Box 122 Battle Lake, MN 55615 218-864-5860 Scott & Beth Madson Phone Number: Applicants: Variance Requested We request a variance to build a garage addition onto an existing storage building at Moe’s Otter Tail Beach Resort. The proposed location of the addition is T from the side lot line and 4’ from an existing alley bisecting the property. ' Reasons for the variance: The resort is in the process of being sold to the applicants for this variance, (Scott and Beth Madson). The resort currently has no garage or storage space for cars, lawn mowers, snowblowers, etc. The previous owner (Donald Moe) lives next door to the resort where he has had adequate storage space for these needs. The current owners property and storage buildings are not included in the sale of the resort. The proposed addition will improve the appearance of the resort by reducing the number of cars and the amount of equipment parked outside. This area will also double as a space for the new : owners to perform equipment maintenance during the off season. We do not believe that this addition will have any adverse impact to the property, the lake, or to neighboring properties for the following reasons: j • The existing alley running through the resort terminates at the north lot line and is used by resort patrons only. • The alley is already restricted by trees and will not be restricted any further by this addition. • The proposed addition does not encroach on the north lot line any further tlian the existing cabins or storage building. j • The proposed building location is the only logical place that a garage can be built on this property. In purchasing this resort we have invested in the area and intend to provide conWual improvement to a resort which has been in operation for over 60 years. We believe that this addition will approve the appearance of the resort by providing a place to park our cars, lawn mower, snow blower, and numerous pieces of resort equipment. In order for us to make a viable business of the resort, Beth will be working full-time outside of the resort, and Scott will be working part-time outside of the resort during the off season. Beth is currently employed at a construction company in Alexandria, which is a 50 mile drive from the resort. The property is described as Lot 5, Hilkoske’s Second Addition to Pleasure Park, Otter Tail Lake in Otter Tail Township. Mr. Hemelgarn, Contractor, represented the applicants at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to approve a variance of 39’ from the required ordinary high water level setback of 75’ for the replacement of an existing dwelling, which is located 7’ from the ordinary high water level, with a new dwelling located 36’ from the ordinary high water level. The proposed dwelling is behind the string line as determined when applying the string line between the structure two lots to the right of the applicants’ property and to the structure one lot to the left the proposed dwelling. It was noted that there are many non complying structures in this immediate area. Hardship is a substandard lot of record. Nancy and Todd Johnson - Withdrawn Nancy and Todd Johnson, Ottertail, MN, requested a variance to “build a 36’ x 56’ pole building. South East corner of building would be 8’ from lot line to permit the use of the existing road and allow future removal of present house (next year), with minimal tree removal, and still allow 27’ clearance." The property is described as part of Government Lot 2, Section 8 of Otter Tail Township by Otter Tail Lake. Prior to the scheduled public hearing the applicants provided notification that they were withdrawing their variance application. Dale V. and JoAnn M. Hinsverk - Denied Dale V. and JoAnn M. Hinsverk, Wahpeton, ND, requested the following: “I would like to have the living quarters above the garage left as is for minor usage.” The variance request is to allow more than one dwelling on the applicants’ property. The property is described as part of Government Lot 1, Section 2 of Everts Township by Otter Tail Lake. The audience was polled with no one speaking for or against the request. Letters from the following individuals addressing the variance request were read for the record: Neil E. Heitkamp, Wilfred Heitkamp and Marcella Heitkamp. After consideration, motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to deny the variance as requested noting the variance requested was for a use strictly prohibited by the ordinance. Donald Albert Moe - Approved Donald Albert Moe, Battle Lake, MN, requested “a variance to build a garage addition onto an existing storage building. The proposed location of the addition is 7’ from the side lot line and 4’ from an existing alley bisecting the property.” The property is described as Lots 1, 2, 21 and 22, Block 2, Midway Park, Otter Tail Lake in Otter Tail Township. The audience was polled with no one speaking for or against the request. Scott Madson appeared along with the applicant at the public hearing. After consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to approve the addition of a garage to an existing storage building 7’ from the lot line and 4’ from the alley with the condition that the addition cannot contain any living quarters. It should be noted that the addition would be no closer to the side lot line than the existing structure. It was also noted that the location of the garage 4’ from the alley does not present any major concerns since the alley is not a through road and since the alley is not used as a major ingress or egress for the development in that immediate area. According to Christensen, he thinks that the resort has developed shoreline on Otter Tail Lake that is supposedly platted as a public access. Christensen alleges that the resort has developed parking areas for its clients on the property. He says that he maintains accesses for the township and that is how he is aware of the public access designation. Christensen is concerned that if the resort continues to use the public access as their own property, eventually they will claim it as such. Please forward this report to Otter Tail County Land and Resource Management for follow-up.
