George Walter Pat Eckert, Land and Resource Management Barbara Hanson, Assistant County Attorney Call to Order - Chairman George Walter called the meeting to order at 6:30 p.m. Minutes Approved - Hearing no corrections or additions the, minutes of the September 10, 1998, meeting was approved as mailed. The following variance requests were heard: William and Janet Schicker - Approved ’ William land Janet Schicker, Richville, MN, requested a variance of 20 to 25’ from the required property line setback of 50’ for the placement of a double wide home approximately 25 to 30’ from the property line. The property is described as part of Government Lot 1, Section 13 of Amor Township by Otter Tail and Walker Lakes. A letter from Hans A. Ronhovde in favor of the applicant’s request was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried, to approve a variance of 30’ from the required property line setback of 50’ for the placement of a double wide home 20’ from the property line noting that the 20’ road right-of-way setback will be maintained, the legal setback from the well and septic systems will be maintained and no additional commercial dwelling sites are being added as a result of this variance request. It was noted that this unit replaces the applicants’ existing dwelling. Hardship is the existing easements, power line and sewer system locations on the applicant’s property. 'j- I.' The transcript of the agreement on the record states, “the area within the 80-foot radial arch must be level and completely drivable.” Grade & Fill Permit No. 04974 does not comply with the terms of that agreement; it calls for a “50' cul de sac” and its map shows sloped surfaces. Mr. Karkela requested my clients to develop schematics. Enclosed are four concept drawings that Mr. and Mrs. Lindemann have developed. The bold lines are their proposals. The purpose of the cul-de-sac/tum around is to replace the looped roadway that the Schickers and other owners of Swans Point/Viking Resort want to close/vacate. All of the concepts include the vacation of the roadway that lies west of Mr. and Mrs. Lindemann’s lot and east of Mr. and Mrs. Bommersbach’s lot. In these concepts, Mr. and Mrs. Lindemann are using a 50 foot radius pursuant to a graphic standard that indicates a 50 foot radius will accommodate most trucks, i.e. garbage trucks, delivery tmcks, and pickups or SUVs towing boat trailers which errantly drive into the area, etc. The cul-de-sac will allow most trucks to turn around and exit, without driving on anyone’s lawn. Concept 1 places major portions of the cul-de-sac on the current easement areas and the eastern portion of Cottage 11 area, which is possessed by Mr. Radziszewski. It places the eastern edge of the cul-de-sac at the eastern edge of the road as currently traveled. This proposal would probably be most acceptable to those property owners to the east, though it does not affect their title. Concept 2 is fairly similar, but simply moves the cul-de-sac about 20 feet further east so that it comes close to the eastern edge of the deeded easement area. This places the cul-de-sac closer to the neighbors to the east, but again, does not affect their title. Although the Cottage 11 area does not have a house or garage on it, it is our understanding that Mr. Radziszewski plans to build a house and garage on it; that the house would lie immediately south of the road area to be vacated; that the garage would be immediately west of the cul-de-sac area, and that Mr. Radziszewski would also use the cul-de-sac and the driveway south of the cul-de-sac. Concept 2 creates a tail to the west of the cul-de-sac. This tail area is largely the area that Mr. and Mrs. Lindemann, as well as their predecessors, have used as a driveway and parking area. They ask that that 80 x 33 foot tail be deeded to them in fee simple so that they can control the area and place appropriate signage or lawn ornaments to discourage the public from entering upon it, as the public will be using the cul-de-sac. Concept 3 creates a 33 x 80 foot turnaround area south of the driveway easement depicted on the 1962 map of Knud Madsen, south of the current road as driven, and south of Mr. and Mrs. Lindemann’s lot. This is the location where Mr. and Mrs. Lindemann and their predecessors have parked. This is probably the least practical design to accommodate people turning around. Concept 4 creates a 50 foot cul-de-sac at the end of the road and south of Mr. and Mrs. Lindemann’s lot (where a cul-de-sac should be located), but would place it further east onto the Cottage 11 area. The Lindemarm’s propose that either Concept 1 or 2 be used, as they have the most common benefits for all parties concerned. Concepts 1 and 2 utilize the eastern portion of Cottage 11 area, which is the less buildable area for the possessor of that area given its triangular shape and lot line set back requirements. Concepts 1 and 2 require less dirt work than Concepts 3 or 4. However, if certain persons want to use Concepts 3 or 4, those proposals could be made to work as well, but may involve some adjustments. What is the proposed total amount (cubic yards) of soil to be moved for this project? Please note that our Office’s authority is limited to earthmoving projects involving 300 cubic yards or less. 5. What temporary and/or permanent erosion control measures will be implemented? While I am reluctant to delay the resolution of this matter, it may be necessary for our Office to review your proposal onsite once the existing snow cover is gone. I have relayed to Mr. Karkla, the attorney for Schickers and the numerous fractional owners, the concept of creating a cul-de- sac south of Mr. and Mrs. Lindemann’s property line, as you believe that a cul-de-sac could be constructed in that portion. Mr. Karkla has indicated that his client’s are willing to consider a “turnaround area large enough to accommodate a large vehicle. Given the maximum road width of a vehicle being 8 1/2 feet, and given that we are dealing with extended cab pickups with boat motor and trailer attached, a vehicle can easily become 40 feet long. W'ouid Land and Resource Management and the county approve the constmction of a 100 foot diameter cul-de-sac or some other dimension and a dirt permit for clearing that area? Enclosed is a diagram depicting such proposed driveway easement outlined in purple, turnaround area in red, and parking area in yellow. ; If you could respond within the next week, it would be greatly appreciated, as this case has a court hearing on February 21, and the parties would have to work out logistics within the confines of your parameters.
