We are requesting a conditional use permit to add fifteen (15) campsites to the Northern Lights Resort. 1 hirteen (13) of the planned campsites will be located on a 6.3
acre tract southerly and westerly of our resort on Dead Lake. We are intending on purchasing this tract upon final approval of this CUP.
The additional campsites will be implemented in 3 phases over the course of 4 years. Phase 1 consists of 8 planned campsites within the 6.3 acre tract along an old
roadway (now abandoned and grown over), falling within the previous Dedicated Public Road corridor for the plat of DeShane Beach. These planned campsites lay
approximately 270 to 450 feet southerly of Dead Lake and would be accessed to the west of Northern Lights Trail. Phase 2 consists of 5 planned campsites within the
6.3 acre tract southerly of the Phase 1 campsites and sharing access from Northern Lights Drive. Phase 3 consists of 2 planned campsites located in the back
southwest corner of our existing resort property and approximately 220 to 280 feet southerly of Dead Lake with access being provided across our resort property.
Variances from the Board of Adjustments will be necessary as the old roadway and a small portion of 4 of the planned 8 campsites in Phase 1 fall within the 30 foot
set back from a bluff and part of the existing trail accessing the lake along the west line of the 6.3 acre tract to be acquired falls in the proposed 50 foot buffer zone.
In addition, 10 of the proposed campsites we are seeking boat slips for fall in Tier 2. Application to the Board of Adjustments for these and any other variances
deemed necessary by the Planning Commission will be made following the outcome of our CUP hearing. CONTINUED ON BACK OF PAGE

Each planned campsite will be 2400 square feet (Includes parking requirements) with water, electricity and sewer. Each planned campsite will have a Class 5 gravel
base covered with a layer of pea rock.
During Phase 1 we are proposing to put in a centralized dock system over the 6.3 acre tract to be purchased with slips for 12 of the proposed campsites in an effort to
eliminate uncontrolled beaching and minimize the shore line impact from the additional slips. We believe this will lower the incidences of boats being taken in and
out for visitation to other bodies of water thus assisting in the prevention of the spread of aquatic invasive species.
All of the planned campsites are located to minimize topographical alterations and maintain open space left in its natural state but still function as new members of
our existing resort community.
Where revegetation is necessary, it will be done as quickly as possible and be consistent with the surrounding area to maintain an aesthetically pleasing appearance.
We recognize the tier density calculations do not support our planned resort expansion to the 6.3 acre tract. However, the configuration of our existing resort
facilities and property, when combined with that being proposed over the 6.3 acre tract intending to be purchased, leave an abundance of open space with no visual
indication of overcrowding. The planned campsites fit the property and as most are not readily visible from the lake, the resort will continue to operate with a
natural aesthetic appearance from the lake.M 5ufes, l

Denied As Recommended proposed new property. Previous resort owner, Cheryl Harris, spoke in favor of the
proposed expansion, the economic benefits resorts bring to communities and the loss of
resorts throughout the County. Because of the economic benefits resorts bring to Otter
Tail County, a motion was offered by Huebsch, seconded by Rogness and unanimously
carried to amend the previous motion to approve 13 campsites and 12 centralized boat
slips subject to the applicants obtaining the necessary variances from the Board of
Adjustment. The proposed project is compatible with the usage of the surrounding area.
The project is located in Pt of GL 9 and tr in GL 9 & 10, Section 25 of Dead Lake
Lake (56-383), NE.

