Minnesota MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, June 2, 2005 The Otter Tail County Board of Adjustment met Thursday, June 2, 2005, with the following persons in attendance: Michael Conlon Paul Larson Joe Maske Eric Babolian, Land and Resource Management Stephanie Morris, Otter Tail County Intern Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Cecil Femling Randall Mann Steve Schierer . i Minutes Approved - The Board of Adjustment approved the minutes of the May 5, 2005 Board of Adjustment meeting as mailed. The Board of Adjustment considered the following applications for variance: Donald and Darlene Beltrand - Approved the variance as requested. (6:30 p.m;) Donald and Darlene Beltrand, part of Government Lot 12, Section 18 of Parkers Prairie Township by Nelson Lake, requested a variance of 80’ from the required ordinary high water level setback of 200’ for a 28’ by 32’ addition 120’ from the ordinary high water level and a variance of 75’ from the required ordinary high water level setback of 200’ for the addition of a deck on the back side of the existing house 125’ from the ordinary high water level. The existing dwelling is 109’ from the ordinary highj water level. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion . and consideration, Paul Larson made a motion, second by Michael Conlon and unanimously carried, to approve a variance of 80’ from the required ordinary high water level setback of 200’ for a 28’ by 32’ single story addition 120’ from the ordinary high water level and a variance of 75’ from the required ordinary high water level setback of 200’ for the addition of a deck on the back side of the existing house 125' from the ordinary high water level as depicted on the drawing submitted with the variance application. The proposed development will be no closer to the ordinary high water level than the existing strudure. In their discussion the Board noted the existing site location and the size of the applicant’s property as reasons for their approval. Northern Lights Resort - Approved the variance as requested. (6:37 p.m.) Northern Lights Resort, part of Government Lot 9, Section 25 of Dead Lake Township by Dead Lake, requested is the following; The current Cabin No. 10 on Northern Lights Resort is a 1970 mobile home with an addition on it. The home that used to be on this site burned down in approximately 1992 when Ed and Lois Stans owned this resort known as Pleasant View. The home and garage that burned down measured approximately 37’ by 67’ for a total of 2,479 square feet. The current mobile home, plus the ;. addition, basement and cement left from the previous home takes up approximately 2,101 square feet. Because of the age of this mobile home and our concern for the safety and welfare of guests, we would like to remove the mobile home and addition to replace it with a stick-built cabin. This is currently a 4- bedroom/2 bath cabin and we would like to replace it with a 4-bedroom/2 bath cabin to retain the same enjoyment we’ve had for the past 11 years. The new cabin would be a total of 1,600 square feet, thereby taking up less room than either of the previous two dwelling on that site. Even though the total square footage of the new cabin would be more than what the current cabin is of 1,008 square feet, there will be a reduction in impervious area by 230 square feet. This would allow the cabin to be off of the driveway to assure safety to the guests and make the most use of covering what is already impervious. We would be incorporating the existing basement and most of the cemented area in the site of the cabin. The cabin woul^d measure 40' by 40’ and would be one story, the current sewer system was increased in 1996 and has been approved for the :resort ever since. The replacement of the new cabin on the site requested would not exceed where the' initial house stood and in fact would be further from the lake than the initial house and some of the cement. The, existing basement would be the comer of the cabin closest to the lake. Currently, the side of the cabin viewed from the lake is 66’ long. With the new cabin, the view from the lake would be only 40’ long and would allow people on the lake a much more aesthetic view. At last measurement, we were 89% open on our resort and will remain at 89% with new cabin because of using already impervious surfaces. There would be no impact on the buffer requirements from side or back lot lines. Chairman Mann polled the audience with no one speaking for or against the variance as requested. The applicants made the following change to the variance application as originally submitted; there will be a reduction in impervious area by 230 square feet should read there will be a ijeduction in impervious area by 500 square feet A letter signed by the following individuals in support of the variance as requested was read for the record; Barry Tanner, Shirley Ramberg, James Taylor, Elda Taylor and Betty Seiple. After discussion and consideration, Cecil Femling made a motion, second by Steve Schierer and unanimously carried, to approve the variance as requested and as described in th|e May 11, 2005 material submitted with the variance application. The Board stated that this resort is an asset to Otter Tail County and the proposed improvement will be a benefit to Otter Tail County, the property owners and to the people who use the resort. Marian Dahlgren - Approved the variance as requested with a condition. (6:45 p.m.) Marian Dahlgren, part of Government Lot 2, Section 27 of Hobart Township by Long Lake, requested a variance of approximately 5’ from the required ordinary high water level setback of 75’ and a variance of approximately 30’ from the required ordinary high water level setback of 100’ for tipe placement of a holding tank and an outhouse 70’ from the ordinary high water level. Chairman Mann polled the audience with no . one speaking for or against the variance as requested. After discussion and consideration, Steye Schierer made a motion, second by Joe Maske and unanimously carried, to approve a variance of approximately 5’ . from the required ordinary high water level setback of 75’ and a variance of approximately 30’ from the required ordinary high water level setback of 100’ for the placement of a holding tank and an outhouse 70’ from the ordinary high water level with the condition that before the permits for the proposed development can be issued the existing drain tile must be removed and the area properly landscaped to prevent direct runoff into the lake. The Board noted that the proposed location is perhaps the best location for the holding tank. Carol Lageman - Approved the variance as requested. (6:48 p.m.) . Carol Lageman, part of Government Lot 6, Section 9 of Dunn Township by Pelican Lake, requested a variance to go within 3' of my north property line with my press bed and septic tank, reason being the setback from my deep well, I can’t move any closer to the well. The required setback is 10’. Dan Schlauderaff, septic system designer, represented the applicant at the public hearjing. Chairman Mann polled the audience with no one speaking for or against the variance as requested. A letter from James and Betty’lhrey in support of the variance as requested was read for the record, /j^fter discussion and consideration, Joe Maske made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 7’ from the required side lot line setback of 10’ for the placement of a pressure bed and a septic tank 3’ from the lot line as depicted on the April 29. 2005 drawing submitted with the variance application. The Board noted the letter from the adjacent-property owner as a reason for granting the variance as requested and also noted that the applicant’s property is a substandard lot of record. 5 'i,- • IT V > ! .
