Call to Order - Chairman George Walter called the meeting to order at 6:30 p.m.
Minutes Approved -
Hearing no corrections or additions the, minutes of the September 10, 1998, meeting was approved as
mailed.
The following variance requests were heard:
William and Janet Schicker - Approved
’ William land Janet Schicker, Richville, MN, requested a variance of 20 to 25’ from the required property
line setback of 50’ for the placement of a double wide home approximately 25 to 30’ from the property
line. The property is described as part of Government Lot 1, Section 13 of Amor Township by Otter
Tail and Walker Lakes. A letter from Hans A. Ronhovde in favor of the applicant’s request was read for
the record. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried,
to approve a variance of 30’ from the required property line setback of 50’ for the placement of a double
wide home 20’ from the property line noting that the 20’ road right-of-way setback will be maintained,
the legal setback from the well and septic systems will be maintained and no additional commercial
dwelling sites are being added as a result of this variance request. It was noted that this unit replaces
the applicants’ existing dwelling. Hardship is the existing easements, power line and sewer system

MEMO
OTTER TAIL COUNTY ATTORNEY
218/998-8400
TO: Bill Kalar
From: David J. Hauser
Date: 1-16-08
Re: Grade and fill permits
This memo is to confirm our earlier conversation in which I advised you that your authority to issue
grade and fill permits is authorized by our Shoreland Management Ordinance. It is a delegation
specifically given to you in certain circumstances. You are to consider those circumstances and issue or
not issue a permit based upon our Ordinance.
I understand there are some circumstances where parties involved may have some side agreements or
there may even be some court orders which would either prohibit the work being proposed or allow for
more work being performed. In either event, those agreements or court orders would apply to the
circumstance, but that would be left to the parties to enforce. It would not affect whether or not you can
or should be issuing the grade and fill permit. Your decision is based on the ordinance and the facts on
the ground.

Court File No.: C3-05-306
Re:
Gentlemen:
As a follow up to Grade & Fill Permit No. 04974.1 obtained a copy of the parties’ settlement
agreement that was read onto the court record. The portion dealing with the turnaround calls for
a level turnaround across the entirety of the 80' radial arc from the Narr property’s most southerly
comer. The transcript of the agreement on the record states, “the area within the 80-foot radial
arch must be level and completely drivable.” Grade & Fill Permit No. 04974 does not comply
with the terms of that agreement; it calls for a “50' cul de sac” and its map shows sloped surfaces.
Furthermore, given the elevations indicated on the Anderson Land Surveying Drawing No. 5488,
and the location of the 80' completely level and drivable radial arc, the civil engineering firm of
Anderson, Johnson Associates of Plymouth, Minnesota calculated the amount of dirt that would
need to be cut (513.1 cubic yards) and filled (854.6 cubic yards) with 341.5 yards of the fill
having to be hauled in from a different site. Attached is a copy of that firm’s drawing and
computations.

Randy & Brenda Lindemann, Walker Lake (56-310), adjacent property owners to
fi the ‘Viking Resort” - Otter Tail Lake (56-242) / Walker Lake (56-310). They
discussed the requirements for building a road / cul-de-sac. This would possibly
be constructed (on the Viking Resort property) if a portion of the existing
_ easement on the Viking Resort property is vacated.
I explained that topographical alterations may be done under two different
Permits, (either a Grade & Fill Permit or a Conditional Use Permit), along with the
“ process for filing these Permits.
They had questions regarding there being a bluff onsite. Our file indicates that
Interstate Engineering has determined that there is a bluff, I showed them in the
SMO where it defines bluff, and discussed it’s meaning. Also, I also indicated
that in order to do earthmoving in a bluff, a variance would be required. They

Dear Mr. Kalar, please see attached reference documents. On April 12, 2004 you wrote a letter to the
Schickers ordering an immediate cease to any activities authorized by CUP #6092 (attached for
reference), specifically due to the fact that Condition #4 which requires the recorded road easement to
match the traveled road surface. Also attached you will find for reference the law suit filed by the
Schickers in the 7th District Court which alleges the Lindemann's & Bommersbach's are: "without any right
whatsoever, and that they, and each and all of them, have no right, title, estate, interest in, or lien upon the
premises or any part thereof (attached for your reference).
As you can see. Condition #4 is not settled, quite contrary, the Schickers and their attorney now assert
that we "have no right whatsoever".
Given this context, the fact that the old store, part of the Viking Resort Conversion is currently undergoing
major structural renovation, including the removal of exterior stairs, concrete porch(s), relocating windows
and openings in the structural envelope.
Please let me know the reason the Schickers are allowed to operate in contempt of the Planning
Commission's order.

