Otter Tail County Ordinance: X Shoreland Mgmt. U Sanitation. □ Subdivision. □ WECS □ Dock & Riparian Use □ Setback Ord. Ordinance Section Citation: IV. 12. D. (Expansion) A variance may be granted only where the strict enforcement of county land use controls will result In a "practical difficulty". A determination that a practical difficulty exists is based upon consideration of the following criteria: The applicant identified the following practical difficulty: The cabins are 100+ years old. The last ice push-up, the foundation has shifted and instead of fixing we would like to update the cabin. Otter Tail County Board of Adjustment - Variance Question Findings 1. Is the variance in harmony with the general purposes and intent of the official control? (The board shall consider the purposes and intent of the official control). X Yes, the variance is in harmony with the general purposes and intent of the official control... □ No, the variance is NOT in harmony with the general purposes and intent of the official control... ...because: The Land Use Ordinance allows for expansion of legal non-conforming structures through the variance process. 2. Is the property owner proposing to use the property in a reasonable manner not permitted by the official control? (The board shall consider what reasonable use of the property is lost (practical difficulties) by the strict enforcement of the official control). X Yes, the property owner is proposing to use the property in a reasonable manner... No, the property owner is NOT proposing to use the property in a reasonable manner... ...because: ( There are similar structures and land uses in the neighborhood with similar setbacks as noted during the onsite viewing. 3. Is the need for a variance due to the circumstances unique to the property not created by the landowner? (The board shall consider what circumstances are unique to the property, such as lot size, lot configuration, wetland, steep slope, shore impact zone, bluff floodplain, floodway, etc. One or more should be stated on the record. What differentiates this parcel from others? Does this lot have a feature that does not affect all parcels similarly?) X Yes, the need for the variance is due to circumstances unique to the property not created by the landowner.... □ No, the need for the variance is NOT due to circumstances unique to the property not created by the landowner... ...because: It is an existing legal non-conforming structure not meeting the required setbacks of the current Land Use Ordinance and built prior to any zoning reguiations in 1971 4. Will the issuance of the variance maintain the essential character of the locality? (The board shall consider and state for the record why the request does or does not maintain the character of the area. Is this request similar to what others have, what are near shore conditions of neighbors, similar sized or number of structures adjacent or in area, etc.) X Yes, the issuance of the variance will maintain the essential character of the locality.... □ No, the issuance of the variance will NOT maintain the essential character of the locality... ...because: There are similar structures in the neighborhood with similar setbacks. S. Does the need for the variance involve more than just economic considerations? (The board shall consider if economics played a role in the request. The fact that coming into compliance with the ordinance requirements may cost considerably more does not constitute a practical difficulty). X Yes, the need for the variance involves more than just economic considerations.... □ No, the issuance of the variance is only for economic considerations... ...because: The proposed improvements are to an existing legal non-conforming structure. The Otter Tail County Board of Adjustment: APPROVES the requested variance.DENIES Complete and attach After-the-Fact Addendum if this is an After-The-Fact variance request. DATED: August 13, 2020 Board of Adjustment Chair The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear a rough proportionality to the impact created by the variance. {Mitigating impervious surface with storm water management, deep rooted vegetative buffers, rain gardens, etc.) It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an infrequent remedy where an ordinance imposes a unique and substantial burden. % 750333 MIMJEEBTfl UNIFDHH COHVEYflNCINB BUWKS (197B)HfliTOtn SEEDIndividual Is) to Corporation or Partnership No delinquent taxes and transfer entered; Certificate of Real Estate Value ( —r Filed ( Certificate of Real Estate Value No. ) not required 0444SS ! . Box 160 Perham, Minnesota (TAK/pan) 55419 September 3, 2009 Page # 3 Greg and LaRae Langerud - Approved the variance as requested with conditions. (7:55 p.m.) Greg and LaRae Langerud, Lots 4 and 5 Block 1 Prairie Ridge and Lot 5 Jacobs Beach, Prairie Lake in Pelican Township, requested the following: existing house, built prior to October 15, 1971, is located 6’ from property line. Variance request is for 4’ on east side of property. Construction will change pitch of roof over main entrance to match ■ to a garage roof