( INDIVIDUALS REQUIRING SPECIAL ACCOMMODATIONS SHOULD CONTACT THE LAND,& RESOURCE MANAGEMENT OFFICE PRIOR TO THE HEARING. i July 6. 2005Bert Olson Chairman Planning Commission Mailing Date ; ; ! / I Conditional Use Permit Request Mike & Cheryl Harris, Owners Northern Lights Resort Dead Lake 35387 Northern Lights Trail Richville, MN 56576 In keeping with The Shoreland Management Ordinance of Otter Tail County, Minnesota, we are making application for a new Conditional Use Permit for Northern Lights Resort and are asking for the following approval: Removal of the current Cabin #10 on Northern Lights Resort which is a 1970 mobile home with an addition on it and replace it with a stick-built cabin measuring 40’ x 40’. The home that was initially on this site burned down in approximately 1992 when Ed and Lois Stans owned this resort known as Pleasant View. The home and garage that burned down measured approximately 37’ X 67’ for a total of 2,479 square feet. The current mobile home, plus the addition, basement and cement left from the previous home takes up approximately 2,101 square feet. Because of the age of this mobile home and our concern for the safety and welfare of guests, we would like to remove the mobile home and addition to replace it with a stick-built cabin. This is currently a 4-bedroom/2-bath cabin and we would like to replace it with a 4-bedroom/2-bath cabin to retain the same enjoyment we’ve had for the past 11 years. The new cabin would be a total of 1,600 square feet resulting in less impervious surface. Even though the total square footage of the new cabin would be more than what the current cabin is of 1,008 square feet, there will be a reduction in impervious area by approximately 500 square feet. We would build mostly over the areas that are already impervious. Because of the rules for the Minnesota Department of Health, this would also be a handicapped accessible cabin, even though our topography is not conducive to wheel chairs. In order to accomplish this, meet the rules required by the Minnesota Department of Health and the Fire Marshall, we obtained a variance of 125 feet from the requirement of a 200-foot setback from the ordinary high water level on June 2, 2005. This would allow the cabin to be off of the driveway to assure safety to the guests and make the most use of covering what is already impervious. We would be incorporating the existing basement and much of the cemented area in the site of the cabin. The current sewer system was increased in 1996 and has been approved for the resort ever since. The number of guests would remain the same and would not add any impact on the current sewer system. The placement of the new cabin on the site requested would not exceed where the initial house stood and in fact would be further from the lake than some of the cement. The existing basement would be the corner of the cabin closest to the lake. Currently, the side of the cabin viewed from the lake is 66’ long. With the new cabin, the view from the lake would be only 40’ long and would allow people on the lake a much more aesthetic view. At last measurement, we were 89% open on our resort and will remain at 89% open with the new cabin because of using already impervious surfaces and returning some impervious surfaces to pervious. There would be no impact on the buffer requirements from side or back lot lines. We would then like to move the addition from Cabin 10 to the back of the property behind the owner’s house to use for storage and remove three old storage buildings from the property. The addition measures 20’ x 12’ for a total of 240 square feet. The three old storage buildings to be removed have a total measurement of 254 square feet and are deteriorating. This replacement would take place in the fall of 2006 as we have to finish our current permit first. In order to prepare for this undertaking, we are requesting approval now since we will need to send plumbing plans to the Minnesota Department of Health for approval and get an electrical permit. Page 2 Conditional Use Permit Request Mike and Cheryl Harris Northern Lights Resort We understand the Planning Commission must take several items into account for granting a Conditional Use Permit. We address these items as follows; 1. Compatibility: The replacement of this mobile home and construction of a stick-built cabin will allow the new cabin to blend in much more aesthetically with the surrounding cabins. From the water, the view of the new cabin will be more enhancing than a 1970 mobile home 66’ long. The new cabin will be 40’ x 40’ in dimension and only one story. 2. Environmental Impact: In the last 11 years, we have worked with Bill Kalar, Land and Resource Management, to strengthen the buffer areas preventing water runoff into Dead Lake. The replacement of Cabin #10 will in no way environmentally impact Dead Lake. The replacement of the current Cabin 10 with the new Cabin 10 will not increase the number of guests on the resort or the pressure on the environment. 3. Hazards to Land/Water: We can foresee no hazards since the proposed change will be well back from the water and does not impact the land since we are well off from any public roadways. 