Per letter received, the Planning Commission considers the
conditional use application of Dennis Frahm, Swan Lake, 56-781,
RD, Swan Lake Resort, Section 29 of Dane Prairie Township as
withdrawn (see attached).
Withdrawn:
A motion by Petterson, second by Femling to approve the
conditional use application of Kathleen McNabb, Lake Lida, 56-
747, GD, Lot 3, Block 7, Crystal Lida Beaches (6.4 Acres),
Section 11, Lida Township allowing a total of 9 units; allowing
numbers 1 through 6, 12, 13 & 14 these sites are to be located as
indicated on Exhibit A (signed by Kathleen McNabb, dated December
7, 1988). This tract (E 6.4 Ac of Lot 3, Block 7) is being
considered as a separate project and is not being considered as
part of the existing Resort. Charles Krekelberg, Attorney,
accompanied the applicant; Rod Ebersviller, Carla Perkins and
Scott Johnson expressed concerns and objections to this
application.
Approved;
Voting: All members in favor, except Stringer abstained.
A motion by Lachowitzer, second by Lee to approve the conditional
use application of Andrew A. Klinnert, Rush Lake, 56-141, GD, Pt.
of G.L. 3, Section 23, Rush Lake Township provided he stays 6"
below the ice ridge and must leave as many trees as possible, the
slope must run away from the lake.

A motion by Petterson, second by Schwartz to extend the deadline
for Charles Kochmann, et al. Otter Tail Lake, 56-242, on
Conditional Use Permit //3622 to May 15, 1989.

A motion by Stringer, second by Hatling to nominate Cecil Femling
as Chairman, motion by Lachowitzer to cease nominations passed.

Dear Mr. & Mrs. Frahm:
In response to your letter dated November 28, 1988, I personally became
involved with your proposed resort expansion on August 23, 1988.

As you may recall, I mentioned that I would review your proposal in order to
determine whether or not a variance from the provisions of the Shoreland
Management Ordinance of Otter Tail County would also be required in order
for your expansion to occur.
The Ordinance (copy enclosed), as you will see, requires 26,666 square feet
of land area and 50 feet of water frontage per dwelling unit.
It is my understanding that your property consists of 19.56 acres of land
and 790 feet of lake frontage, therefore the following calculations were
made.
1. Land Area
19.56 acres X 43,560 sq ft = 852,034 sq ft
acre
852,034 sq ft X dwellinR unit = 32 dwelling units (total)
26,666 sq ft
2. Lake Frontage
790 ft X dwelling unit = 16 dwelling units (total)
50 ft

From these calculations, it becomes apparent that your property would be
allowed 16 dwelling units (total) without a variance based on the most
limiting factor, water frontage. In practice, however the Planning
Commission has often averaged these numbers which if done in this case would
result in 24 dwelling units (total) being recommended for approval on this
property.
Your Conditional Use Permit application indicated that currently onsite were
35 dwelling units (1 residence, 30 campsites and 4 rental cabins). This
means that the number of dwelling units currently on your property without
your proposed 10 dwelling unit expansion exceeds the maximum allowable
dwelling unit density as per the provisions of the Ordinance
Since this was the case, on August 24, 1988, I informed you (telephone
conversation) of my calculations as well as the need for a variance from the
Otter Tail County Board of Adjustment. This was done so that you would not
be surprised at the Planning Commission Meeting and so you would have
sufficient time to apply for a variance during the same time your
Conditional Use Permit Application was being considered.
Your letter also indicates that I informed you that 45 dwelling units could
be placed on your property. At this time, I have no recollection of
indicating to you that 45 dwelling units could be on your property. As
previously indicated I became involved in this matter upon receipt of your
Conditional Use Application in which you requested 45 dwelling units.
Pr ease note, I make it a point not to comment on what the Planning
Commission or Board of Adjustment may or may not approve.

Dear Mr. Kalar:
As you.can see by the enclosed copy of the letter to the Planning
Commission we will not be applying for a variance from the Board
of Adjustments at this time. Many things contributed to this
decision including the high cost of the additions. One thing
we would like to clarify though is the number of dwelling sites
we can have on'our property. When we initially talked to you
before the October 5th Planning Commission Meeting you indicated
we could have 45 dwelling sites but at the meeting you indicated
we were entitled to only about 30. That was a surprise to us.
Would you please verify which is to correct total and perhaps
indicate to us why the big discrepancy? We would appreciate it
for any further plans we may have to improve our resort.
We thank you for all of the other information we received from
you too.
