Planning Commission Recommendations Preliminary Plat - “Rose Acres’YMr. & Mrs. Wavne Neu: Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat of "Rose Acres" on Rose Lake with conditions as recommended by the Planning Commission. The property is described as Pt of Gov Lot 3 & 4, Pt NWVi SEVi & Pt SE%SEVi, Section 17 of Hobart Township, Lake No. 56-360 RD. Conditional Use Permit - Scenic Point Partnership - Withdrawn by Applicant: Owner of Scenic Point Resort on Clitherall Lake, Terry Colton, explained that his proposal was to split Scenic Point Resort (currently 12.44 acres) into 2 separate entities. Mr. Colton stated that the property was established with cabins on the West side and a few cabins on the East side along with a campground with separate roads, wells, etc. The Planning Commission would eliminate 14 present units on the property if the split occurred. Mr. Colton opposed the decrease in number of units in the resort because there would be no further impact to the lake, lake esthetics, or neighborhood. Land & Resource Director, Bill Kalar, presented a map of the initial resort and a map showing the proposed split with Section B enlarged. With a change in size of lots, the Planning Commission felt that the entire operation of the resort should be looked at to see how it fits with current SMO guidelines. The Planning Commission recommended that Parcel A should have 12 units and Parcel B, 8 units. Discussion followed regarding ordinance language that if a change occurs, minimum requirements of the current SMO may need to be met. In this case, a split would result in 2 substandard parcels. Motion by Lee, second by Froemming, and unanimously carried to uphold the recommendation of the Planning Commission to accept the applicant’s withdrawal for a Conditional use Permit for Scenic Point Partnership on Clitherall Lake. Donald & Suzanne Tirk - Tabled: A Conditional Use Permit Application to allow us to keep the 34 inch high partial retaining wall as built beyond the zoning setback distance as shown on the plot plan (on file at Land & Resource). We request approval in order to ensure safe access to our cottage and safe use of our lot for our severely disabled quadriplegic and spacially impaired daughter. There would be no retail sales, no employees, no commercial sign on site and no outside storage of product related to the business. We do not plan on customer traffic however, there is adequate off-road parking in the private driveway on our property should a customer come to the business. The garage would continue to be used for parking our personal vehicle when no work is being done in the shop. Purves - Approved With A Condition: On November 10, 1999, the Planning Commission tabled a Conditional Use Permit Application for a topographical alteration to construct a driveway from Tordenskjold Township lOO* Street to the building site on a 19.68 acre lot located on the southeast shore of Long Lake. The drive will be 18' wide at the surface and approximately 850’ in length. It will be constructed in two phases. Assuming approval, the first phase involving significant excavation from the Township Road north approximately 400’ will be completed soon after April 15, 2000. The second 450’ that requires only grading and gravel coating of an existing drive will be constructed probably in the summer of 2001 after I have had time on site to determine the best building location. Reason for approval: This proposal is as safe a driveway as can be installed in this area and other alternatives were considered. Motion: A motion by Lachowitzer, second by Bergerud to approve as presented, provided: 1. All the work is done inside the garage. 2. There is no outside storage of material or product. Reasons for approval: 1. The garage is across the road from the residences. 2. The noise should not affect anyone in the area. 3. Stich - Approved As Presented: A Conditional Use Permit Application for a new Conditional Use Permit to cover the proposed lot line changes. These changes are proposed to separate the commercial property from the homeowner properties. We request the continuation of this business operation (Comer Store) on Parcel C (as proposed) with no proposed changes in the manner it is currently being operated. Alberg, Russ OTTER TAIL COUNTY PLANNING COMMISSIONTo: Subject: SCENIC POINT SUBDIVISION BRET OLSON— I am responding to the attached request to subdivide Scenic Point Resort on behalf of Charlotte Barnack. I am her son and she has asked me to handle the business affairs for her farm property and lakeshore property which borders the property to be subdivided. Our concern is that Mr. Colton may not have enough lakeshore to operate his traiier park as a separate unit from the resort. Mr. Colton has been renting and leasing lakeshore from Charlotte Barnack to provide lake access for his trailer park up through 1998. In 1999 Mr. Colton opted to no longer lease the property and is attempting to take it from her through the courts. The case is still open in Otter tail District Court. Case number is C1-99-1654. I have attached a copy of the case and the property affected for your information. We request that the Charlotte Barnack property in no way enters into the subdivision equation. HAUSER 11-17-99DATE: Splits of cluster developmentsRE: In reviewing our ordinance, it appears clear to me that a split of a cluster development into two parcels would require new conditional use permits. Our ordinance requires, on page 21 at Section IV. 11 .A., that cluster developments have conditional use permits. Any changes in these developments which were in existence prior to 1971 require a conditional use permit and any changes in the number, type or size of dwelling units requires a new conditional use permit. A split of an existing cluster development would result in smaller cluster developments which should be subject to review by the Plarming Commission.
