Motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to approve a variance of 20’ from the required lot line setbacks of 50’ for the placement of a storage building at least 30’ from the Rod Nelson property and at least 30’ from the Betty Moe property with the condition that the building identified on the applicant’s drawing for removal must be removed before a site permit for the new storage building can be issued. Hardship is the terrain of the applicant’s property. Minnesota September 7, 2000 Page 2 Roger and Rhonda Nelson - Tabled Roger and Rhonda Nelson, Fargo, ND, requested a variance to place our septic tank in the southwest corner of our lake lot. This would be 35’ - 40’ from the lake, a few feet from the lake road and butted up to our neighbor’s lot belonging to Harry Jackim, who has granted us permission. We also will be moving our well to the other side of our cottage to insure more than a 50’ clearance between sewer and well. So we would need a variance for our septic tank, since it would be closer than 50’ from the ordinary high water level. The property is described as Lot 14, Nedberg-Nye Survey Lots of Government Lots 1, 2, and 3, Section 1 of Edna Township by Devils Lake. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Mark Steuart, second by David Holmgren and unanimously carried, with the verbal and written permission of the applicant (Roger), to table this variance application until the October 5, 2000 meeting. The Board requested that the applicants meet with the Township and with the neighbor to obtain letters approving the variances as requested. Roland D. Penfield - Approved as requested Roland D. Penfield, Staples, MN, requested a variance of 6’ from the required side lot line setback of 10’ for an 18’ by 26’ addition, to the backside of an existing structure, 4’ from the lot line. Due to the way the structure sits on the angled lot, only the northwest corner of the addition would be within 10’ of the west property line. The addition would be approximately 4’ from the lot line at the northwest corner of the addition. The property is described as Lot 11, Oak Grove Beach, Rush Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by David Holmgren, second by Steve Schierer and unanimously carried, to approve a variance of 6’ from the required side lot line setback of 10’ for an 18’ by 26’ addition, to the backside of an existing structure, being approximately 4’ from the lot line. It was noted that a portion of the existing dwelling, which is closer than the proposed addition, is being removed and that the proposed addition is to the rear of the existing dwelling. Hardship is a substandard lot of record. Old Town Camp and Resort - Approved as modified with condition. Old Town Camp and Resort, C/0 Jack Plantin, Clitherall, MN, requested a variance of 15’ and a variance of 40’ from the required side lot line setback of 50’ for the construction of a 40’ by 60’ storage building 35’ from the north lot line and 10’ from the west lot line. The property is described as part of Sub Lots F and G of Government Lot 2, Section 12 of Clitherall Township by Clitherall Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to approve a variance of 20’ from the required lot line setbacks of 50’ for the placement of a storage building at least 30’ from the Rod Nelson property and at least 30’ from the Betty Moe property with the condition that the building identified on the applicant’s drawing for removal must be removed before a site permit for the new storage building can be issued. ACKNOWLEDGEMENT I UNDERSTAND THAT THE ADMINISTRATIVE STAFF OF THE OFFICE OF LAND & RESOURCE MANAGEMENT AND THE PLANNING COMMISSION MEMBERS/BOARD OF ADJUSTMENT MEMBERS, MAY NOT BE ABLE TO VIEW THE PROPERTY FOR WHICH A CONDITIONAL USE/VARIANCE HAS BEEN REQUESTED DUE TO SNOW COVER. AS A RESULT, IT MAY NOT BE POSSIBLE FOR OTTER TAIL COUNTY TO MEET THE LEGAL REQUIREMENT TO TAKE ACTION WITHIN 60. DAYS OF THE RECEIPT OF THE COMPLETED APPLICATION.I UNDERSTAND THAT IN THE ABSENCE OF A WAIVER OF THE 60 DAY REQURIEMENT, THE COUNTY MAY HAVE NO ALTERNATIVE BUT TO DENY THE APPLICATION.
