County Wide Zoning Discussion Land & Resource Director, Bill Kalar, opened discussion regarding County Wide Zoning. Eagle Lake Township Officer, David Broud, discussed the challenges of Eagle Lake’s enactment of an Interim Ordinance. Mr. Kalar talked about the wide variety of regulatory agencies relative to water quality and the variety of land uses. Mr. Kalar stated that the first thing the County needs to do is to map out the current land uses in the County. The GIS Department could assist in the mapping. Commissioners requested that Mr. Kalar proceed with mapping the current uses in Eagle Lake Township and around Dead Lake to use them as samples of what can be done throughout the County. Mr. Broud will ask townships, over the winter, to document what they want relative to zoning. Mr. Kalar provided a document from the Minnesota DNR entitled “Shoreland Rules Update Project”. Otter Tail County, Planning Commission October 8, 2008, Page 2 Victoria & James Trites and John Christensen represented the Application. Terry Eikren reiterated that this is precedent setting and their request was denied several years ago. Ken Kappes expressed concerns regarding drainage and the Township Road. Motion: A motion by Schwartz, second by Gill, to approve as presented, provided; 1. The maximum depth of cut be 2.5’ at the easterly end. 2. Land & Resource Management approves the stabilization plan prior to starting the project. 3. The project must not be started until spring 2009. Reason being the drainage should go towards the road. Voting Yes: Erickson, Gill, Olson, Schwartz, & Wilson. Voting No: Boyer, Maske, & Zimmerman. Sunset Beach Resort / Scott & Cathy Olson - Approved As Presented: A Conditional Use Permit Application (as stated by the Applicant): Convert existing owners home to a rental unit. Currently 59 rental units & 1 residence, propose 60 rental units total. The property is described as Sunset Heights Lots 1 - 6 & Lot 8 and pt SL A of GL 1, (13.14 AC), Section 28 of Girard Township; West Battle Lake (56-239), GD. Rodney & Linda Schmidt-Approved With Conditions: A Conditional Use Permit Application (as stated by the Applicant): To change the access for an easement for ingress and egress purposes that is shared by the Schmidts and Elaine Solee so that it comes off of County Hwy 22 instead of County Hwy 43. By doing so the prospective buyers of the Schmidt property (Robert & Julie Budke) can eliminate the existing portion of the easement that crosses the parcel in a north/south direction. Otter Tail Co. Up to 2,000 cy of excavation will take place within 1,000 feet of Tamarack Lake. Unit has three bedrooms and is proposed for a maximum occupancy of 8 persons. Every building, structure or enclosure shall be kept in good repair and maintained to promote health, comfort, safety and well-being of persons accommodated, shall be kept clean and free of litter or rubbish (Minnesota Rule, part 4625.0400). 1. 2. Floors shall be smooth, easily cleaned, shall be kept clean and in good repair. Abrasive strips for safety purposes may be used to prevent accidents (Minnesota Rule, part 4625.0500). 3. Walls and ceilings shall be kept clean and in good repair. Studs, joists, or rafters shall not be left exposed unless suitably finished and kept clean (Minnesota Rule, part 4625.0600). Every room occupied for sleeping purposes by one person shall contain at least 70 square feet of usable floor space, and every room occupied for sleeping purposes for more than one person shall contain not less than 60 square feet of sable floor space for each occupant thereof Under no circumstances shall there be less than 400 cubic feet of air space per occupant. Usable floor space excludes closets and bathroom areas. Beds placed side by side must be separated by a minimum of three feet (Minnesota Rule, part 4625.0900, section A) Main floor sfeeping room indicated as 11 feet by 12 feet for occupancy of 2, second floor sleeping rooms, one at 8 feet by 25 feet and one at 10 feet by 25 feet proposed for 2 persons per room for a total of 8. 4. No sleeping quarters shall be provided in any basement having more than half its clear floors to ceiling height below the average grade of the adjoining ground (Minnesota Rule, part 4625.0900. section B) 6. When flies, mosquitoes, and other insects are prevalent all outside doors, windows and other openings shall be screened (Minnesota Rule, part 4625.0700). 7. All equipment, fixtures, furniture and furnishings, including windows, draperies, curtains, carpets, electrical appurtenances, decorative or utility items shall be kept clean and maintained in good order and repair (Minnesota Rule, part 4625.1100). 8. Toilet facilities shall be available on each floor when not provided in each individual room/unit. Toilet, lavatory, and bath facilities shall be provided in the ratio of one lavatory and toilet for every ten occupants, or fraction thereof, and one bathtub or shower for every 20 occupants or fraction thereof (Minnesota Rule, part 4625.1200). 9. Toilets and bathrooms shall be kept clean and in good repair and shall be well lighted and ventilated (Minnesota Rule, part 4625.4625.1200). 10. All lavatories for public use or furnished in guest rooms shall be supplied with hot and cold running water and soap. Approved sanitary towels or warm air devices shall be provided for hand drying (Minnesota Rule, part 4625.1400). A safe adequate supply of water shall be provided and shall be located, constructed, and operated in accordance with rules governing water supplies (Minnesota Rule, part 4625.1300). Provide a certificate of compliance for all septic systems or sewage treatment facilities operated in conjunction with the licensed facility (Mirmesota Rule, Chapter 7080). No information received regarding the septic system serving the owner’s residence. Maximum occupancy should be determined by septic system compliance. Contact Otter Tail County for occupancy estimation for septic system. The temperature of hot water which is provided in any public area or guest room, including but not limited to lavatories, bathtubs or showers, shall not exceed 130° F (approximately 55° C) (Minnesota Rule, part 4625.1300). 13. 14. Comply with the Minnesota Clean Indoor Air Act (MCIAA) (Minnesota Rule, part 4626.1820). Obtain an electrical inspection from the Minnesota Electrical Licensing and Inspections. All electrical systems must comply with the currently adopted edition of the National Electrical Code (Minnesota Statute, part 326.244).
