Launching ramp facilities, including a small dock for loading and unloading equipment, may be provided for use by occupants of dwelling units or sites located in other tiers. At the resort, we have 8 cabins in tier 1 plus 4 RV sites for a total of 12 dwelling units. We currently have 6 docks, which I believe if I interpret correctly would be one slip per dwelling unit in tier 1 which meets the ordinance. However, we have a home on a parcel adjacent to the resort (parcel #14000160135000) which would give us 13 total dwellings. I have attached the drawing from Anderson Land Survey which depicts the resort and home on it. You can see the 6 current docks depicting 12 boat slips. Can I add another dock to account for the house? For placement, the dock would be located to the left of the gravel launch drive when looking out to the water. (FYI, because the docks are moveable. 1 and we own both parcels we never concerned ourselves with where the docks lie in conjunction with property lines since we own both parcels.) I did not want to interpret the Shoreland Management Ordinance on my own, so I am seeking approval to add one dock. The length of a new dock would essentially match the length of the one on the right side of the gravel launch drive. A variance is a property right that is afforded for the life of the property. The variance granted on April 4,1991 states: "Approved as long as none of the screened patio/deck will be larger than 10' x 24' in size". As long as the project adheres to the approved variance granted in 1991, this project may be completed with a permit from the office, and there is no need for any further variance(s). Sorry I missed your call. I am attaching a scan of the paperwork I have from our abstract showing the submittal from Paul and Virgina Grabarkewitz stamped as received by Land and Resource on December 13,1990. The first page is the written submittal, page 2 is a drawing of how the cabins sit upon the shoreline, and how the decks would be built in the front facing the water/beach. Page 3 is part of the paperwork submittal to the county showing a date of hearing initially of March 7, 1991. The topic was tabled at that meeting and subsequently approved at a meeting on April 4, 1991 as long as none of the screened patio/deck will be larger than 10' by 24' in size. It is then signed by the Chairman of the Otter Tail Board of Adjustment at that time (last name Walter?). I know these scans are not ideal as the paperwork in the abstract covers a bunch of years and is bound together and we scanned it without detaching this document. We are actually in Fergus tomorrow, but I believe the attached provides what you need. I did look online at historical BOA meeting minutes, but online it looks like they only go back to 2014. This was from April 4,1991. Let us know if you need anything else from our end. Also, we are just looking for Land and Resource to confirm that this approved variance is still in force and essentially traveled with the land and is grandfathered to be effective for our ownership, and enables us to do the work as approved. Our intention is to not build screened patios, but rather just (uncovered) decks off the front of the cabins not to exceed 10 by 24 in size as was approved. We would be hiring a contractor to do this work and will require them to pull any necessary permits for this work as required by the county. My review showed that on April 4,1991, the Board of Adjustment granted a Variance to Paul and Virginia Grabarkewitz which would allow the construction of 6 (one on each cabin), 10 ft. X 24 ft. screened patio/deck approximately 125 ft. from the waters edge. Assuming no change to the property (i.e. the 6 cabins) other than ownership or the size of the project (i.e. 10 ft. X 24 ft.) has occurred, this Variance would still be valid. Should you decide to proceed with this project (and assuming no changes have occurred onsite), you would need a Site (Building) Permit from this Office prior to construction. Over the years we have done minor improvements to the property to include staining, replacing roofs, etc. In searching our title documents we came across a previously approved application for variance to construct 6 decks or screened patio/decks on the west (lake) side of the cabins here at Sunset Bay Resort. We see this variance was approved April 4,1991 with the notation that it was approved as long as none of the patio/decks will be larger than 10 footX24 foot in size. Previous owners never acted on this approved variance. My question is, since this is an attractive amenity, does this approved variance grandfather in with the land and now is ours as owners to either implement or not? So if we desired could we build these patio/decks without further approval or variance request from the county? Thank you for your time. I would like to outline in this letter the changes, alterations and improvements that my wife and I would like to make to Gov’t Lot 4, Section 16, T.135, R.40, to be referred to from this point forward as Sunset Bay Resort. The changes and additions have also been outlined on the plat of survey accompanying this letter. The changes outlined below are contingencies to the purchase of Sunset Bay Resort. The following changes, additions, alterations, etc. will be outlined according to tier. The changes, alterations, etc. for tier 1 are outlined as follows: Expansion of the current owners home, which is a one bedroom 20 foot by 40 foot structure, to a 40 foot by 40 foot 3 or 4 bedroom structure to accommodate new owners family of 4. This increase does not include the already existing garage, which will continue to be used in its current configuration. If the structure of the garage is to be changed or enlarged, it will be done at a later date and will be addressed with the planning commission at that time. 1. 2.Transformation of the current 20 foot by 40 foot garage into a 2/3 bedroom rental cabin, to be called cabin #8. This building is already in existence and would not alter the lakeshore setting as regards to the number of structures on tier one and it therefore would not alter the view from the lake itself. Minimal alterations would be made to the exterior of the building, i.e. windows, doors and possibly a screen porch or deck. The alterations will be in compliance with Ottertail County restrictions in regards to septic requirements and will have either it’s own septic tank or tie into the septic tank for cabins 1 and 2, whichever is appropriate for proper waste management of potential cabin 8. The septic system for cabin 8 would tie into current septic mound located directly behind cabins 4 and 5 about 260 feet from the lakeshore. It is also our desire to winterize cabin 8 for potential winter use although winter business is not a part of our short range business plan. Erect a 30 foot by 40 foot storage building / work shop on the north side of entrance road approximately 300 feet from the shoreline. The changes, alterations, etc. for tier 2 are outlined as follows: The installation of 15 RV sites to be located on tier 2 along entrance road as outlined on plat of survey. These sites will be fully conforming sites with water, metered electric, sewer and potentially cable TV. 1. The changes, alterations, etc. for non-conforming lot to the north of resort lot are outlined as follows: Please note that one of the purchase contingencies is the sale of the non- conforming lot owned by current owners of Sunset Bay resort directly to the north of the resort property as part of the resort purchase. According to the county recorder this lot is a deeded lot recorded before 1971 which allows for construction of a structure by the current or potential owner of this property. It is our desire to build a private residence on this property with the maximum size of 60 feet by 28 feet excluding the garage area which would be a maximum of 21 feet by 23 feet as outline on plat of survey. We would like to erect this structure as near to, but not over, the string test building line marked on the plat of survey, or a location further away from the lakeshore that affords the best building location for this structure. This structure would have it’s own well and septic system in compliance with Otter Tail County. 1. Note: If any of these changes, additions and/or alterations do not meet with the committees approval, my wife and I would greatly appreciate it if the committee would provide for us what it would consider to be acceptable variations of the proposed changes. In conclusion, my wife and I are excited about the possibility of becoming a member of the Otter Tail business community and the owners of Sunset Bay Resort. I feet very strongly that my wife and I, as owners, would be an asset to Otter Tail County. We are very aware that your role in the commission is to protect the existing cleanliness, beauty and integrity of the lakeshore, now, and for years to come.
