An onsite investigation revealed that fill had been brought in and if the survey stakes onsite are accurate, the fill is partially on the adjacent property. It appears that a Conditional Use Permit (#5702) was issued in 1999 that allowed additions to some to the cabins at this resort, however that Permit has expired. Therefore, a new Conditional Use Permit is required. Please note that there was a Variance granted in 1999 that includes an addition to the west side of Cabin #3. I have attached that application for your use. If the property owner has a proposal for expanding cabin #3, you should schedule a meeting with Chris LeClair to discuss the Conditional Use Permit process. The prospective buyers would like to know if they could build out on either side or back away from the lake, and possibly add a level? The neighbor had told me each cabin had a separate variance for expanding. Listing agent just told me she thought they could build out west but she wasn't sure. Any extension of the surface of public waters from work authorized by this permit shall become public waters and left open and unobstructed for use by the public. 11. Where the work authorized by this permit involves the draining or filling of wetlands not subject to DNR regulations, the permittee shall not initiate any work under this permit until the permittee has obtained official approval from the responsible local government unit as required by the Minnesota Wetland Conservation Act. 12. Spoil material shall not be placed on the beds of protected waters, and wherever possible, such material should not be placed anywhere within areas subject to flooding. All spoil materials is to be placed on upland areas only and is specifically prohibited from deposition within any wetland areas. 13. Invasive Species. All equipment used must be free of prohibited invasive species and aquatic plants prior to transport to or .use in public waters. All equipment used in waters known to contain aquatic invasive species shall be inspected by the permittee or the contractor and adequately decontaminated prior [o being transported. The DNR is available to train or assist in these inspections. A list of designated infested waters is found at httD://files.dnr.state.mn.us/eco/invasives/infestedwaters.Ddf. A. Before transporting equipment from a work site, inspect all equipment that had been in contact with the water and remove all visible aquatic remnants [plants, seeds, mud, soil, and animals]. Power washing followed by drying (7 days) is an acceptable method to ensure killing and removal of invasive species. B. Before transporting equipment from a work site, drain all water from equipment where water may be trapped, such as tanks, pumps, hoses, silt curtain, and water-retaining components of boats/barges. C. After spraying and draining, dry equipment that has been in infested waters for a minimum of 7 days before reuse. 14. General Erosion Control: Erosion control measures shall be adequately designed for the site characteristics. They may include staked haybales, diversion channels, sediment ponds, or sediment fences. They shall be installed in accordance with 'The Minnesota Stormwater Manual". MPCA, November 2005 (and as revised in the future), prior to commencement and maintained throughout the project. All exposed soil shall be stabilized as soon as possible and no later than 72 hours after the completion of the project. Topsoil should be used to re-dress disturbed soil areas and indigenous plant species should be us^ to revegetate disturbed areas whenever possible. 15. The permittee shall ensure the contractor has received and thoroughly understands all provisions of this permit. Contractors must obtain a signed statement from the property owner stating that permits required for work have been obtained or that a permit is not required, and mail a copy of the statement to the regional DNR Enforcement office where the proposed work is located. The permittee shall comply with all rules, regulations, requirements, or standards of the Minnesota Pollution Control Agency and other applicable federal, state, or local agencies. 7. Upon completion of construction, the bed of the protected water shall be restored as nearly as practicable to the original cross-section. 8. Future maintenance excavation of this project shall not exceed the dimensions herein authorized. Prior to commencing any maintenance excavation, permittee shall advise the Department of Natural Resources of the volume of material to be removed, the manner of removal, and the spoil disposal site(s) proposed. Maintenance excavation shall not be commenced until permittee’s receipt of the Department's approval. 