Conditional Use Permit - Volk Properties LLC:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to re-grade the lot and reconstruct a walkway as presented. The project is located at Plainview Sandy
Beach Lot 8, Section 3 of Edna Township; Little McDonald Lake (56-328).
Conditional Use Permit - Northern Lights Resort/Pro’s Properties LLC:
Motion by Froemming and second by Rogness to approve a Conditional Use Permit to add 13 campsites
as recommended by the Planning Commission and 9 centralized boat slips on the proposed new property.
Previous resort owner, Cheryl Harris, spoke in favor of the proposed expansion, the economic benefits
resorts bring to communities and the loss of resorts throughout the County. Because of the economic
benefits resorts bring to Otter Tail County, a motion was offered by Huebsch, seconded by Rogness and
unanimously carried to amend the previous motion to approve 13 campsites and 12 centralized boat slips
subject to the applicants obtaining the necessary variances from the Board of Adjustment. The proposed
project is compatible with the usage of the surrounding area. The project is located in R of GL 9 and tr in
GL 9 & 10, Section 25 of Dead Lake Township; Dead Lake (56-383), NE.
Recess & Reconvene
At 11:24 a.m.. Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The Board of Commissioners meeting was reconvened at 11:28 a.m.
RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
FOR SAFE COMMUNITIES GRANT APPLICATION
Otter Tail County Resolution No. 2014- 35
Commissioner Rogness offered the following and moved its adoption:
Be it resolved that Otter Tail County Department of Public Health enter into a grant agreement with the
Minnesota Department of Public Safety, for traffic safety projects during the period from October 1, 2014
through September 30, 2015.
The Director of Public Health is hereby authorized to execute such agreements and amendments as are
necessary to implement the project on behalf of Otter Tail Countv Public Health and to be the fiscal agent
and administer the grant.

Volk Properties LLC - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Regrade lot on
lakeside of cabin. Lot was raised in 2011 when lake rose 4.5’ above OHWL, but not
finished. Proposed work includes: 1) Regrade lot and recreate 2 filtering basins. Move an
estimated 20 - 30 CY material. 2) Reconstruct walkway to lake with pavers. 3) Topsoil. 4)
Seed. Estimate 30 - 40 CY of new material will be hauled in. The project is located at
Plainview Sandy Beach Lot 8, Section 3 of Edna Township: Little McDonald Lake (56-328),
Jeffrey Volk represented the Application.
Motion: A motion by Gili, second by Boyer to approve as presented. Voting: All Members
in favor.
Picture Identification: Bill informed Commission Members that on April 22, 2014 the
County Board passed a motion to provide picture IDs for Planning Commission and Board of
Adjustment Members.
Break: At 7:16 the Commission took a 14 minute break.

Office. Appiication to the Board of Adjustment for any variances deemed necessary by the
Planning Commission will be made following the outcome of our CUP Hearing. Existing
Units: 10 cabins, 8 RV sites, 1 home. Request a total of 23 RV sites, 10 cabins & 1 home.
The project is located in Pt of GL 9 and tr in GL 9 & 10, Section 25 of Dead Lake Township:
Dead Lake (56-383), NE.
Vince & Cheryl Prososki and Glenn Howe (Anderson Land Surveying) represented the
Application.
Cheryl Harris, previous owner of Northern Lights Resort, spoke in favor of the proposal,
indicated that in their experience, they found clients to be good stewards of the land and the
lake (not all are fisherman), the centralized docking would assist in preventing the spread of
AiS and that approval would promote tourism (a benefit to businesses & Otter Tail County).
Chuck Brasel (neighbor) spoke in favor of the project, stating that boat traffic is not currently
a problem and should not be an issue with this proposal, also stated that the resort is not
visible from the lake. Terry Mcdevitt expressed concerns regarding vehicle traffic and the
resort’s visibility from the road.
Motion: A motion by Wilson, second by Bailey, to approve 13 PRCV Sites and 6
centralized boat slips on the proposed purchase property, excluding the 2 PRCV Sites
requested on the existing resort property, approval is subject to the Applicants obtaining the
necessary variances from the Board of Adjustment. Reason for approval: the proposed
project is compatible with the usage of the surrounding area. Voting: Ail Members in favor,
except Boyer.
Adjourn: At 9:34 P.M., Chairman Olson set the Meeting. The next Meeting is scheduled
for 6:30 P.M. on June 11,2014.

