Mr. Gedde stated that Mr. Clouse could subdivide this property by way of metes and bounds description without County approval and; therefore, requested an unconditional approval by the Board today. The County Attorney advised that the County can put conditions on plats, such as this type of condition that relates to the project. Motion by Lee, second by Mosher, and unanimously carried to approve the Preliminary Plat known as “Sportsman Landing” and a Conditional Use Permit to construct a road to service the plat, with conditions as recommended by the Planning Commission. Sewage System Abatement Program Mr. Kalar presented statistical information regarding the 2003 Sewage System Abatement Program. He reported that he has received a letter from 18 concerned citizens on Round Lake (across from Rush Lake). They had a fairly large fish kill recently on this lake. These concerned citizens are requesting that the County look into this from the standpoint of non- conforming sewage systems. This issue will be further discussed with the Budget Committee. Final Plats Motion by Nelson, second by Froemming and unanimously carried to approve the Final Plat of Ricky C. Heinie and Laura L. Heinie and Donald B. and Donna J. Meyer known as “Big Pine Haven". The property is described as GL 4 of Section 22, Township 136N, Range 38W on Big Pine Lake (56-130). Motion by Lee, second by Block, and unanimously carried to approve the Final Plat of George and Dorothy Ford known as “Ford’s Loon Lake Heights”. Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1:10 p.m. Sale of Furnishings at the 121 Washington Avenue Building Motion by Block, second by Nelson, and unanimously carried to sell most of the furniture (including workstations) located at the 121 Washington Avenue building to the new tenant. Allen Haugrud (Jewett Lake Association) expressed concerns regarding the lots that are not purchased by the DNR & asked what assurance is there that the DNR will purchase Lots, Block 1? Sunset Bay Resort / Jocelyn Kerr - Extension of Conditional Use Permit #5867: " Bill Kalar discussed with the Commission a letter (dated July 17, 2003) from Jocelyn Kerr, Sunset Bay Resort, Dead Lake (56-383), indicating that due to medical reasons they are requesting an extension (to December 31,2004) of their Conditional Use Permit. Motion: A motion by Lachowitzer, second by Schwartz to approve an extension to December 31, 2004 as requested. Voting: All Members in favor. Shoreland Management Ordinance Revision Effective January 1, 2004: Bill Kalar informed the Commission that the Shoreland Management Ordinance Revisions were approved by the County Board on August 12, 2003. The revisions would be effective January 1, 2004. He indicated that copies of the revised Ordinance will be provided at an upcoming meeting. Junius Fergus Falls, MN 56537 RE; Request for Extension, CUP No. 5867 Bill, Our letter requesting another extension on CUP 5867 is enclosed. We know we’re cutting it close, but hope it still can be considered. We are kind of in limbo right now. Mom (Virginia Grabarkewitz, former owner of the resort) had a stroke in early April and has been recuperating since then. She was able to return home just 1 week ago (with assistance from another family member). Over the next 2-3 months, she will be evaluating her situation to determine if she can live independently or if other arrangements need to be made. One of the possibilities is that we would use the residence authorized by the CUP as Mom’s residence, so she could live in her own house, but with our on-hand supervision. The residence would require accessibility features we hadn’t planned on in our original design. On a temporary basis, if necessary. Mom would be able to use the old residence (the 8* rental cabin) until the new residence can be completed. We did not want to go into detail in our formal request to the Planning Commission, but hope that you can use this additional information to better inform the members of our situation. Conditional Use Permit (CUP) No. 5867, was issued July 30,2001, for Sunset Bay Resort. The original expiration date of the CUP was July 30, 2002. The work authorized by the CUP is, “1 residence (2”“ tier, 8 rental cabins, and 4 camping units (located S & E of driveway).” By letter of June 18,2002, we requested an extension of time to November 30, 2004; an extension to July 30, 2003, was granted. B. By letter to the Planning Commission dated July 9, 2001 (paragraph D), we requested that a timetable be approved which exceeded the one (1) year authorized by the CUP. The timetable was not addressed at the time our original application was heard, and the extension granted did not take into consideration the mitigating factors we submitted in our request, i.e., seasonal business that severely restricts the time available to work on the building projects approved in the CUP, so we are submitting this second request for an extension of time. C. We request the expiration date be extended from July 30, 2003, to December 31, 2004. We have been unable to accomplish the work on the residence in the 2“‘* tier due to maintenance required by other buildings as well as unexpected changes in family member medical conditions. Since our business is seasonal, running from mid-May to late September, and is extremely demanding (nearly 24/7 from April- October), we must accomplish the CUP work either before or after the prime season, so progress is slower than one would expect if we had all 12 months available or if we hired most of the work out. We believe that if this extension is granted, we will be able to complete the work by the end of the time we’ve requested. D. Board of Commissioners’ Minutes June 25, 2002 Page 4 Conditional Use Permit - Matt & Brenda Hobbs: Mr. Kalar stated that this CUP request was recommended for denial because of lack of representation at the Planning Commission meeting. Shoreland Solutions Consultant, Rob Goral, spoke on behalf of the applicants and explained that he thought the Planning Commission meeting was Thursday, not Wednesday and that error was the reason for lack of representation. He requested that the County Board consider and approve the proposal on the merits of the application. Discussion followed. Motion by Froemming, second by Nelson, and unanimously carried to refer this Conditional Use Permit request back to the Planning Commission to review the request at their July 10, 2002, meeting. This motion is conditioned upon the applicant’s written agreement to waive the 60-day rule. Conditional Use Permit- Glenn K. & Kathleen A. Carlson: Motion by Froemming, second by Block, and unanimously carried to approve a Conditional Use Permit to construct a driveway as presented. Conditional Use Permit Extension Request Motion by Nelson, second by Lee, and unanimously carried to extend the deadline for the Conditional Use Permit of Mark & Jocelyn Kerr on Sunset Bay Resort on Dead Lake from July 30, 2002, until July 30, 2003. Final Plat - “Adair Acres” Attorney, Kris Svingen, addressed the Board regarding the proposed final plat of Adair Acres on West Battle Lake. Mr. Svingen addressed two concerns involving the mapped location of the Indian Mound and the amount of space shown on the Preliminary Plat between the drainage easement and the Indian Mound buffer zone. Land & Resource Director, Bill Kalar, will further research these issues with surveyor David Anderson, and return to the Board this afternoon for consideration of this final plat. Culvert Replacements Motion by Lee, second by Froemming, and carried with Nelson opposed, to authorize a cost share agreement (based on County resolution/policy dated 09/06/77) with Elizabeth Township and Eastern Township to replace a 48 “ or larger culvert in each township. Otter Tail County will pay one-half of the cost of the culvert replacements including permit costs at an estimate of $10,000 for each project. Rail Safety Project - Pine Lake Township MN/DOT Agreement No. 80364 Otter Tail County Resolution No. 2002 • 44 Commissioner Nelson offered the following and moved its adoption: BE IT RESOLVED, that the Otter Tail County Board of Commissioners enter into an agreement with The Township of Pine Lake, The Burlington Northern and Santa Fe Railway Company, and the Commissioner of Transportation for the closure of railroad crossings and the construction of roadway improvements in Pine Lake Township, Minnesota, and appointing the Commissioner of Transportation agent for the Township to supervise the project and administer available Federal Funds in accordance with Minnesota Statutes, Section 161.36.