19. October 7, 2006 Page # 5 Wayne Horgen - Approved a variance for a modified request with conditions. (9:15 p.m.) Wayne Horgen, part of Government Lot 1, Section 30 of Girard Township by West Battle Lake, requested the following: "This is a variance request to develop three residential back lots with a reduction in the minimum frontage requirements for residential back lots. The requirement for residential back lots for a General Development lake is 200 feet of frontage and 40,000 square feet. The request is a reduction for Lot 1 of 100 feet and 2 and 3 is reduction of 150 feet from the required 20C feet. On proposed Lot 2 and Lot 3, the proposed plan is to have a common shared driveway for the lots. Upon approval for the variance, the applicant will proceed to submit to the Otter Tail County Planning Commission to subdivide the lots. Jim Peterson appeared with the applicant at the public hearing. September 14, 2006 - The audience was polled with Orlo and Barbara Baslington, James Line and Bob Westgaard expressing concerns with the variance as requested. Letters from Glennis Decker-Brosz, Marilyn Eastman, Michael Werner, Robert and Judith Reed and William and James Jedlicka, Rod and Bonnie Nelson and James and Linda Line in opposition to the variance as requested was read for the record. An email from Mark Neitzke and Nancy Grossman opposing the variance as granted was read for the record. After consideration and discussion. Steve Schierer made a motion, second by Randall Mann and unanimously carried, with the verbal permission of the applicant, to table this application until the October 5, 2006 Board of Adjustment meeting to allow the applicants an opportunity to consider other subdivision alternatives. October 5, 2006 Meeting - Jim Peterson, Surveyor, appeared along with the applicant. Mr. Peterson presented an alternative which displayed how the entire parcel could be developed. This alternative is not what Mr. Horgen wishes to do with his property at this time. Mr. Peterson presented another alternative to create one 5 acre parcel instead of the three parcels as originally requested. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve as a buildable lot a 5.02 acre metes and bounds parcel having only 100' of frontage on the public road with the following conditions; 1.) a registered surveyor’s drawing must be provided and 2.) no structures can be located/placed in the narrow portion of the parcel which from the drawing submitted at the public hearing would be approximately the first 200’ back from the road right-of-way. Lots 13 and 14 Linden Park, East Battle Lake in Girard Township, requested the following: I propose to construct (1) 22’ by 34’ addition with a 10’ by 8’ entry, (2) 24’ by 40’ second story addition to existing dwelling and (3) 24’ by 40’ second story addition to existing garage (to become one structure). The closest addition will be 24’ form the ordinary higi water level. Requesting a variance of 76’ from the required ordinary high water level setback of 100’ for the development as proposed above. Project timeline is over the course of approximately three years. September 14, 2006 Meeting > The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Randall Mann and unanimously carried, to table, per the request of the applicant, this variance hearing until the October 5, 2006 Board of Adjustment meeting. The applicant requested this action prior to the September 14, 2006 meeting and indicated that he would submit a written request for the file. October 5, 2006 Meeting - Prior to the meeting Thomas A. Gedde, Attorney for David Nyhus, submitted a letter requesting that the hearing be tabled un the November 2, 2006 meeting. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to table, per the request of the applicant’s attorney, this variance application hearing until the November 2, 2006 meeting of the Board of Adjustment. Additional Discussion - Scenic Point Resort - April 1, 1999 # Eric Babolian, Land and Resource Management, brought forth for discussion a variance application which was originally heard by the Board of Adjustment on Thursday, April 1,1999. Mr. Steve Adams appeared to represent his interest (Cabin N 5) in the Scenic Point Resort Development. In April of 1999 a number of additions were approved by the Board of Adjustment. The issue before the Board of Adjustment was how the roof on the addition would be connected to the existing structure and if a variance should be required. The Board of Adjustment took no formal action regarding the information discussed, but did indicate general agreement with the project; however, it was the opinion of the Board that the Land and Resource office and the County Attorney’s office needs to determine if another variance application is necessary due do the change in the roof pitch. If local governments require land or easement dedications, they must provide easements over natural drainage or ponding areas for management of stormwater and significant wetlands. Cluster Developments: