Motion
Motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to approve the
variance as requested for the upgrade of the existing septic system identified as site “C” on the applicant
drawing. It was noted that this is the best location available as determined by an licensed septic system
installer.

Pocahontas Resort - Approved
Pocahontas Resort, C/0 William and Collene Barnick, Dent, MN, requested the following; “We
are applying for this variance in order to upgrade our septic system to code as you have
requested. Permits have been applied for by our contractor Dan Barry. These plans are on file
in your department if you need exact reference to the plan. We need to put the lift tank for the
office and our private house closer to the lake then the usual setback.” Requesting a variance
of 105’ from the required ordinary high water level setback of 150’ for the placement of a lift
station 55’ from the ordinary high water level. The property is described as part of the
Southeast Quarter of the Southeast Quarter, Section 7, part of Government Lot 1, Section 8,
part of Government Lot 3, Section 17 and part of Government 2, Section 18 of Dead Lake
Township by Dead Lake. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by John Everts, seconded by Robert Schwartz
and unanimously carried, to approve the variance as requested for the upgrade of the existing
septic system identified as site “C" on the applicant drawing. It was noted that this is the best

Roland Johnson - Approved
Roland Johnson, Moorhead, MN, requested a variance of 43’ from the required ordinary high
water level setback of 75’ and a variance of 6’ from the required side lot line setback of 10’ for
the replacement of an existing flat roof with a pitched roof located 32’ from the ordinary high
water level and 4’ from the side lot line. The property is described Lot 6, Anderson Beach, Big
Pelican Lake in Scambler Township. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Craig Anderson, seconded by
John Everts and unanimously carried, to approve a variance of 43’ from the required ordinary
high water level setback of 75’ and a variance of 6’ from the required lot line setback of 10’ for
the replacement of an existing flat roof with a pitched roof located 32’ from the ordinary high
water level and 4’ from the lot line. It was noted that the applicant’s proposed plans will place
the structure no closer to the ordinary high water level than the existing structure. Hardship is a
flat roof in need of major repairs.
David Johnson - Approved
David Johnson, Battle Lake, MN, requested a variance of 4’ from the required lot line setback of
10’ and a variance of 14’ from the required road right-of-way setback of 20’ for the construction
of a garage 6’ from the back lot line and 6’ from the road right-of-way (approximately 22’ from
the edge of the road). The property is described as Lot 7, Rosenquist Beach, Eagle Lake in
Eagle Lake Township. The audience was polled with no one speaking for or against the
request. A letter from the Eagle Lake Town Board of Supervisors in favor of the applicant’s
request was read for the record. After consideration, motion was made by Cecil Femling
seconded by Craig Anderson and unanimously carried, to deny the variance as requested
noting that the variances are to great and noting that the applicant is proposing a two story
garage. After additional consideration, motion was made by Craig Anderson, seconded by
Randall Mann and unanimously carried, to approve a variance of 10’ from the required road
right-of-way setback of 20’ for the construction of a single story garage 10’ from the road right-
of-way and 10’ from the lot line. The granting of this variance provides the applicant with a
reasonable use of his property.
