I have also enclosed a copy of a survey map for the area in question which shows the location of the easement. I have As we discussed, the deed creating this easement was recorded by the County and has been in existence for almost 20 years. The sole purpose of the easement is for personal, not commercial, ingress and egress to Dead Lake. As I understand the ordinance, at the time this easement was created it was a permissible use under the ordinance and these controlled access requirements were applicable to resorts, mobile home parks, recreation campgrounds and cluster developments, not to single family lake access use. You indicated that you would be contacting the County Attorney's office regarding the matter and that the County Attorney would then contact me so that we would have an opportunity to discuss these easements which were arguably authorized by virtue of their recordation, existence and use for the past 15 to 20 years. I represent the owner, Marilyn Nelson, of a 6Vi acre parcel located on Dead Lake. When Marilyn Nelson and her co-owner, Myron Anderson, purchased this property in 1978, the seller, Frank and Hazel Hunter, reserved an easement over the west 50 feet of my client’s property. I am enclosing a copy of that deed dated June 10, 1978 on which I have highlighted the reservation of the easement. As you will note, the easement is not defined as to purpose and does not identify any benefitted tracts. I am also enclosing a copy of the survey of the parcel and of subsequent deeds given by the Hunters to Freskes in 1982 and given by Freskes to Petersons in 1995, which purport to convey the easement rights to the Petersons. As you will note, the Petersons own non-riparian property which is not adjacent to Dead Lake. At this time the Petersons have notified my client that they intend to construct a road for lake access over the easement area and to fill in sand and construct a dock facility on the lakeshore. I have no information at this time as to the number of parcels or living units which would be using the easement area. You indicated in our telephone conversation that the Otter Tail County shoreline management ordinance may restrict access to Dead Lake from non-riparian parcels. I am requesting that you review the enclosed materials and provide me with pertinent sections of your ordinance and your opinion as to whether or not the proposed use of the easement area by the Petersons is permissible.
