To Whom It May Concern:
Enclosed please find Conditional Use Permit #6470. As you can see, this Permit allows
the replacement of two manufactured homes provided the impervious surface onsite does
not exceed 25% as required in the Shoreland Management Ordinance.
In reviewing the file, it appears that this parcel is currently covered with 25% of impervious
surface. Since this is the case, our Office will not be able to process any Site Permits that
would include additional impervious surface than what currently exists onsite. Therefore, if
you plan to proceed to replace these manufactured homes with larger structures (or
increase the impervious surface in any way), we would need to see your plan identifying
the removal of the appropriate impervious surface and also we would need to go onsite
and verify that it has occurred prior to processing a Site Permit.

Motion by Nelson, second by Froemming, and unanimously carried to approve an extension of one
year for Conditional Use Permit #6160, issued in September of 2003 with a 5 year plan. This
extension is approved until September, 2009 to allow more time for construction of the pole barn. The
property Is known as Shady Grove Resort on Rush Lake (56-141).
Motion by Erickson, second by Nelson, and unanimously carried to approve extension of Conditional
Use Permit #6467 (Carol Martinson & Juanita Gronda) for the road building time until October 15,
2007. Land & Resource Director, Bill Kalar, stated that erosion should not be an issue with this
project. The property is located on Rush Lake (56-141).
Mr. Kalar reported that a Conditional Use Permit was approved in year 2000 for Otter Tail Beach Club
I on Otter Tail Lake; however the CUP was not issued because they were unable to meet the
requirements of the 25% rule. All conditions including the 25% rule were later met in 2003 or 2004. A /,
landowner would like to replace a trailer and the Land & Resource Office is unable to issue a site
permit without the issuance of the CUP. Motion by Froemming, second by Erickson, and unanimously
carried with Nelson abstaining, to approve issuance of a Conditional Use Permit for Otter Tail Beach
Club with conditions as applied in Year 2000. The property is known as Otter Tail Beach Club in
Amor Township on Otter Tail Lake (56-242).

Dear President Stan,
As directed by the County Planning Commission, I went out to the 0TB Club grounds on 9 April
01 to determine the % of impervious coverage. I am attaching copies of the Commissions
determination on your CUP request and my figures of the impervious surface coverage at
present.
My measurements indicate a present coverage of @29% or @31,707 square feet. 25% of the
2.5-acre lot would be 27,225 square feet. Therefore, your present coverage is @4,448 square
feet more than the 25% maximum coverage required by the Shqreland Management Ordinance,
and written as a condition by the Planning Commission.
We vrill not be able to issue a Site Permit for an exchange of MH’s until/unless the total
impervious coverage is reduced to no more than 25%. This could possible be done by removal
of extraneous decking, sidewalks etc. Please refer to annotated plot drawing attached.