Enclosed you will find a copy of our submittal drawing for the CUP application and public hearing of May 14,
2014. We have color coded the areas in an attempt to illustrate where the numbers came from for the density
calculations.
Please note we had inadvertently omitted the delineated wetland area in our earlier calculation. We have now
included this calculation in the color coded drawing. As a result, the allowable density in the “Proposed Resort
Tier 1 Calculations” went from 7.08 to 6.81 (rounding from 7 to 6 units).
I apologize for this error in our presented calculations. Thankfully, in this particular case I don’t think it was a
significant error in that we were requesting 15 units which is considerably greater than both 6 or 7 units. From
listening to and being a part of the Planning Commission’s discussions I do not believe it would have affected
their decision.
However, we will strive to do a better job in the future.

We are writing this letter in regards to the Condition Use Permit that is being requested by
Vince and Cheryl Prososki at Northern Lights Resort. We are totally against such an addition to this
Resort. The Resort has grown over the last 10 to 15 years with the addition of extra camp/trailer sites
that have become an eye sore to the lake frontage. The addition of 15 more sites would just add
addition pressure the lake and species that thrive in and on the lake. Not to mention the wildlife that
makes their homes on the 6.3 acre tract. We also feel cutting down the necessary trees would be a
travesty. The East Bay of Dead Lake where the Prososki's want to add the 15 sites would just add more
pressure and a more of trailer park look than it already have. We have been land owners on Dead Lake
and neighbors to the Northern Lights Resort for 30 plus years. In that time we have seen improvements
made to the resort which feel have been positive. But adding more camp/trailer sites will just add way
to much of a trailer park look and put more unnecessary pressure on the eco-system of the natural
environment lake and will harm it in a very negative way. Trespassing by additional resort patrons would
also be a great concern to local land owners as well. Trespassing has been a problem in past.
We also believe it will considerably decrease land values for all of the land owners on the bay
but especially land owners in the immediate vicinity of Northern Lights Resort. This is nothing personal
against Vince and Cheryl but more of an environmental concern for the bay and Dead Lake in general.
We have maintained and updated our property as much as possible in the 30 years we have owned it.
We would hate to see all the hard work and endless weekends deteriorate the value of our property
because of additional Trailer sites. Nobody wants to go spend a weekend at their cabin getaway and be
surrounded by 20 to 30 camp/trailer sites. "The 20 to 30 sites would be the number of sites the resort
would have if the 15 were added". The resort already has 10 rental cabins, store and bait barn. We don't
need another Blue Fin Bay. In addition to their camp/trailer sites you would be adding 15 more families
with boats, pontoons, watercraft, dock slips, that would put more pressure on the lake and more
pollutants to the water. We have seen visitors to the Northern Lights Resort keep fish that have not
nearly reached their full growth potential by the Resort patrons. When people come and stay at
Northern Lights Resort for the weekend or a week-long stay they don't care what type of condition they
leave the lake in. They will keep every fish they catch no matter how big or small. We have no problem
with Resort owners making a living off of a beautiful body of water like Dead Lake, but building a trailer
park is in no way shape or form going to help anybody on the lake but the Prososki's.

Dear Mr. Kalar:
We won't be able to attend the Planning Commission Hearing on the above referenced matter due to a business
travel requirement. For that reason we are submitting our comments by this letter.
As a general comment we oppose increased density development on natural environment lakes. The proposed
CUP acts as a proxy development at approximately 4.37 times the minimum density for standard residential lots
under shoreline regulations for Dead Lake.
The regulatory exceptions that exist for the continued operation of traditional resorts are based on historic land
development, social relevance and the need to periodically up-date or replace existing assets. Any expansion
should be treated to full review as a new development under current regulations. We request the County ensures
careful evaluation of wastewater design, visual impact, boating, docking and any other commercial development
regulations that apply. This portion of Dead Lake is heavily developed with considerable peak week-end boat use
and congestion in the narrows from the east bay into the greater part of the lake to the west.
We believe the project proposers are responsible individuals who are endeavoring to work within the existing
framework for permits including variances.
We oppose the granting of a Conditional Use Permit. We are aware that Otter Tail County has been careful in
granting development density exceptions to its shoreline regulations. That is the best policy as the County works
to protect the shoreline ecology of our lakes. However, if Otter Tail County chooses to grant the CUP, we want the
County to carefully review the project and make sure that full and proper mitigations and conditions are part of
the permit.