4. Crowding: The entire resort, with the proposed change will continue to be a minimum of 55 feet from our closest neighbor’s property line well exceeding the buffer requirement. The resort itself has a spacious setting in that most of the cabins have anywhere from 30 to 50 feet between them and a generous area undeveloped. The replacement cabin will allow more room between Cabin #2 and Cabin #10 and return approximately 500 square feet of impervious surface to pervious surface. 5. Density: Although our density exceeds the guidelines of The Shoreline Management Ordinance of Otter Tail County, Minnesota, we have obtained a variance from the Board of Adjustment dated June 2, 2005. In their decision, the Board of Adjustment viewed our proposal as necessary and essential to keep the resort updated. Five years ago, when we were approved for a Conditional Use Permit, our open area was at 89%. With the proposed change, we will still be at 89% open. 6. Suitability: Due to the topography, the trees, and that our elevation above the lake exceeds that of the majority of our surrounding neighbors, we become practically invisible from neighboring properties. We would, however, be replacing Cabin #10 to become more aesthetic to the surrounding area. We also realize that specific requirements will be addressed and wish to state the following in accordance with those requirements: 7. Parking and Traffic Control: Currently, each site has adequate parking for the number of guests per unit. We do not allow drive-thrus by the general public, thereby eliminating an excessive amount of traffic on our private resort drive. NOTE: As an additional control, we have not nor do we ever intend to seek any type of liquor or restaurant license, thereby eliminating any attraction to that type of transient traffic. Page 3 Conditional Use Permit Request Mike and Cheryl Harris Northern Lights Resort 8. Noise: Our guests have shown a propensity for quiet time in our resort. We have never received any complaints or negative comments from our neighbors regarding our guests and the noise level. We have a policy of quiet hours beginning at 10:00 p.m. All noise level goes down to conversation level only. We have received several compliments from some of our neighbors regarding our guests and their respect for the quiet serenity of our area. 9. Hours of Proposed Use: Due to the nature of our business, we will be using the resort on a 24-hour basis seasonally for the purpose of a family resort. We will be open during the months of May through mid-October. From mid-October through the end of April, we would be the only residents at the resort. We are now in our 11*'^ year at Northern Lights Resort and call this home. 10. Lighting: Other than the lighting in place for the safety and security of our guests, we do not intend to erect any excessive, brilliant lighting on the resort. 11. Lot Size: As stated by the Board of Adjustment in 1995 when we received our first variance, the property does not have the appearance of being overdeveloped. We have not changed since that time. We are confident that should you choose to personally inspect the resort, you will also see our careful planning and development so as to retain the natural beauty of our area maintaining a spacious, grassy and wooded area for everyone’s enjoyment. 12. Natural Topography: Through the use of our Grade and Fill Permits, we have been able to continuously establish a full, grassy area between the cabins and the lake avoiding any mud or debris from running into the lake. The replacement of Cabin #10 will have no impact on the natural topography in any way. We are well back from the lot lines and do not have a bluff impact zone. 13. Adverse Effects: During the process of developing our plans and improvements to the resort over the last 11 years, we feel we have eliminated all adverse effects to the environment, the lake, the neighborhood and the community. We feel we will retain the hidden nature of the resort as well as to help keep the unwanted debris in the water runoff out of the lake. Since we purchased this property in 1995, we have worked with Bill Kalar, Land and Resource Management, to properly manage the impact of the resort to the lake. We have obtained the appropriate permits when needed and re-established the buffers for water to travel through the grassy areas before reaching the lake in order to preserve the lake and land. We have re-graded travel routes to better facilitate the natural lay of the land where possible. We have worked to improve the visual and environmental effect this resort has on the lake, on the neighbors and on the community. We have done our best to be conscientious when planning improvements and determining the limits of our developments. As we enter our 11‘^ season at this resort, we look back to our previous years. Since purchase, we have cleaned up and reformatted the resort from a fishing camp with a zero return rate to a family resort and a customer base that is at approximately 85% return from year to year. ;^sT- ■; i -i? ■:, '^• >t,.
