Larson abstaining, to deny the variance as requested as it is an after the fact request and noting that the sewage
treatment system application contained incorrect information regarding the location of the wetland.

Dear Mr. Stein:
It was certainly a pleasure talking with you last week about our variance application for a
lift station. As I mentioned to you, we weren’t quite sure what the procedures were once
the variance was denied. I understand from that conversation, as was also described to
me by Wayne Enquist who represented us at the hearing, that the primary problem was
the fact that the lift station was too close - 19 feet - to the wetland and that the permit
application filed by our installer noted the “setback to wetland” as 50 feet.
You suggested that I might talk to the installer and have him look, once again, at the
property and see if there isn’t a possible location for the lift station outside of 50 feet from
the wetland. If he found such a location I should have him move the lift station. I
understand that this one possible solution that would be acceptable and legal. You also
suggested that if he, for whatever reason, determined that the location where the lift
station was installed is the only possible or best possible location for it, he could meet
with the board and explain why. The board would then rule on whether if could remain
or should indeed be moved.
I have asked the installer to inspect the property. He said that he would ask someone
from Land and Resource Management to accompany him.
Thank you, again, for your help. We had thought that the only recourse we had was to
either move the lift station at our own expense with some sort of official concurrence on
the new location from Land and Resource Management or to file a civil action in the
county court as a form of appeal.

Leland J. and Carol M. Larson, part of Lot 18 and all of Lot 19, Birchwood Shores, Pickeral Lake in Maine
Township, requested a variance of 10’ from the required ordinary high water level setback of 100’ for a 20’ ^
by 28’ addition to an existing dwelling 90’ from the ordinary high water level. The audience was polled with
Jim LaFond speaking to the variance as requested. Letters from Arnold and Margie Mickelson and from
Gary and Janet Kaeding in support of the applicants’ request were read for the record. After consideration,
motion was made by Randall Mann, second by Steve Schierer and carried with Paul Larson voting no, to
approve a variance of 10’ from the required ordinary high water level setback of 100’ for a 20’ by 28’
addition to an existing dwelling 90’from the ordinary high water level. Hardship is a substandard lot of
record. It as also noted that the proposed addition would be no closer to the ordinary high water level than
the existing structure. :
Tony and Elaine Carroll - Denied. (6:50 p.m.)
Tony and Elaine Carroll, Lot 4, Block 1, Linda’s Beach, Tamarac Lake in Scambler Township, requested a
variance of 53’ from the required side lot line setback of 65’ for the placement of a 12’ by 16’ gazebo 50’
from the ordinary high water level and 12’ from the side lot line. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, motion was made
by Mark Steuart, second by Steve Schierer and unanimously carried, to deny the variance as requested as
no adequate hardship unique to the property had been shown that would allow for the granting of the
variance as requested and it should be noted that the applicants must either remove or relocate this
structure to comply with the setback requirements of the Shoreland Management Ordinance on or before
June 1,2004. It was noted that there is adequate room on the applicants’ property to legally locate the
proposed gazebo. It was also noted that had this variance request been made before the construction of
the structure the variance would not have been approved since there is no adequate hardship that can be
used to justify the granting of the variance as requested.
Mark S. Williams - Approved as requested. (7:00 p.m.)
Mark S. Williams, part of Government Lot 8, Section 1 of Sverdrup Township by East Lost Lake, requested
a variance of 24’ from the required ordinary high water level setback of 100’ for the construction of a 26’ by
3T 2” addition 76’ from the ordinary high water level. The audience was polled with no one speaking for or
against the variance as requested. After consideration and discussion, motion was made by Richard Sha,
second by Steve Schierer and unanimously carried, to approve a variance of 24’ from the required ordinary
high water level setback of 100’ for the construction of a 26’ by 3T 2" addition 76’ from the ordinary high
water level. Hardship is a substandard lot of record. It was noted that the proposed addition is not within
the shore impact zone and will be no closer to the ordinary high water level than the existing structure.

audience was polled with no one speaking for or against the variance as requested. After consideration
and discussion, motion was made by Mark Steuart, second by Richard Sha and carried, with Steve
Schierer voting no and with Paul Larson abstaining, to deny the variance as requested as it is an after the
fact request and noting that the sewage treatment system application contained incorrect information
regarding the location of the wetland.
