ground floor, and have a basement and a loft. The total number of dwelling units on the
resort would be reduced by one, and the total number of bedrooms available for resort

Motion by Erickson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to replace a shared wood foundation retaining wall with a two tiered modular block system as

Conditional Use Permit - Amor Township:
Motion by Froemming, second by Mosher, and unanimously carried to install a 2"'’ culvert from

Recess & Reconvene
At 12:00 p.m.. Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners recessed for a joint meeting with the. City of Fergus Falls regarding the proposed
Tower Road & Bridge project. The Board of Commissioners’ meeting was reconvened at 1:06 p.m.
Market Value/Mass Apprasisal System Discussion
Assessor, Bob Moe and Local Realtor, Tom Verhelst, discussed the local appeal process and the
Board of Equalization process. Mr. Verhelst questioned the reasons for disqualified sales and
provided examples. He requested more consistency in this area based on the circumstances of the
sale rather than the sale price as compared to the assessed value. Mr. Verhelst explained that
unqualified sales are not used in the appeals process and are not included in the ratios. He stated
that if too many sales are thrown out when the sale price is below the assessed price, you will not get
real numbers for property values. Mr. Verhelst also stated that the public has a perception that there
is no use in making an appeal. Mr. Moe stated that every disqualified sale is reviewed by the
Department of Revenue. Discussion took place regarding a $30,000 site increase if the property is on
a lake and has well and septic. Mr. Verhelst suggested a substandard lot surcharge to the properties
in this category. Mr. Moe explained that the County has a mass appraisal system that needs to be 90
to 100% of assessed value every year by State law. The Department of Revenue looks at all property
types and in order to take definitive action, there must be 6 sales and there has not been State
ordered changes for Otter Tail County for several years.
Closed to the Public
At 1:55 p.m.. Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners
closed to the public for the purpose of evaluating the performance of Assessor, Robert Moe, pursuant
to M.S. Chapter 13D.05 Subd. 3. Commissioners Nelson, Erickson, Block, Froemming, and Mosher
were present for the evaluation. A summary of performance conclusions will be provided at the next
regular County Board meeting.

Planning Commission Motion to Deny - August 13, 2008: A motion by Zimmerman,
second by Erickson to deny: 1. The project is not compatible with the surrounding area,
both land and water. 2. The environmental impact is going to be extreme on soil,
vegetation, fish and wildlife. 3. Hazards may be created on both land & water because of
the bluffs and the minimum sized lots. 4. The area is extremely sensitive due to the trees,
the lake (Natural Environmental) and bluffs onsite. 5. Lack of adequate lot area and water frontage.
County Board Motion to Refer Back to Planning Commission - August 19. 2008: A motion
by Froemming, second by Block, to remand the request for approval of the Preliminary Plat
back to the Planning Commission for reconsideration/redesign.

Jeffrey & Rebecca LeDoux & Kenneth Lien - Approved As Presented:
A Conditional Use Permit Application (as staled by the Applicant): The proposed project
consists of the replacement of a shared wood foundation of a previously removed
deteriorating deck with a two tiered modular block system. The modular blocks will be
approximately 2 - 2’6” high and match the existing blocks on both sides of the project. The
proposed project will be more aesthetically attractive and consistent with the area. The
blocks (wall) will also be elevated slightly (2"*) above natural ground to reduce direct runoff
from lawns, reduce potential erosion and improve water quality. The length in
approximately 23'. Remove approx. 4 cy of dirt; bring in approx. 2 cy of sand fill behind
wall. Bring in approx. 2 cy of black dirt on upper portion, to be sodded or seeded with
grass. The property is described as Lot 7 Pelican Lake Park & Lot 8 remain one parcel
#1329-004, #785 & 68-010 not to be split. Pelican Lake Park, Section 5 of Dunn Township;
Pelican Lake (56-786), GD.
Jeff LeDoux represented the Application.
Motion: A motion by Boyer, second by Maske to approve as presented. Voting: All
members in favor.
Amor Township - Approved As Presented:A Conditional Use Permit Application (as stated by the Applicant): Add a second culvert from
Eldorado Road to Otter Tail Lake at same grade as the existing culvert to avoid folding on
adjacent property. Work also includes replacement of a centerline culvert on Eldorado
Road with a new culvert of same size and grade. Estimated earthwork would not exceed
300 cubic yards. The property is described as Pt of Eldorado Beach Rd, Lot 19 & that pt
Lot B dir N of Lot 19 Shirley Beach and SW 54’ on lake Lot 18 & that pt of S 270’ Lot B
Shirley Beach, Section 22 of Amor Township; Otter Tail Lake (56-242), GD.
Patrick Reisnour (Interstate Engineering) & Mike Holstrom (Amor Township) represented
the Application.
Motion: A motion by Estes, second by Gill to approve as presented, allowing the work to
be done this fall provided it is completed by November 1, 2008. Voting: All members in
favor, Boyer abstained.
Adjourn: At 10:25 P.M., Chairman Olson set the Meeting. The next Meeting is scheduled
for 6:30 P.M. on October 8, 2008.
John Bemis (Eagle Lake Township) addressed the Township’s adoption of the Interim
Ordinance, stating that the Township has established their own Planning Commission and
are committed to this Ordinance; he read a definition of Interim Ordinance; he requested
denial, stating this request is on an environmental lake with effects on the Pomme de Terre
watershed and the Minnesota water system. David Braud (provided a power point)
expressing concerns regarding the size of the lake, bluffs, steep slopes, aquatic
vegetation, boating, septic systems, water run-off, & spawning beds; he requested denial.
Donna Grover questioned the process for approval of a preliminary plat. Rick Chodeck
stated opposition to the revised proposal, and presented a brochure showing the area
(estimated to be from approximately 1946). Les Bensch expressed concerns regarding
water quality, turbidity, water run-off, cattle in the shore impact zone, and stated that an
EAW needs to be done and possibly an EIS to protect the watershed; he requested it be
developed without this kind of density. Milt Paulson indicated that development would
improve the area with the buffer strip and other Ordinance requirements.
Motion: A motion by Schwartz, second by Wilson to qpprove' provided 1. A 35’
vegetative buffer strip across the entire development is established. 2. The recreational
access, due to the terrain, must be reduced to 20’. 3. Areas must be sloped so the water
runs to the south. 4. The solid waste onsite must be cleaned-up and properly disposed.
5. Land & Resource must be supplied with the Storm Water Management Plan Design for
the development. It should be noted that reasons 2. The environmental impact is going to
be extreme on soil, vegetation, fish and wildlife. 3. Hazards may be created on both land
& water because of the bluffs and the minimum sized lots. 4. The area is extremely
sensitive due to the trees, the lake (Natural Environmental) and bluffs onsite. & 5. Lack of
adequate lot area and water frontage., for denial on August 13, 2008, provides support for
the conditions of this approval. Voting Yes: Gill, Schwartz, & Wilson. Voting No: Boyer,
Estes, Maske, Olson, Trites, & Zimmerman.
