Senyk; I have recently been in contact with Mr. Fred Wright who is in the process of developing his property on the north shore of Little Pelican Lake. The plat of Pelican Heights Subdivision has a dedicated r«ad going te the top of a sixty-f*ur f»ot hill. Mr Wright owns all the land adjacent and contiguous to the road. It has never been maintained by the county or the township and has deteriorated from washouts to the point where it is impassable. He is willing toMr. Wright wishes to vacate the present road as it exists, see that there is a dedicated road for the public use in his project. The Dunn Town Board has no opposition to the vacation of the present road which goes to the top of the hill and is on record as favoring Mr. Wright's project. (See copy of enclosed letter to County Planning Commission). Wright and we are in agreement as to the proposed locations of approaches and culverts. He has also indicated a willingness to build the roads in the development in accordance with Dunn Township specifications so that they could be maintained by the township should that possibility arise in the future. VJe have reviewed the revised preliminary plat of Pelican Heights Cluster and have walked over the grounds. The location of the proposed roads as indicated on the plat follow existing roads or natural contour lines and would have a minimal effect on the topography. Little Pelican Lake in Otter Tail County was sounded and mapped in 1965-1966. Records kept by the Division of Waters and the Division of Fish and Wildlife indicate that the shoreline length was<^6.2_jgiiles~~ at the time of the survey. I have rechecked this using a map wheel and the lake map (DOW Number 56-761) and USGS quad map (Lake Franklin Quadrangle, 1972) and found this length to be reasonable. The outlet bay to the Hwy 31 bridge was apparently included in the figure. Little Pelican lake has a planimetered area of 344.9 (Division of Fish and Wildlife figure) or(_385 acres*. (Division of Waters figure). The discrepancy is probably due to Division of Waters measuring the lake area at normal high water mark which will include wetlands, marshy areas, etc. in the basin. All of this information is available on the lake map. I hope this letter has been useful. GAP BETWEEN PARCELS; As pointed out in the title opinion on the metes and bounds property that you own in Government Lot 4, there is a possible gap between the platted property and the unplatted property which you own. A quiet title action may be needed to clear this problem. 4. POSSIBLE OVERLAP: There is a portion of lakeshore property between Lots 2 and 3 of Block 2 which you do not own, which is apparently owned by Colemans. Because of the way that this property is described, it is possible that the property overlaps with Lots 2 and 3. It would be recommended that the Colemans, or current owners of this missing piece of property, deliver a quit claim deed to you for Lots 2 ands 3 of Block 2. General Provisions A. B. C. Definitions Farm - The aggregate area operated by any one person, family, partnership, corporation or joint venture for agricultural or farming purposes. The entire unincorporated area of the town of Dunn is hereby established as an ••Agri­ cultural Zone^'. Section IV. Permitted and Prohibited Buildings and Uses A. Permitted uses in an "Agricultural Zone" are as follows: Agricultural Uses - The use of the land for agriculture or farming purposes, including grain farming, dairying, pasturage, horticulture, floriculture and animal and poultry husbandry and the necessary accessory uses for packing, treating and storing the produce secondary to that of normal agricultural or farming activities. 1. Provided, use of land shall not be considered as used for agricultural farming purposes If the aggregate acres owned, rented or operated for such purposes do not equal 10. acres in area. (d)Having a minimum frontage of 200 feet, subject to any additional restri­ ctions by virtue of the Shoreland Management Ordinance of County, Minnesota.Otter Tail Special Uses - The following special uses may be compatible within the Agricultural Zoning district but the town board shall review the proposed use to ascertain such compatability: C. The offices of members of recognized professions, such as doctors of medicine and dentistry, chiropractorsand engineers, lawyers and architects, provided such professions- are carried-on in their respective residences. Federal, state or local goverxunent buildings and facilities. 1. 2. Nursing homes, hospitals or sanatoria.3. Resorts, camp grounds and other recreation oriented commercial use.4. Customary home occupations in the resisdence, provided that such occupation shall be carried on in the main building, and provided further that no more sthan 25 percent of the floor space of the residence is used for this purpose. 5. Churches, chapels, temples and other houses of worship.6. Junior and Senior high schools, and incidental usss when situated of the same site or unit of property. 7. 8.Cemeteries. Dual-family and multi-family dwellings.9. Junk and auto and machinery salvage yards. Location of a mobile home or other dwellings upon a lot which already contains a business or a dwelling, that it is compatible with existing nearby uses as well as with the overall plans, and it shall be presumed that such uses are incompatible with existing uses until shown to the contrary. 10. 11.Such use shall be permitted only when it is found 12. Mobile home parks and R.V. parks. 13. Parks and Playgrounds. Railroad right-of-way, regional pipelines, power transmission lines and relay towers. 14. Page 3 Establishment and maintenance of any public firing range or public hunting area.15. Such other uses and structures as may from time to time be appoved by the town board upon proper application. 16. That the special use will not be injurious to the use and employment of other property in the immediate vicinity for the purpose already permitted, nor substantially diminish and impair property values within the general vicinity; (a) That the establishment of the special use will not impede the normal and orderly development and improvement of surrounding vacant property for uses predominate in the area; (c)That adequate utilities, access roads, drainage, and other necessary facilit­ ies have been, or can be provided. D. Uses Specifically Prohibited prohibited: The following uses and actions are specifically Discharge of a firearm with the muzzle pointed toward any building, road, person domestic bird or animal,-machinery, equipment'-or vehicle. 