William A. Slabich, Government Lot 15, Section 18 of Star Lake Township by North Long Lake requested the
following: Due to property being a peninsula I need to decrease setback to facilitate a small cabin. Proposing to
construct a 24’ by 24’ dwelling with enclosed porch. The structure will be approximately 63’ from the lake on the east
and west and approximately 92.5’ from the lake on the North. Dee Kennedy represented the applicant at the public
hearing. The audience was polled with Eric Boe expressing concerns with access to this parcel and with Larry Miller
asking questions about the proposal. After consideration and discussion, Steve Schierer made a motion, second by
Michael Harris and unanimously carried, to deny the variance application as requested noting that the variance as
requested is a substantial variation from the requirements of the ordinance, that there are no other structures on this
lake that close to the ordinary high water level, there is no legal location to place a septic system and if the variance
as requested had been approved there would be an adverse effect on government services as there is no adequate
access to this property for emergency vehicles.
Black Ridge Holding LLC - Approved the variance application as requested. (7:25 p.m.)
Black Ridge Holding, LLC and Dennis and Dorothy Madsen, part of Lots 4, 5 and 6, Block 6 of Carlisle, requested the
following: Need to install a drain field and septic tank within 10’ of property line. Drain field will be 2’ at closest point.
Septic tank will be 4’ at closest point. Well setback has been approved by the Minnesota Department of Public
Health. Bruce Fuhrman represented the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a
motion, second by Joe Maske and unanimously carried, to approve the variance appiication as requested noting the
letters from the Minnesota Department of Public Health, the Carlisle Community Hall Association and from Rolf and
Brenda Sue Ronnevik.
Jeff and Susan Jenson - Approved the variance appiication as requested with a condition. (7:28 p.m.)
Jeff and Susan Jenson, Lot 1 Pleasant View Beach and part of Government Lot 2, Section 21 of Otter Tail Township
by Otter Tail Lake requested the following: Requesting a variance to construct an addition (to an existing cabin) that is
7T 8” from ordinary high water level. This would be a variance of 3 to 4’ from the required ordinary high water level
setback of 75’. The existing cabin will be remodeled to match the new addition but will retain its existing footprint and
volume. All new addition will be at the rear of the existing cabin. The audience was polled with no one speaking for or
against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by
Paul Larson and unanimously carried, to approve a variance to construct an addition (to an existing cabin) that is 7T
8” from ordinary high water level with the condition that no more than 25% of the total eligible lot area can be covered
with impervious surfaces. It was noted that the addition will be behind the existing structure and there will be no roof
line change to the existing structure.
Maple Leaf Resort - Approved the variance appiication as requested. (7:35 p.m.)
Maple Leaf Resort, part of Government Lots 2 and 3, Section 29 of Maine Township by West Lost Lake requested the
following: Allow an existing sign to be relocated. Being 60’ from the center line of County Highway 35 and being less
than 20’ from road right-of-way as required and allow said sign to be moved with its existing size. The audience was
polled with Glenn Lord speaking for the variance as requested. A letter from the Otter Tail County Highway
Department indicating no objections to the proposed sign location was read for the record. After consideration and
discussion, Michael Harris made a motion, second by Carl Zick and unanimously carried, to approve the relocation of
an existing sign as described in the variance application dated October 13, 2008 and as depicted in the
drawing/pictures submitted with the appiication. It was noted that proposed location will place the sign out of the road
right-of-way.

FINDINGS OF FACT
SUPPORTING/DENYING AN AREA VARIANCE
An area variance ma)' be granted only where the strict enforcement of county zoning controls will result in
“practical difficulty”. A determination that a “practical difficulty” exists is based upon the consideration of the
following criteria as defined by the Minnesota Supreme Court in In re the Matter of the Decision of Counp' of Otter
Tail Board of Adjustment to Deny a Variance to Cvril Stadsvold and Cvnara Stadsvold.:
Is the request a substantial variation from the requirements of the zoning ordinance? Why or why not?
Will the request have an adverse effect on government services? Why or why not?2.
Will the requested variance effect a substantial change in the character of the neighborhood or will it result in
a substantial detriment to neighboring properties? Why or why not?
3.
Is there another feasible method to alleviate the need for a variance? (Economic considerations play a role in
the analysis under this factor) Why or why not?
4.
How did the need for a variance arise? Did the landowner create the need for the variance? Explain.5.
Will a variance secure for the applicant a right or rights enjoyed by others in the same area?6.
Does existing sewage meatment need upgrading?7.
Is a variance contrar)' to the public interest or damaging to the rights of othei' persons or to property' in the
neighborhood?
8.
Ill light of all of the above factors, would denying a variance serve the interests of Justice? Why or why not?

Dear Board of Ajustment members:
On September 26,2008 the assistant county highway
engineer sent us a letter telling us we were in violation
of usage on a county right of way and that we have
until October 31 of 2008 to remove our resort sign. At
the last county commissioners meeting I presented to
the board a series of pictures that explained that there
had been a resort sign there since the 50’s and that
that sign was replaced in 2005 with our new sign when
the tornados went through . Under all the
circumstances the sign should have been able to be
grand fathered in and the county commissioners tried
to do all they could to help us find a suitable remedy
but the county attorney would not allow them to do
anything to help us remedy the situation. We then had
Bill Kalar and Mr. Grotte come out to the resort and
take a look at another spot which happens to be the
only spot that the sign can be moved to and still do the
job it is intended to do, but the new spot comes under
the shoreline management rules which would make us
cut up our sign to meet their sign size requirements.
At that point Mr. Kalar suggested that we apply for a
variance that would allow us to move our sign in its
entirety to the new spot. By doing this it would allow
us to use our sign, the highway department would be
satisfied as well as the Shoreline Management Dept.
We there fore are coming before your board asking
you to help us remedy the situation by giving us the
variance to move the sign in its entirety to the new
location. Thank you for your time in this matter.

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, October 7, 2008, at 9:30 a.m., at
the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
Syd Nelson, Chair; Everett Erickson, Vice-Chair; Bob Block, Roger Froemming, and Dennis Mosher
present.
Approval of Agenda #
Motion by Froemming, second by Block, and unanimously carried to approve the Board of
Commissioners agenda of October 7, 2008, as presented.
Approval of Minutes
Motion by Froemming, second by Mosher, and unanimously carried to approve the Board of
Commissioners meeting minutes of September 30, 2008, as mailed.
Approval to Pay Bills
Motion by Erickson, second by Mosher, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Sian Discussion
Owner of Maple Leaf Resort, Lois Klinker, discussed an issue with their sign by the road that identifies
their resort. According to Ms. Klinker, the resort sign has been in place since the storm of 2005 and
previous to the storm, there were different signs in that location, one being an old Coca Cola sign.
The resort recently received a letter from the County Highway Department that the sign is located in
the highway right of way and must be moved. Lengthy discussion took place regarding the situation.
Motion by Mosher to request the Highway Department to grant an extension until April 30, 2009, to
Maple Leaf Resort for removal of their resort sign. This would allow time to designate a different
location and hire someone to move the sign. Commissioner Mosher withdrew the motion because the
Highway Department has authority over road right of way issues by statute. The Highway Department
will work with the landowner to resolve the situation.
Training - Highway Department
Motion by Mosher, second by Erickson, and unanimously carried to approve a Tuition Assistance
Agreement between the County of Otter Tail and Wade Bugbee to allow Mr. Bugbee to attend
MnDOT certification courses. The County will pay for classes and related expenses.
Culvert Replacement - Cental Lakes Trail
The Otter Tail County Highway Department received the following quotations for a culvert
replacement project on the Central Lakes Trail:
