It was noted that the applicant’s existing dwelling is very close to ordinary high water level, but that the proposed addition is on the backside of the existing structure away from the lake and the proposed addition would square off the rear of the applicant’s dwelling. Approximately 46’ 6” back from the lake (waters edge). The required ordinary high water level setback is 75’. The property is described as Lot 59, Provan Beach, Pelican Lake in Dunn Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Randall Mann and carried with Cecil Femling and George Walter \ voting no, to approve a variance to construct a 10’ by 17’ addition no closer than the existing structure to the. ordinary high water level with the condition that before a site permit can be issued for the proposed development the existing boathouse must be removed. It was noted that if the applicant’s proposed addition is placed behind the existing string line the boathouse would be allow to remain in its present location. It was noted that the granting of the variance as requested would make a substandard situation more substandard. The variance as granted will eliminate the existing boathouse thereby making an improvement over the existing situation. 1Teresa A. Olivieri - Approved Teresa A. Olivieri, Fargo, ND, requested a variance of 60’ from the required ordinary high water level setback of 100’ and a variance of 6’ 6” from the required road right-of-way setback of 20’ for the construction of a garage 40’ from the ordinary high water level and 13’ 6” from the road right-of-way. Also, requesting a variance of 34’ from the required ordinary high water level setback of 100’ for the construction of a 6’ by 24’ porch, which will be connected to the house and garage, 66’ from the ordinary high water level. The property is described as Lots 18 and 19, Pikes Beach, Tamarack Lake in Scambler Township. Curtis Gullickson represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Bert Olson and unanimously carried to approve the following: 1.) a 6’ 6” variance from the required road right-of-way setback of 20’ and a variance of 60’ from the required ordinary high water level setback of 100’ for the placement of a garage 13’ 6” from the road right-of-way and 40’ from the ordinary high water level with .the condition that the ingress and egress to the proposed garage must be from the east (approximately at a right angle to the existing road), and 2.) a variance of 34’ from the required ordinary high water level setback of 100’ for the construction of a 6’ by 24’ porch, which will be connected to the house and garage, 66’ from the ordinary high water level noting that before a site permit can be issued for any of the proposecf development the existing garage must be removed.