1. Discharge of a firearm within 500 feet of any building without the permission of the owner or occupant of said building. No private driveway or field approach shall be constructed to connect to a town­ ship road except by permit furnished by the town board. 2. 3. Section V. Non-Conforming Uses Any lawful use existing at the time of the adoption of this ordinanace may be continued after the adoption of this ordinance except as follows: No non-conforming use shall be renovated, expanded or reconstructed, except that it may be restored to its original use and size if damaged by any cause not to exceed fifty (50) percent of its present replacement cost as satisfactorily dem­ onstrated to the town board. A. If a non-conforming use ceases to be used and property maintained for a period of twelsve (12) consecutive months, or is changed to a conforming use, any subsequent use shall meet the requirements of the Zoning Use District wherein located. A non-conforming use shall not be moved to any other part of its site or to another site where it would still constitute a non-conforming use. B. C. Section VI. Application For Permits Written applications for permits shall be filed with the town clerk on forms to be furn­ ished by the clerk for that purpose, shall be complete and signed by the owner of the land upon which the building or use is contemplated and shall be accompanied by the necessary application fee or the application shall be deemed to be not filed. . 1 Page 4 Section VII. Application Fees Application fees shall be non-refundable and shall be filed with the applications for permits as follows: 1. Applications for permitted uses or buildings - no fee Applications for special uses or buildings2.- $10.00 Applications for other uses or buildings3.- $25.00 . Section VIII. Administration The town clerk shall issue permits for permitted uses upon the filing of the applica­ tion without any approval of the town board. A. Provided, the clerk shall refer the application to the town board if the clerk has any questions concerning the application or the requested permit. The town clerk shall issue permits for other uses only upon approval of the town Upon receipt of an application for a permit for other than B. board after bearing, a permitted use, the town clerk shall: Issue a notice of hearing, using the next regularly scheduled meeting of the board of supervisors of the towny if practicable. 1. Notify the applicant of the time and place of the hearing.2. Require the applicant to give written notice of the pending application to each owner of real estate located within one half mile of the site or 500 feet of the site in Lake Shore Management area of the proposed building or use and to each city within 2 miles of such site or use by deposisting in the U.S. Mails, postage prepaid, for the delivery as first class mail, a copy of such application and of the notice of hearing, not less than seven days in advance of said hearing, and to file with the said clerk proof of the giving of such notice in advance of the hearing, however, shall not Invalidate the proceedings. 3. Failure to receive such notice. Mail to each member of the board of supervisors and the zoning commission a copy of the notice of hearing. 4. Keep all necessary records and otherwise administer the terms of this ordinance.5. C. At such hearing the zoning commission shall: 1. Examine- the applicant, whose attendance at the hearing is required, concerning the application. 2. Consider possible adverse effects and hear all persons and review all evidence presented to the hearing concerning such application. Advise the town board whether it recommends approval or disapproval and any recommended conditions to be met before any approval. 3. The town board shall consider the recommendation of the zoning commission and shall take action on the application within 60 days after hearing. If it grants the spec­ ial use permit, the board may impose any special conditions it considers necessary to protect the public health, safety and welfare. D. Provided, if the applicant failed to file proof of the mailing of the required notices, failed to appear at the hearing or failed to answer questions concerning the proposed use or building, the hearing shall not be considered as complete until such failure is remedied. Page 5 E.Enforcement and Penalties: 1.This ordinance shall be administered and enforced by the town board with the advice of the zoning commission. Any person who shall knowingly, violate, infract, or disobey any of the terms provisions of this ordinance shall be guilty of a misdemeanor. Each 24 hour violation continues shall constitute a separate offense. All fines 2. day that aand cash receipts shall be credited to the general revenue fund. Validity:F. Should a court of competent jurisdiction declare any part of this ordinance to be invalid, such decision shall not affect the validity of the remainder. 1. Effective Date:G. This ordinance shall be in full force and effect upon the due passage thereof.1. Zoning Commission:H. S/X 1. The zoning commission is hereby established as -five persons appointed by the town board, two persons to be appointed each year for a term of three years to succeed the members whose terms then expire. No person shall serve as a member for more than six consecutive years. The Initial commission shall be composed of two members whose terms expire in one year, two members whose terms expire in two years and two members whose terms expire in three years. A quorum shall consist of three members. Section IX. Amendment This ordinance may be amended by the town board cf supervisors but only after holding a public hearing on the proposed amendment, notice of the time and place of such hearing to be given by at least one publication in a newspaper of general circulation in Otter Tail County. Provided, that no change in the boundary line of a zoning district shall be made unless 50 percent of, the owners of the lands proposed to be changed shall file a petition for such a change.'