line. Construction will also change pitch of front porch to a gable. Being behind building line, ,■ approximately 70’ from lake shore. All changes are to roof line only. The audience was, ppllejd with.no one speaking, ■for or against the variance as requested. After discussion and consideration, MichaelHarris made a motion, second by Thomas Lee to approve the variance as requested with the condition that no more than 25% of the total eligible lot area can be covered with impervious surfaces. This motion failed with three members voting| in favor of the motion . and with three members voting in opposition to the motion. After additional discussion and consideration, Randall Mann made a motion, second by Steve Schierer and carried with Michael Harris and Robert Schwartz voting no to approve the variance as requested with the condition that the existing boathouse must be removed and the lakeside deck must be eliminated from the proposed project. It should be noted that the variance as approved will most likely result in imperious surface coverage greater than the allowable 25%, but less than the 29.8% as stated on the drawing submitted with the variance application. f;.'- Virginia Adams - Tabled (8:15 p.m.) Molly Stark LakesVirginia Adams, part of Government Lot 1, Section 25 of Everts Township by West Battle and requested the following: Virginia Adams would like to subdivide her property into 3 parcels, one for each of her 3 children. She is asking the Otter Tail County Board of Adjustments to waive the platting requirement as she does not have ownership or control over the 33 foot wide roadway commonly known as Rokmar Road and RokmarTrall. Ownership of the lands under Rokmar Trail appear to lie in Timothy Olson while the ownership of the lands under Rokmar Road are unknown at this time, and may still He with the original owner of Gov't Lot 1 prior to all of the subsequent tract conveyances. Platting requires a 66 foot wide dedicated road corridor and the existing roadway and ditches to be built up to the minimum road standards of Appendix 3 of the Otter Tall County subdivision ordinance. The existing roadway has adequately served for years as an ingress and egress access to the many properties along West Battle Lake. Any plans for the widening of the roadway, ditch work and the destruction of trees and natural vegetation would be met with strong opposition. The majority of her property falls within 1000 feet of both Molly Stark Lake and West Battle Lake. Virginia is asking the Otter Tall County Board of Adjustments to waive the tract area and width requirements as applied from Molly Stark Lake over proposed Parcels A and B. These two proposed parcels would meet the tract area requirements as applied from West Battle Lake and would fall only 11 feet short of the width requirements. Proposed Parcel C, wRh the permanent attachment of proposed Parcel C-1, would exceed the tract size and width requirements as applied from Molly Stark Lake. Required size of non-riparian lands falling within 1000' of Molly Stark Lake is 400’ of width and 5 acres of area. Required size of non-riparian lands falling within 1000’ of West Battle Lake is 200’ of width and 5 acres of area. William Adams appeared with the applicant at the public hearing. The audience was polled with Richard Miller speaking in support of the request and with the applicant’s son expressing his concerns. A letter from James S. Donelan expressing concerns was read for the record. Letters from Tim Olson and Robert and Norma Lee in support of the variance as requested were read for the record. After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to table, with the applicant’s verbal permission, this hearing until the next scheduled meeting of the Board of Adjustment to provide the applicant with an opportunity to consider other alternatives. For example - purchasing additional property, Gary Fluto - Approved the variance as modified with a condition. (8:42 p.m.) Gary Fluto, 2.5 acre tract in Government Lots 3 and 5, Section 12 of Amor Township by Otter Tail Lake, requested a variance of 45’ from the required lot line setback of 50’ and a variance of 30’ from the required ordinary high water level setback of 75’ for replacement of an existing mobile home (Unit I) with a new structure ^'approximately 5’ from the lot line and 45’ from the ordinary high water level. The audience was polled with Joyce Alfson expressing her concerns with the variance as requested. A letter from Joyce Alfson in opposition to the variance as requested was not read at the public hearing as Ms, Alfson was in attendance and addressed the Board in person. After discussion and consideration, Michael Harris made a motion, second by Thomas Lee and unanimouslyjcarried, to approve a variance of 40’ from the required lot line setback of 50’ for the replacement of an existing mobile home (Unit I) with a new structure at least 10’ from the lot line and no closer to the ordinary high water level than the existing building/sight line with the condition that no more than 25% of the total eligible area can be covered with impervious surfaces.
