Motion
Motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve the placement
of an outhouse either at a location further up the hill that will provide for the proper ground water separation or at an
ordinary high water level setback of 94’ with the condition that the outhouse has an approved sealed chamber.

Gary Stengel - Approved
Gary Stengel, Crystal, MN, requested a variance of 25’ from the required ordinary high water
level setback of 100’ for the addition of a 12’ by 12’ porch 75’ from the ordinary high water level.
It should be noted that the porch will be added to the side of the dwelling and that it would be no
closer to the ordinary high water level than the existing structure. It should also be noted that
the original structure was placed at the 75’ setback due to an error in the classification of the
lake at the time the original site permit was issued. The property is described as Lot 31,
Timberlane Beach Rearrangement, Round Lake in Everts Township. The audience was polled
with no one speaking for or against the request. After discussion and consideration, motion was
made by John Everts, seconded by Randall Mann and unanimously carried, to approve a
variance of 25’ from the required ordinary high water leveljetback of 100’ for the addition of a
12’ by 12’ porch 75’ from the ordinary high water level noting that the addition will be no closer
to the ordinary high water level than the existing dwelling and the addition does not obstruct the
view of the adjacent property owner.
Hilary and Marilyn Barry - Approved
Hilary and Marilyn Barry, Richville, MN, requested a variance of 106’ from the required ordinary
high water level setback of 200’, a variance of 6’ from the required shore impact zone setback of
100’ and a variance of T from the required 3’ minimum ground water separation for the location
of an outhouse 94’ from the ordinary high water level and 2’ above the ground water. It should
be noted that the outhouse is only used as an emergency backup to the applicant’s septic
system. The property is described as part of Government Lots 7 and 8, Section 25 of Dead
Lake Township by Dead Lake. The audience was polled with Duane Donley speaking in favor
of the variance request. After discussion and consideration, motion was made by Cecil
Femling, seconded by Craig Anderson and unanimously carried, to approve the placement of an
outhouse either at a location further up the hill that will provide for the proper ground water
separation or at an ordinary high water level setback of 94’ with the condition that the outhouse
has an approved sealed chamber.
Gerard William Kranz and Al David Johnson - Approved
Gerard William Kranz and Al David Johnson, Richfield, MN, requested a variance of 130’ from
the required ordinary high water level setback of 200’ and a variance of 30’ from the required
shore impact zone setback of 100’ for the construction of a dwelling 70’ from the ordinary high
water level. The new dwelling will be located behind the string line, but within the shore impact
zone. The property is described as Lots 12,13 and 14, Clear Beach Resort, Fish Lake in Aurdal
Township. The audience was polled with no one speaking for or against the request. After
discussion and consideration, motion was made by Randall Mann, seconded by Craig Anderson
and unanimously carried, to approve a variance of 130’ from the required ordinary high water
level setback of 200’ and a variance of 30’ from the required shore impact zone setback of 100’
for the construction of a dwelling 70’ from the ordinary high water level. Hardship is a
substandard lot of record. The proposed dwelling is within the string line and the applicant has
checked the location of the wells on the adjacent property and has no problems meeting the
setback requirements from those wells.