A. General: 11. All cluster developments, which have been in operation continuously since October 15, 1971 may continue to operate the number, type and size of dwelling units which were in operation on October 15, 1971. Any change will require that the owner obtain a Conditional Use Permit which will authorize a specific number, type and size of dwelling units. All owners of cluster developments which have opened since October 15, 1971, must have a Conditional Use Permit which specifies the number, type and size of dwelling units which they are authorized to operate. Any change in number, type or size of dwelling units requires a new Conditional Use Permit. When applicable, all resorts, recreational camping areas, manufactured home parks and campgrounds must also receive a license from the Minnesota Department of Public Health. 1. Pre-Application Meeting: Prior to the submission of any plans for consideration to the Planning Commission under the provisions of this Ordinance, the potential applicant shall meet with the Administrative Officer and learn what shall be expected of them in such a capacity. 2. Crowding potential: Applications for Conditional Use Permits for cluster developments shall take into consideration crowding potential as defined in this Ordinance. 3. Before final approval of all Cluster Developments, adequate provisions must be developed for preservation and maintenance in perpetuity of open spaces and for the continued existence and functioning of the development as a community. Open spaces must be preserved by deed restrictions, covenants, permanent easements, public dedication and acceptance or other equally effective and permanent means. The instruments must include all of the following protections: a. Vegetation and topographic alterations other than routine maintenance prohibited. b. Construction of buildings other than indicated on the preliminary plan or storage of vehicles and other materials prohibited. c. Uncontrolled beaching is prohibited. 4. Development organization and functioning.Unless an equally effective alternative community framework is established, when applicable, all Cluster Developments must use an owners association with the following features: a. Membership must be mandatory for each dwelling unit or site purchaser and any successive purchasers. b. Each member must pay a pro rata share of the association's expenses, and unpaid assessments can become liens on units or sites. c. Assessments must be adjustable to accommodate changing conditions. d. The association must be responsible for insurance, taxes and maintenance of all commonly owned property and facilities. Mr. Hendershot contacted me and indicated that he wanted me to witness his attempt to resolve a sewer complaint by the owner of the Resort. He felt the owner of the resort was unfairly blaming him for sewage system failure. While onsite, the lift station was uncovered and was full beyond pump cut-in level. The pump ran, but was not emptying the lift tank. There was a broken coupling on the vertical pipe in the lift station found and it was replaced. After the replacement, the pump ejected effluent, however due to a break in the liftline, the effluent surfaced near the crest of the hill. Discussion: Bill Kalar had the Commission discuss the possibility of Scenic Point (Terry Colton), Clitherall Lake (56-238), adding additional campsites to their resort. Colton Scenic Point Resort Route 1, Box 201 Clitherall, MN 56524 LAND a RESOURCE Dear Mr. Colton: AMENDMENT, PERMIT 85-1023; CLITHERALL LAKE, OTTER TAIL COUNTY This letter acknowledges the receipt of your $30.00 check (amendment fee) and letter requesting maintenance excavation within your harbor in S.13 T.132N R.40W, Otter Tail County. The request has been reviewed with Department personnel in Fergus Falls, and herein is officially approved. Therefore, the authorized work in Permit 85-1023 is amended to read: "Perform maintenance excavation (removal of accumulated sand, debris, or sediment) on the existing L-shaped harbor inlet channel measuring 25 ft. in length (distance from the ordinary high water mark of Clitherall Lake to the mouth of the harbor), 10 ft. in width and 2.5 ft. in depth, and to also include maintenance excavation within the 250 ft. long harbor adjoining the channel. No enlargement of the harbor is authorized by this amendment. All spoil (removed materials) shall be placed on land above the ordinary high water level of Clitherall Lake." All other provisions of the original permit shall remain in effect. The enclosed orange card should be posted on-site prior to the commencement of the maintenance excavation. The expiration date for this work is November 1 5, 1988. All future maintenance excavation shall follow the requirements of Special Provision No. IV, and relates to the work dimensions as amended herein.
