It was noted that the proposed parcel “B” meets the minimum size required for platted lots on a general development lake. It was also noted that this is a very unique situation and the exchange of the properties should result in a much improved situation. The property is described as Lot 7, Third Addition to Outlet Beach, Lake Lida in Lida Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Robert Schwartz and carried with Cecil Femling voting no, to approve a variance to move an existing cabin approximately 5’ forward towards the ordinary high water level, a variance of 4’ from the required side lot line setback of 10’ and a variance from the required road right-of-way setback of 20’ for the construction of a 24’ by 26’ garage approximately 6’ from the, side lot line, approximately 18’ from the edge of the road surface and for the construction of a second story addition above the garage approximately 14’ from the edge of the, road surface. It should be noted that the second story will be constructed above both the dwelling and the garage and that the advancement of the dwelling towards the lake by 5’ will not cause the dwelling to exceed the string line when the string line test is applied across the public access lot. Hardship being a grossly substandard lot of record. It should be noted that the granting of this variance will not set a precedence for this area, will provide the applicant with^a reasonable use of his property and will enable the applicant to enjoy the same rights and privileges as his immediate neighbors. Robert E. Doty - Approved Robert E. Doty, Sebastian, FL, requested a variance of 50’ from the required ordinary high water level setback of 100’ for the construction of a dwelling 50’ from the ordinary high water level. The property is described as Lot 13, Jaegers Silent Lakes Beach, West Silent Lake in Dora Township. Arlin Johnson represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by . Randall Mann, seconded by Cecil Femling an unanimously carried, to approve a variance of 50’ from the required , ordinary high water level setback of 100’ for the construction of a dwelling 50’ from the ordinary high water level. It . should be noted that this location meets the string line test when applied across the public access lot. Hardship being, a substandard lot of record. ' Brad Finianslund - Denied Brad Frimanslund, 164 Hampshire Dr., Cranberry Twp., PA, requested a variance of 8’ from the required ordinary high water level,setback of 100’ for the enclosure of an existing deck located approximately 92’ from the ordinary high water, level. The property is described as Lot 27, Block 1, The Peninsula, East Spirit Lake in Dora Township. Less Kellogg represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded.by Robert Schwartz and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and other reasonable alternatives exist. The Situation: Parcel A, owned by Steve Wischmann, is an existing lot, approximately 1 acre, roughly triangular in shape with lake shore on one side and a marshy bay on its second side. Its third side forms the property line with Parcel C. Parcel A was subdivided from Parcel C in the early 1950s and has remained undeveloped and largely unused except for occasional overnight tent camping since that time. Parcel A is land locked by Parcel C, is approximately three quarters of one mile from the nearest township road, has no existing passable vehicle access, is comprised very low land and is very marginal in terms of its developmental potential. Upon completion of the property exchange (Parcel A for the to- be-created Parcel B), Parcel A will be rejoined with the surrounding 175 acre Parcel C. Parcel B is to be a newly created “Metes and Bounds” lot subdivided from the northwest portion of Parcel C with much superior topography and access to the township road and utility services than the existing Parcel A, Although the proposed lot has not yet been surveyed, the property owners involved have agreed on the lot size and location. The new lot will be nearly rectangular in shape with 150 feet of lake frontage by approximately 250 feet depth (total area approximately 37,000 square feet). Parcel B is comprised of wooded high ground suitable for development within Otter Tail County standards. A 33 feet wide roadway easement from the existing township road along the west boundary line of Parcel C will provide access to the proposed new Parcel B. Existing utility lines run parallel to, and nearly the entire length of, the proposed roadway easement. {Parcel C, owned by Stuart S. and Corinne D. Peterson, is a 175 acre parcel comprising the entire eastern most portion of the Star Lake peninsula (with the exception of Parcel A) beginning at the North - South Quarter line of Section 3-135-41. It is our understanding that the Application will be considered at the Board’s November 7, 1996 meeting. As indicated in the attached materials, the purpose of the proposed variance from the Subdivision Control Ordinance is to facilitate an exchange of property that will result in a much more suitable building lot on Star Lake for our neighbor than the one he presently owns. Before we proceed with the required survey to define and describe the proposed new lot and access, we request consideration of the required variance. The respective property owners will be benefited without affecting any other neighbors. Among the advantages are the following: 1. The proposed new lot is approximately 2,000 feet closer to the existing township road than is the existing lot. Access for private use and any public services will be significantly improved at the new location. 2. The proposed new lot is comprised of high ground and is rectangular in shape, compared to the existing lot’s extremely low, triangular shape with lake on two sides. The new lot will meet and exceed all development standards of the County. The existing lot (at best) is marginal for development because of its location, topography and shape. 3. The proposed new lot lies nearly adjacent to existing Lake Region Electric power lines, as compared to the existing lot’s 1/2 mile+ distance through prime wood lot to the nearest power lines. 4. Both lots are surrounded by the same parcel so no other neighbors are affected. The next nearest neighbor to the proposed new lot is approximately 800 feet away. The “old” lot will be rejoined with the adjacent larger woodlot acreage. Peterson and I both own property on Star Lake in Otter Tail County. At present, his property virtually surrounds my property and as such I have no easy access to the nearby County Road. Furthermore, my deed provides for an easement to allow vehicle travel to my property, yet it is a fairly good distance through the woods and neither Mr. Peterson nor I wish to disturb the woods any more than we have to. He and I have entered into a property trade agreement whereby he is giving me Parcel B, as represented on the map, in exchange for my property, illustrated as Parcel A. This agreement satisfies both Mr. Peterson's interests and mine in regard to mutually cooperating as neighbors, preserving his essentially unmolested woods, affording me a comparable piece ofproperty on which to build a home, and finally, making it much easier to provide for the County's requirements and obligations. I respectfully ask that you give Mr. Peterson's Application for Variance due consideration and that you approve it in the spirit of benefiting all the parties involved, while still preserving the County's notable interests.
