was
recommended for approval by the Planning Commission. Larry Olson stated that he is an adjacent
property owner and spoke in opposition to the location of this proposed road. He stated that the
road will traverse a runoff area that will be forced onto his property and if the location could be
moved a little further north, there would be no impact on either property. Motion by Nelson,
second by Block, and carried with Lee opposed, to approve a Conditional Use Permit to build a
road with conditions as recommended by the Planning Commission. The property is described as

A Preliminary Plat of “Clear Lake Landing” consisting of 9 single family residential lots, 1
block. The property is described as Pt GL 1 lying NWly of Ed’s Clear Lake Beach,
Section 23 of Tumuli Township; Clear Lake (56-559), RD.
June 12, 2002 / Motion: A motion by Sha, second by Maske to table, with the Applicant’s
approval, to July 10, 2002 to allow the Applicant to: 1. Stake the lots onsite. 2. Provide
a new plat plan showing the elimination of Lot 8 (add the area to lots 7 & 9). 3. Provide
Land & Resource Management a Preliminary Title Opinion that has been prepared by an
attorney. 4. Include on the new plat plan any existing draintiles. Voting: All Members in
favor.
Bud & Barbara Jo Nelson represented the Application and Jim Peterson (Anderson Land
Surveying) represented the Application.
Motion: A motion by Sha, second by Maske to approve the June 24, 2002 Revision (7
lots) as presented. Voting: All Members in favor.
Break: at 7:45 P.M., the Commission took a 15 minute break.

purchased (waiting to see results of meeting, mobile will be no bigger than 14’ x 70’).

John Barry (Jim Jensen) - Denied:
A Conditional Use Permit Application to alter topography of site by filling a small Type 2
wetland. Fill is needed to stabilize 5’ retaining wall and reduce run-off into ground water
and adjacent lake. Area will be converted to manicured lawn. The property is described
as Provan Beach, Lot 23 & Vac Rd Adj Ex Pt Vac Rd Being 32.26’ x 5.13’ x 33.5T x

John Anderson represented the Application.
Motion: A motion by Sha, second by Lachowitzer to deny for the following reasons: 1.
By filling the wetland without a permit, the hydrologic benefits of the wetland have been
destroyed. 2. The Application stated that the Applicant would purchase mitigation
property and the documentation filed with the Application states it would be an easement.
3. If this Application had been considered prior to the work being done, it would have
been denied. Voting: All Members in favor.