We purchased our lake home on Dead Lake in 1986. One of the primary reasons for choosing
Dead Lake was the environmental classification of the lake. The fact that regulations
concerning lakeshore use were in place and enforced was important to us. It is apparent that
lake usage and lakeshore construction have increased dramatically in the last 27 years. The
proposal of backlots having dockage on the Lake just is not in the best interests of the Lake.
There are numerous large acreage plots around the Lake and the thought of future
developments of backlot sites having access to the Lake is not consistent with an environmental
lake classification. Dead Lake is indeed a treasure that requires protection from all of us.
The East Bay of Dead Lake is also very special, and I perceive this permit application of enough
importance that all the lakeshore owners of the bay should have been notified for their input of
this issue. The requirement of an Environmental Assessment Worksheet concerning an
addition of 15 campsites in our bay should be considered due to the wetland impacts.
Our opposition to the permit application is because we believe large numbers of campsites will
further stress the East Bay, and is not in the best interests of the Lake.
Our opposition to this application should not be considered animosity against Vince and Cheryl
Prososki. They are good people and have a positive reputation.

Planning Commissioners;
We are writing this letter in response to the conditional use permit application
of Northern Lights Resort.
It is our belief that this increase in boat traffic as well as increased numbers of
residents on the small east bay of Dead Lake would be detrimental. The State
of Minnesota Shoreland Management states; “The consequences of
overdevelopment are increased risks of flooding, pollution and scenic
degradation.
“Degraded property values, polluted lakes and wells, flood damages, and
increased public service costs result when short-sighted thinking places
immediate profits above long-term impacts and goals”.
Dead Lake is designated as an environmental lake, the high density proposed
by adding 15 seasonal campsites and 12 boat slips on 200 feet of lakeshore is
not in keeping with the values and goals of Shoreland Management or an
environmental lake.
The state has a history of working to protect our natural resources and the
value of our water resources. This plan goes against good stewardship and
Minnesota Shoreland Management goals.

Planning Commissioners;
We are writing this letter in response to the conditional use permit application
of Northern Lights Resort.
It is our belief that this increase in boat traffic as well as increased numbers of
residents on the small east bay of Dead Lake would be detrimental. The State
of Minnesota Shoreland Management states; “The consequences of
overdevelopment are increased risks of flooding, pollution and scenic
degradation.
“Degraded property values, polluted lakes and wells, flood damages, and
increased public service costs result when short-sighted thinking places
immediate profits above long-term impacts and goals”.
Dead Lake is designated as an environmental lake, the high density proposed
by adding 15 seasonal campsites and 12 boat slips on 200 feet of lakeshore is
not in keeping with the values and goals of Shoreland Management or an
environmental lake.
The state has a history of working to protect our natural resources and the
value of our water resources. This plan goes against good stewardship and
Minnesota Shoreland Management goals.

I am opposed to the permit application for a variety of reasons, but in particular;
As I am a lakeshore owner directly next to the proposed construction of 15 campsites, I am concerned of
the decrease of my property values.
I am also concerned of the increased vehicular traffic on Northern Lights Drive, which is a dirt road. The
thought of more blowing dirt and more noise is something I wish would not happen.
I don't understand why or how this application would be approved for the dockage of 15 boats for back
lot sites.
Why were not all the lakeshore property owners notified of this application?
I believe a further study of this development should be done.

Dear Ottertail County Planning Commission:
I have owned property at the above addresses since 1994.
1 strongly oppose the Conditional Use Permit Application Request, by Northern Lights Resort and
Paulette Jimenez.
I believe this will have a negative impact on the east bay of Dead Lake. There is already
significant boat traffic from Northern Lights Resort. The purchase of this property of this property and the
additional 15 RV sites will almost double the size of Northern Lights Resort.
In 1994 Northern Lights Resort ad 9 cabins, 1 home, and 4 semi-primitive camp sites. They now
have 10 cabins. 8 RV sites and 1 home. Dead Lake is an Environmental lake that is more sensitive to
recreational use. Resorts impact a lake way more than individual cabin/home owners.
More property owners on Dead Lake should be notified of this Cup Application and should be given more
time to respond.
1 also believe the applicant’s should be required to perform an EWS followed by a EIS.

