Dear Ms. Bamick, As per our conversation on June 12, 2006 and after discussing the situation with Bill Kalar, your options are as follows: 1) You can remove the structure from your property. 2) You can remove the structure, then call our office so an inspector can verify removal and apply for and receive a site permit for the standard price of $90.00 and replace the structure onsite in a legal location. If no legal location can be found a variance would have to be applied for and received before the Site Permit could be issued. 3) You can leave the structure onsite and apply for and receive an After-the-Fact Site Permit to move it to a complying location. In this case a variance would also be required if a complying location could not be found. 4) You can ignore the situation and on August 11, 2006 I will forward a violation to the County Attorney for prosecution. Barnick, Jr. 1301 Second Avenue South Moorhead, Minnesota 56560 Dear Mr. Barnick; This is in response to an investigation of citizen complaints of improper refuse disposal, illegal open burning and improper liquid storage at the Pocahontas Resort on Dead Lake in Otter Tail County. The investigation conducted on March 20, 1981 by staff from this Office confirmed the validity of the complaints Cans, bottles, ashes and a large gasoline storage tank were observed on the beach within twenty (20) feet of the water's edge. These refuse disposal practices appear to be in continued violation of state and local laws, and specific instructions provided you by Mr. Richard Astrup (Min­ nesota D epartment of Health) on August 26, 1980. The placement of a gasoline storage tank on the shore of a lake in this manner is in violation of Minnesota Pollution Control Agency Regulation WPC-4 (copy enclosed). Please discontinue the disposal of refuse of this property and direct this material to a permitted sanitary landfill. You may wish to avail yourself of one of the several refuse collection services in the area for this purpose. Enclosed for your convenience are guidelines and applications for permit for construction of liquid storage safeguards should above ground storage of flam­ mable liquids be allowed by your Health Department license, state and local fire codes, and County Shoreland Zoning restrictions. You should check with these Agencies before committing yourself to above ground storage of gasoline.
