As of my site visit of 23 May 2012, the discrepancies noted on my 22 December 2010
letter and Violation #2880 have been “satisfied”.
It appears that the septic system serving the facility is functioning properly and has more
than sufficient sewage treatment capacity for the number and type of units present.

Mr. Peloqun,
I was out to the subject property again on 5 January 2012 to verify the progress towards
“compliance” made by Mr. Roger Schleske (owner of subject facility).
At that time, I took pictures and noted that the only action that would keep the septic
system from being in full compliance is the physical “abandoning” of three existing
drainfield trenches that do not meet our required separation distance of 3’ from the
restrictive layer of moisture in the soil.
This will need to wait until spring, and the County is willing to give Mr. Schelske until 1
June 2012 to bring this into compliance. We will continue to work with Mr. Schleske to
ensure that this is done.
Mr. Schleske has corrected all of the observed “imminent threats to public health”
observed pertaining to the MHP’s septic system.

Sir:
As I promised during our meeting on site 17 May 11, lam sending you thisletter detailing
the requirements for satisfying the outstanding violation (septic problems).
Many of the problems detailed in my December 2010 remain valid and are repeated
below. In addition, the original 1973 seepage bed is still connected to the park septic
system and is essentially a “direct connection” to the surface water in the Township road
ditch and the drain pipe that flows directly into the Pelican River.
#1. Shed over pumping station East side of facility. Buildings are not allowed to be less
than 10 feet from a structure by the MN septic rules. The top of the lift station is not
securable”.
#2. Pumping station East side of the facility. Tank has no lid. Not secured against
“unauthorized entry”.
#3. Inspection riser on septic tank East side of facility, pipe damaged. No cap on riser.
#4. Manhole cover. East side offacility, stainless steel fastening screws are missing.
#5. The main septic tank and lift station (center of the facility) have been covered with a
shed. Buildings are not allowed to be less than lO feetfrpm a structure by the MN septic
rules. The electrical connections,to the pump and floats are improperly installed; The
cover to the lift tank is missing. The main septic tanks do not have maintenance holes
(manholes) accessible for pumping/cleaning the tanks. Tanks cannot be properly cleaned
via the inspection risers.
It appears as if a significant portion.of the septic system servicing the park requires repair
of replacement and you need to contact a licensed septic system inspector to conduct a
“Compliance Inspection” on the park system.

This will allow an “independent third party” to “troubleshoot” the system and also
determine what is actually there, where it is, and if is serviceable or repairable.
The County has limited records on this facility as it was constructed in 1973 under
guidance and licensing by the MN Department of Health and the MHP portion of the
property falls more than 3Q0’ from the Pelican River and therefore out of bur jurisdiction for
structures. The County did not require septic permits for.Non-Shoreland properties until
1996.

I am enclosing copies of all the records we do have for your information. The schematic
drawn by Delzers in 1992 may be of some use for part of the system.
The flow of sewage into the old 1973 seepage bed must be stopped immediately. The
other discrepancies must also be addressed, but we can discuss a timetable once your
Compliance Inspection has been completed and we know exactly what needs to be done
to properly treat the sewage generated by the park.

As I promised during our meeting on site yesterday, I am sending you a copy of the
pictures I took of the septic problems noted on my 17 Nov 10 visit to the MHP.
I will number and annotate the backs of the pictures to help to explain the problems.
#1. Shed over pumping station East side of facility. Buildings are not allowed to be less
than 10 feet from a structure by the MN septic rules. The top of the lift station is not
“securable”.
#2. Pumping station East side of the facility. Tank has no lid. Not secured against
“unauthorized entry”.
#3. Inspection riser on septic tank East side of facility, pipe damaged. No cap oh riser.
#4. Manhole cover. East side of facility, stainless steel fastening screws are missing.
#5 & #6. A wetland has developed over the original 1973 seepage bed. When the snow
conditions have eased (Spring 2011), the main septic tank must be treated with tracing
dye to determine if the 1973 seepage bed is still connected to the facility sewage
treatment system. I will coordinate this with you in the spring.
#7. The garden hose that is pictured has been used to transfer sewage from the lifting
station (East side of the facility) to the North drainfield in order to work on the pump in the
lift station. This is not allowed under the MN septic rules.
#8. The main septic tank and lift station (center of the facility) have been covered with a
shed. Buildings are not allowed to be less than 10 feet from a structure by the MN septic
rules. The electrical connections to the pump and floats are improperly installed.

From the water marks on the plywood floor, I suspect that there is also a problem with the
tank(s) covered by the shed.' I
From the comments you made during our conversation, it appears as if you have been
doing maintenance and repair on the septic system that services the facility. This is
problernatic, as since this is a commercial facility, only properly licensed personnel are
authorized to work on the water, plumbingiand septic systems. If you do not possess the
proper credentials, you cannot do such work yourself. In order to perform
maintenance/repairs on the septic and plumbing system^ you must either have the
appropriate credentials yourself, or hire someone who does.