I was recently notified by the Dead Lake Association that Northern Lights Resort would like to add 15 more
camp sites. I have owned a lake home on the east end of the bay since 1992. My family is against the expansion
of Northern Lights Resort. The East bay is a small bay. On windy days and holidays the bay gets pretty busy
with boats, water skiers, fishing boats and jet skis. People come from other parts of the lake to get out of the
wind to water ski and jet ski on the smaller bay. Adding 15 more camp sites will just add to this problem.

We, the neighbors and adjacent landowners to Northern Lights Resort have been apprised of the
conditional use permit being applied for and all items described on the request.
This will serve, as shown by the signatures below, our cooperative and full support for all items included
on the conditional use permit request. In the past 2 years since Vince and Cheryl Prososki purchased
this property, they have been improving not only the looks of the resort, but have been conscientious of
the natural environment lake they are on.
To reduce run off into the lake, they have installed a rain garden and now are restoring the side hill to its
natural state with nature plants. Currently they are working with East Ottertail Soil and Water
Conservation District to reduce the run off from the driveway. All these projects have been in
conjunction with East Ottertail Soil and Water Conservation and Dead Lake Association.
To maintain the shoreline, we approved the central dock system on the new property which will reduce
the number of docks and eliminate uncontrolled beaching and minimize the shore line impact from the
additional slips. We approve of using the existing cart trails on top of the hill and down to the lake
which will eliminate the process of creating new trails.

buildable lots and to use original survey and not to have new survey done. The audience was polled with no one

Proposed lot split from Tract Al 1.43 acres (62,290 square feet) will be Tract B1 (11,230 square feet) to be sold to the
owners of Lot 6 and part of Lot 7 of Klien’s Beach. New Lot Tract B1 can’t be created by sub-division plat because
that requires a 66’ roadway easement. It is not feasible to create a 66’ Roadway easement as this would contain an

unanimously carried, with the applicant’s verbal permission, to table this public hearing until the September 11, 2014
meeting for additional information regarding impervious surface coverage and for the location of the ingress and
egress road. September 11, 2014 Meeting - The audience was not polled as this was a tabled application from a
previous meeting. The applicant provided a revised variance request and a revised drawing along with impervious
surface calculations. After discussion and consideration, Michael Harris made a motion, second by Paul Larson and
unanimously carried, to approve the variance for the request as submitted at the public hearing on September 11,
2014 and as depicted on the drawing submitted with the revised request with the*condition that a registered surveyor's

June 12, 2014 Meeting - Pro’s Properties LLC and Paulette Jimenez, part of Government Lot 9, Section 25 of
Dead Lake Township by Dead Lake, requested the following:
Northern Lights Resort is considering purchasing a 6.3 acre tract southerly of and adjoining the existing resort. We
would like to eventually place 15 seasonal campsites with 15 boat slips in the 6.3 acre tract (a phase development)
and operate those campsites as part of our resort. We have obtained a conditional use permit recommendation for
approval at the May 14, 2014 Planning Commission meeting and final conditional use permit approval from the Otter
Tail County Commissioners at their May 20'^, 2014 meeting for 13 seasonal campsites with 12 boat slips as shown on
the Certificate of Survey. We are asking the Board of Adjustment to grant the following:
1. We are requesting a variance from the 30 foot bluff setback (the closet point of the existing trail lies 3 feet from
the bluff) in order to continue to use the existing trail running along the north side of and providing access to 8 of
the proposed seasonal campsites. This will eliminate having to construct a new access road. The existing trail
lies within the original dedicated public road corridor laid out in the plat of DeSchane Beach.
2. We are requesting a variance from the 30 foot bluff setback for a small portion of 4 of the proposed seasonal
campsites (the closet point lying 20 feet from the bluff). There will be no pad, structures within the 30 foot