Approval to Pay Bills
Motion by Mosher, second by Froemming, to approve the bills per Attachment A of these minutes
which includes the following lodging payment:
American Motel & Suites Judy Siggerud, Dispatcher
Request for Approval for Retainage Reduction on
Project SAP 56-657-05 & Etc,
Motion by Lee, second by Nelson, to approve reduction of retainage to 1% for Mark Sand & Gravel
for overlay projects on CSAH 57, CSAH 81, and one mile of overlay on CSAH 65. Motion carried.
Update on Trail
Rick West gave an update on the trail between Pelican Rapids and Maplewood State Park. The
City of Pelican Rapids has chosen to proceed forward with the project; however, there appears to
be considerable opposition to the proposed trail location. Mr. West stated that Otter Tail County is
the sponsor of the grant.
Request for Forgiveness of Penalties
Treasurer, Steve Andrews, requested forgiveness of penalties on behalf of Mary Ann Nehl for
parcel nos. 74-000-99-0182-000 and 74-000-99-0183-000. Mrs. Nehl’s husband passed away on
June lO®’. Mr. Nehl took care of the financial affairs, so Mrs. Nehl was unaware that this had not
been paid. Motion by Froemming, second by Nelson, to deny the forgiveness of penalties in the
amounts of $9.60 and $39.44, because it was not due to County error. Motion carried.
Recess and Reconvene
At 10:40 a.m.. Chair Portmann declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 11:00 a.m. with all
commissioners present.V
Kit'Planning Commission Recommendations
Preliminary Plat - Boqenbrook, Inc.risland View”:
Motion by Nelson, second by Lee, to approve a Preliminary Plat of “Island View” consisting of
single family residential lots, 1 block, with conditions as recommended by the Planning
Commission. The property is described as Part of Gov. Lot 12 & All Gov. Lot 13 (7.4 Acres),
Section 16 of Edna Township, Berger Lake (56-1149), RD. Motion carried.
Conditional Use Permit-Otter Tail Beach Club, Inc.:
Motion by Froemming, second by Lee, to approve with conditions a Conditional Use Permit for
Carl Rudolph/Replacement of manufactured mobile home 12’ x 58’ Alantic 1976 to a 14' x 70’
newer home; J. Karen Baumont/Replace manufactured home Liberty 14’ x 60’ for a 14’ x 70’ later
model. The property is described as PT of GLs 3 & 5 (2.5 Ac), Section 12 of Amor Township:
Otter Tail Lake (56-242), GD.
Cattle Exclusion From RD & GD Lakes Discussion:
Land & Resource Director, Bill Kalar, informed the Planning Commission that the County Board
decided not to include the cattle exclusion language in this Shoreland Management Ordinance
revision.

mobile home 12’ x 58’ Alantic 1976 to a 14’ x 70’ newer one; J. Karen Baumont / Replace
manufactured home Liberty 14’ x 60’ for a 14’ x 70’ later model. The property is
described as Pt of GLs 3 & 5 (2.5 Ac), Section 12 of Amor Township: Otter Tail Lake (56-
242), GD.
Karen Baumont and Anna Rudolph represented the Application.
Steve Schierer (Board of Adjustment Member) indicated a variance was approved at their
November Meeting for a sideyard setback, provided the impervious surface meets the
Shoreland Management Ordinance requirements.
Motion: A motion by Trites, second by Sha to approve as requested, provided that the
impervious surface requirements of the Shoreland Management Ordinance are met.
Land & Resource Management must verify (onsite) compliance after the snow melts.
Voting: All members in favor.
Break: At 8:10 p.m., the Commission took a 10 minute break.
Scenic Point Resort/Terrv Colton & Brenda Burton - Tabled To February:
A Conditional Use Permit Application to split Scenic Point Resort into dual ownership as
per survey (on file at Land & Resource Management, Courthouse, Fergus Falls); to
include 10 x 40 porch at cabin #9; 40 x 40 addition to lodge; 40 x 60 cabin in exchange
for vacating pad 11; 40 x 100 pole barn 20 feet from SW boundary: owners unit 20 feet
from north property line and 30 feet from east line and a 16 x 22 addition to cabin #1.
The property is described as Part Gov Lot 2, Section 13 of Clitherall Township; Clitherall
Lake (56-238), RD.
Brenda Burton and Penn Brandberg (attorney) represented the Application.
Rodney Heinz had questions regarding - the impervious surface, the closeness to the
lake (cabin #9 is only 30’ to 40’ back from the lake/the proposed 40’ x 60’ is very close to
the lake), how they can request an addition to a structure that does not exist, the
substandard lotline setback for the pole building and he also stated that he was not
notified when Variance Applications were being considered.
A motion by Trites, second by Lachowitzer to table the Application to theMotion:
February Meeting, per the Applicant’s request, to allow the Applicant time to come-up
with a plan that will: 1. Minimize variance requirements. 2. Reduce the total number of
dwelling units. 3. Provide a drawing that more accurately depicts the location of the 34
units.
Voting: All members in favor.