It is urgently necessary to secure access to the septic and lifting station tanks before
someone gets in there and is harmed. Please contact a septic professional to do this
immediately. The other discrepancies can wait Until spring to fix.

We received an anonymous complaint on 16 Nov 10 alleging that the MHP septic system, was "running into the road
ditch".
The address of the facility is 26177 River N Woods Circle, Fergus Falls, MN 56537.
I visited the facility on 17 Nov 10 and noted that there were several significant problems with the septic system. If the
original 1973 seepage bed is still connected to the main sewer, it is presently under water and is a cattail marsh. This is
directly connected to an area of high surface water that is chronic in the entire subdivision.
The two septic pumping stations are not in compliance with current septic codes and need to be replaced. They are not
tight (the old metal lids have rusted away) and are not "secured against unauthorized entry".
I would think that this creates an additional "public health nuisance"/safety/child endangerment/attractive nuisance etc.

I am issuing the owners violation #2880 today, with a response date of 1 Dec 2010.
It appears that all of the historical records for this facility were given to the MDH representative (Rick Toms) when I
turned over the files for Otter Tail County in 1999 when the MDH received the County back. I do not know what became
of them after that.
I have no record of any approved work/additions being done on the septic system that serves this facility since it was
created in 1973, although I do know of one drainfield put in on,the North side of the property.
Any assistance you may be able to provide with this problem will be greatly appreciated.

I just received your April 13, 1992 letter (copy attached.) It poses several
questions that may have been answered to your satisfaction during our meeting
on April 16, 1992. I shall answer your questions in the order you presented
them:
Mr. Clifford Moen has made two visits to the office to sight the
file on River-N-Woods (PUBLIC RECORD.) During these visits, he
mentioned that he had made seven attempts to regain ownership of
the facility and was planning another. No other individuals were
mentioned outside of yourself, Sgt. Morris - OTC Sheriff's Dept.,
Mr. Stewart, Mr. Paul Sonmor, and Mr. Doug Johnson. I informed
Mr. Moen, as I have yourself, that 1 cannot comment on past
occurrences, that I have no personal knowledge of past
occurrences, and that my concern (and the County's) is that the
sewage discharge be contained and kept from re-occurring. Any
personal or legal differences between citizens is their affair.

As we discussed on April 16, the drainfield in the hollow north of
the "store" has to be considered a failed system, because it is
saturated, too close to the water table, and subject to seasonal
flooding. there is sewage effluent seeping to the surface. As
you should remember, Mr. Bill Kalar is the County Land and
Resource Management Department agrees with this.

I have no record of the low ground field (1987?) or the newest
field up to the north being officially approved, and I have no
percolation tests for the hilltop field. I furnished you with
copies of all the documentation I could find in the file
concerning the two fields in question. As Mr. Kalar and I
suggested, you need to talk to Paul Sonmor at Delzer Construction
and see if he has records concerning the installation of the
newest field.

Dear Mr. Mullin:
On April 7, 1992, I the undersigned investigated a complaint relative
to sewage being discharged to the earth's surface. The complaint was
found to be valid.
The site of the seepage is in the drainfield adjacent to the township
road and in the low ground to the South of the Northwest drainfield
investigated on February 12, 1992.
It is obvious that you now have two failed drainfields that require
immediate attention.
It is a violation of Minnesota Pollution Control Agency's rule number
7080 to discharge or allow effluent from any cesspool, septic tank,
leaching pit, dry well, drainfield, soils absorbtion field, or other
types of on-site sewage treatment to flow or emerge to the earth's surface.
Any replacement/repair to the above failed drainfield will require approval
of this office and the County Land & Resource Management office, and must
be performed/constructed in total compliance with Chapter 7080 of the
Minnesota Rules.
Be advised that this office must be made cognizant of your intentions in
the above cited matter within ten (10) days of receipt of this notice.
Failure to respond in writing within the allotted time, will be cause for
the matter to be referred to the County Board of Health. The Board may
declare the discharge a public health nuisance and order the necessary
repairs to bring the sewage treatment facility into compliance with MPCA
Rules 7080. The cost of these repairs will be assessed to your tax liability.

Dear Mr. Moen:
Our onsite meeting of June 2, 1987 regarding your proposed project revealed
the following information:
It is my understanding that you plan to replace 9 recreational
vehicle sites with 5 manufactured home sites.

2. The sewage system on your property will be modified to properly
serve the needs of all the dwelling units (present and proposed) on
your property.
This inspection also revealed that the proposed project will be over 300
feet from the Pelican River. Please note your proposal lies outside the
district boundaries of the Shoreland Area established by the Shoreland
Management Ordinance of Otter Tail County.
Since this is the case, our office has no jurisdiction regarding this
project.