3. We are requesting a variance from the 50 foot buffer (the closet point of the existing trail lies 5 feet from the
property line) for those portions of the existing walking trail lying within the 50 foot buffer along the northwesterly
part of the 6.3 acre tract which provide walking access to the lake. This will eliminate having to construct a new
walking trail.
4. We are requesting a variance from the Tier 1 density calculation across the 6.3 acre tract for 2 of the 4 seasonal
campsites.
5. We are requesting a variance from the Tier 2 density calculation across the 6.3 acre tract for 10 of the 11
seasonal campsites.
6. We are requesting a variance from the number of boat slips allowed by Tier 1 density calculations across the 6.3
acre tract for 13 of the 15 boat slips.
We would also like to note the total impervious surface for this tract of land will be less than 19%
We believe, and the Otter Tail County Commissioners agree, the land is best suited for the type of development
approved and the acquisition of this property will allow Northern Lights Resort to better serve the general public.

Bill Kalar, Land and Resource Director, clarified the requested variances, the roles of the Planning Commission, the

calculations and provided the board members a detailed worksheet as to how the calculations were made, the
numbers (sites and boat slips) as authorized by the ordinance/rules and the numbers (sites and boat slips) being

Each member of the Board of Adjustment had an opportunity to ask questions of the applicants and to express their
views. After discussion and consideration, thomas Lee made a motion, second by David Wass and carried, with
Michael Harris abstaining (Mr. Harris had left this hearing and was not in attendance when the motion was acted
upon) to table this hearing per the applicants’ request until the next scheduled meeting to provide Bill Kalar with an
opportunity to perform additional density and boat slip calculations using other calculation methods and to provide the
applicants with an opportunity to reconsider the number of sites and slips being requested.
July 10, 2014 Meeting - The Otter Tail County Auditor’s office received a letter dated July 9, 2014 requesting the

Bill Kalar, Land and Resource Director presented a handout with property characteristics information, general notes
and density calculations, which was completed from his review of the most recent drawing submitted. Mr. Kaiar’s
handout has also been attached an incorporated as an official part of the September 11, 2014 minutes.
The Planning Commission had approved 13 campsites and 6 centralized boat slips.
The County Board of Commissioners had approved 13 campsites and 12 centralized boat slips.
The applicant's revised request is for 12 campsites and 12 boat slips
One board member noted that the County Board’s approval was based on an acknowledgement that the existing
regulations are too restrictive. Another board member thought the request represented to much variance from the
requirements. The attorney for the association felt the expansion should follow the existing rules and wondered what
the practical difficult is.
After discussion and consideration. Ward Uggerud made a motion, second by Thomas Lee to approve 11 campsites
and 5 boat slips, which is based on the State’s standards. During discussion of this motion, it was suggested that
each campsite should have a boat slip to eliminate daily transportation of the boats which might prevent campers from
transporting their boats from lake to lake during their stay at the resort. After this discussion this motion was
withdrawn and Ward Uggerud proceeded to make a motion to approve 11 campsites and 11 boat slips. This motion
was seconded by Thomas Lee and carried with Paul Larson and David Wass voting no. Note - Michael Harris,
shortly after this hearing had begun, removed himself from the seated board area and seated himself in the audience
for the balance of this public hearing. Mr. Harris step down from this particular public hearing because he and his wife
were former owners of this resort; however, they no longer have an ownership or financial interest in this resort. Mr.
Harris did not vote. The above noted motion passed on a 3- 2 vote.
It was noted that the variance as approved does provide the owners of the resort with a reasonable commercial use of
the property. It was also noted that drainage from the proposed campsite areas does not go directly into the lake.
The variance as approved supports the commercial resort industry and recognizes the important role resorts have
both environmentally and economically. There was some concern if this action would establish precedence for other
resorts; however, it was noted that each application should be consider individually, be given the same consideration
and acted upon accordingly