Dear Mr. Kalar
This is a follow up to my March 15, 2006 letter concerning the concepts which Mr. and Mrs.
Lindemann developed for possible settlement of the above case. Have you had the opportunity to
review them? Please inform me which of these concepts are your preference, and which of these
concepts can be approved by your office, or which have to be approved by the Planning
Commission. A pretrial conference in this matter has been set for April 10, 2006 and we would
like to be able to present a proposal for settlement to Mr. Karkela and his clients before the April
10, 2006 pretrial conference. If you have any questions, please feel free to call. Thank you.

Re: Schickers et al. vs. Lindemann et al
Dear Mr. Kalar
I have been in contact with Mr. Karkela, the attorney for the Schickers, regarding proposals to
resolve the closure of the through road, the driveway easements and tumarounds/cul-de-sacs.
Mr. Karkela requested my clients to develop schematics. Enclosed are four concept drawings
that Mr. and Mrs. Lindemann have developed. The bold lines are their proposals. The purpose
of the cul-de-sac/tum around is to replace the looped roadway that the Schickers and other
owners of Swans Point/Viking Resort want to close/vacate. All of the concepts include the
vacation of the roadway that lies west of Mr. and Mrs. Lindemann’s lot and east of Mr. and Mrs.
Bommersbach’s lot.
In these concepts, Mr. and Mrs. Lindemann are using a 50 foot radius pursuant to a graphic
standard that indicates a 50 foot radius will accommodate most trucks, i.e. garbage trucks,
delivery tmcks, and pickups or SUVs towing boat trailers which errantly drive into the area, etc.
The cul-de-sac will allow most trucks to turn around and exit, without driving on anyone’s lawn.
Concept 1 places major portions of the cul-de-sac on the current easement areas and the eastern
portion of Cottage 11 area, which is possessed by Mr. Radziszewski. It places the eastern edge
of the cul-de-sac at the eastern edge of the road as currently traveled. This proposal would
probably be most acceptable to those property owners to the east, though it does not affect their
title.
Concept 2 is fairly similar, but simply moves the cul-de-sac about 20 feet further east so that it
comes close to the eastern edge of the deeded easement area. This places the cul-de-sac closer to
the neighbors to the east, but again, does not affect their title. Although the Cottage 11 area does
not have a house or garage on it, it is our understanding that Mr. Radziszewski plans to build a
house and garage on it; that the house would lie immediately south of the road area to be vacated;
that the garage would be immediately west of the cul-de-sac area, and that Mr. Radziszewski
would also use the cul-de-sac and the driveway south of the cul-de-sac. Concept 2 creates a tail to
the west of the cul-de-sac. This tail area is largely the area that Mr. and Mrs. Lindemann, as well
as their predecessors, have used as a driveway and parking area. They ask that that 80 x 33 foot
tail be deeded to them in fee simple so that they can control the area and place appropriate
signage or lawn ornaments to discourage the public from entering upon it, as the public will be
using the cul-de-sac.
Concept 3 creates a 33 x 80 foot turnaround area south of the driveway easement depicted on the
1962 map of Knud Madsen, south of the current road as driven, and south of Mr. and Mrs.
Lindemann’s lot. This is the location where Mr. and Mrs. Lindemann and their predecessors
have parked. This is probably the least practical design to accommodate people turning around.
Concept 4 creates a 50 foot cul-de-sac at the end of the road and south of Mr. and Mrs.
Lindemann’s lot (where a cul-de-sac should be located), but would place it further east onto the
Cottage 11 area.
The Lindemarm’s propose that either Concept 1 or 2 be used, as they have the most common
benefits for all parties concerned. Concepts 1 and 2 utilize the eastern portion of Cottage 11 area,
which is the less buildable area for the possessor of that area given its triangular shape and lot
line set back requirements. Concepts 1 and 2 require less dirt work than Concepts 3 or 4.
However, if certain persons want to use Concepts 3 or 4, those proposals could be made to work
as well, but may involve some adjustments.
After you have had the opportunity to review these concepts, please inform me which of these
concepts are your preference, and which of these concepts can be approved by your office, or
which have to be approved by the Plaiming Commission.
Yours truly.

RE: Schickers v. Lindemann et al, Viking Resort, Otter Tail Lake (56-242)
Dear Mr. Seeger:
As we discussed (telephone conversation on February 1, 2006), I can not provide answer
to your question fletter dated January 16, 2006) at this time. This is due to the fact that
our Office will need the following additional information prior to making a decision.
1. What is the proposed dimension of the cul-de-sac?
2. What is the proposed dimension of the parking area?
3. What is the maximum depth of excavation and/or the maximum depth of fill for the
proposed cul-de-sac and the proposed parking area?
4. What is the proposed total amount (cubic yards) of soil to be moved for this
project? Please note that our Office’s authority is limited to earthmoving projects
involving 300 cubic yards or less.
5. What temporary and/or permanent erosion control measures will be implemented?
While I am reluctant to delay the resolution of this matter, it may be necessary for our
Office to review your proposal onsite once the existing snow cover is gone.
It will also be helpful to receive some assurance that all affected properties will continue to
have road access and some assurance that all affected parties are in agreement with this
proposed solution.
If you have any questions or comments regarding this matter, please contact me (998-
8095).
Sincerely,

Re: Schickers vs. Lindemann et al
Dear Mr. Kallar
I am following up to our conference from last fall regarding the road easements for the properties
along Walker Lake in the area generally known as Viking Resort. I have relayed to Mr. Karkla,
the attorney for Schickers and the numerous fractional owners, the concept of creating a cul-de-
sac south of Mr. and Mrs. Lindemann’s property line, as you believe that a cul-de-sac could be
constructed in that portion.
Mr. Karkla has indicated that his client’s are willing to consider a “turnaround area large enough
to accommodate a large vehicle. Given the maximum road width of a vehicle being 8 1/2 feet,
and given that we are dealing with extended cab pickups with boat motor and trailer attached, a
vehicle can easily become 40 feet long. W'ouid Land and Resource Management and the county
approve the constmction of a 100 foot diameter cul-de-sac or some other dimension and a dirt
permit for clearing that area?
Enclosed is a diagram depicting such proposed driveway easement outlined in purple, turnaround
area in red, and parking area in yellow.

If you could respond within the next week, it would be greatly appreciated, as this case has a
court hearing on February 21, and the parties would have to work out logistics within the
confines of your parameters.
Yours truly.

Dear Ms. Schicker:

Application Fee (check #5343 in the amount of $100.00) and your site plan.

Board backs away
from easement fight
By Janet Preus

The board room filled up quickly Tuesday when a
dispute between Viking Resort on Otter Tail Lake and
the resort owners’ neighbors on Walker Lake camd
before the Otter Tail County commissioners. The pre-f
sentation and comments continued long past the allotted
10 minutes, but that didn’t sway the board’s opinion tha{
the private road dispute is outside of their authority. ;
“I think it’s a private easement. I don’t think we have
any business in it at all,” said Commissioner Malcolm
Lee.

“Why does it take a judge to
decide?” Lindeman asked. “It’s
a common sense issue.”
Land
Management Director Bill Kalar
said his office granted a condi-,
tional use permit to the
Schickers, but it was later with
drawn because certain condi- .
tions had not yet been met:
■ The traveled surface of the
road and the recorded easement
must be the same.
■ Trash on the resort property
has to be cleaned up, including
broken up concrete, old tires and
metal debris.
■ The Otter Tail Lake shore
line has to be rip-rapped andc
seeded. .j
“The permit has been"
rescinded, but that has not
rescinded the issues,” said Kalar. i
Hauser called the proposed
project “homemade condomini
ums” and “an odd way of doing
business.” He cautioned the
owners to “take a good, hard •
look at it.”
The Schickers need to con- :
form to the conditions of the |
permit, said Hauser, but that is 1
the extent of the board’s author- <
ity. They also have the option of '
applying again, he said.

Lindeman expressed the
landowners’ frustrations with a
“paper” easement correction.
“It doesn’t solve the issue as
long as there’s this adversarial
issue with the fence posts,” said
Lindeman.
