Minnesota ( MINUTES or THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT December 7, 1989 The Otter Tail County Board of Adjustment met Thursday, December 7, 1 989, with the following persons in attendance: George Walter Cecil Femling Carl Johnson John Everts Dan Oehler Wm. Kalar, Land J Resource Management Wally Senyk, County Attorney Chairman Walter called the meeting to order at 7:00 p.m.. Motion was made by Cecil Femling, seconded by Carl Johnson and unanimously carried, to approve the minutes of the November meeting, with the correction that one cabin is to be constructed barrier free, in the approval for Charles Malmstrom, Madsen's Resort, Blanch Lake in Everts Township. CALL TO ORDER MINUTES APPROVED The following applications for variance were considered: Judith V. Lightowler, Fargo, ND, requested permission to build an addition to existing garage, 7‘ from lot line on Lot 9 of Birchwood Subdivision, Little MacDonald Lake in Edna Township. Appearing and speaking were Mrs. Robert Nelson and Sherlene Miller. Motion was made by Carl Johnson, seconded by John Everts and unanimously carried, to table action until the next meeting, at such time the applicant can be present. Jack Fankhanel, Sabin, MN, requested permission to construct garage on Lots 12 & 13, Block 1, Crystal Lida Beaches, Lida Township on Lake Lida, within twenty feet of road right-of-way. Letters re­ ceived were read. After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to deny, no adequate hardship shown with viable alternatives. John Elgethun, Battle Lake, MN, requested permission to leave a 9' x 10' metal shed as located two feet from property line on Lot 11, Madison Beach, Clitherall Lake in Clitherall Township. Letters re­ ceived were read.Femling, seconded by Carl JOhnson and unanimously carried, to allow the shed to remain, hardship being able to enjoy the same rights and privileges as others in the area enjoy. JUDITH LIGHTOWLER TABLED JACK FANKHANEL DENIED JOHN ELGETHUN APPROVED After consideration, motion was made by Cecil JOhn Armstrong, Battle Lake, MN, requested permission to construct garage 10’ from road right-of-way and 6' from lot line, on Lot 2, Dursch's Silver Bay, Silver Lake in Everts Township, ation, motion was made by Carl Johnson, seconded by Cecil Femling and unanimously carried, to grant approval, hardship being substandard lot of record and being able to enjoy the same rights and privileges as others in the area enjoy. Mike Valentine, Fergus Falls, MN, requested permission to rebuild garage that was destroyed by fire on the same location, on the N*s Lot 5 & all Lot 6, Anderson Beach, Wall Lake in Dane Prairie Township. After consideration, motion was made by John Everts, seconded by George Walter to deny, no adequate hardship shown. Motion was then made by Carl Johnson, seconded by Daniel Oehler and unanimously car­ried, to table so the Board members can "take another look". Kalar of Land & Resource Management. The original request was for a 100' set back from Dead Lake, which requires a 200' set back, with a variance of 70'tioned approval. Motion was made by Dan Oehler, seconded by Craig Anderson and unanimously carried, to authorize the recording of a new permit with the correction to show the decision as made by the board at 130' from the water, not 100' as requested. The matter of the approval for Edward Holger on October 5, 1989, re­ quired a clarification. Motion was made by Cecil Femling, seconded by Carl Johnson and unanimously carried, to approve a 20' x 22' structure, no closer to lake than the original request, on Lots 13 & 14. The recorded document did not show the condi- HOLGER APPROVAL AMENDED Don Magnuson, Henning, HN, requests a 4' variance to place a storage shed on Lot 8, Mrugalas Beach, West Battle Lake in Girard Township. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to allow the 4’ side lot variance as requested, hardship being a substandard lot of record, with the terrain not allowing access to building. Richard Currier, Fargo, ND, requested permission to allow a vision obstructing fence to remain as located on Lot 7 & 8, Block 1, Jacobson's Pelican View, Pelican Lake in Dunn Township. After consideration, motion was made by Cecil Femling to allow the fence to remain. The motion was seconded by Carl Johnson but failed with Oehler, Everts, Anderson and Walter voting "no". Motion was then made by George Walter to deny, no hardship shown, allowing until June 1, 1990 to remove or alter. The motion was seconded by Dan Oehler and carried with Femling and Johnson voting "no". Quentin Walseth, Frazee, MN, requested permission to sell a strip of land 16' pakeside) x 165' x 20' (roadside] out of Sublot A, G.L. 9, Section 3, Hobart Township in Wimer Lake. After considera­ tion, motion was made by Carl Johnson, to approve, to allow would increase the size of the neighbor's substandard lot, enhancing both properties. The motion was seconded by Cecil Femling and car­ ried, with John Everts moving "no". DON MAGNUSON APPROVED RICHARD CURRIER DENIED QUENTIN WALSETH APPROVED Charles Malmstrom, Battle Lake, MN, requested permission to increase resort from 11 units and 1 dwelling to 13 units and one dwelling, on an 8.95 acre 309.7' lake frontage in Section 1 , Everts Township on Blanche Lake. Appearing and speaking to the issue were Patrick Green and Emil Madsen. After consideration, motion was made by Cecil Femling to grant, hardship being, since the acreage space allows for 14 units, with the new cabins not encroaching onto the lake, with the cabins being constructed as handicapped accessible. The motion was seconded by Craig Anderson and carried, with John Everts abstaining. James C. Huebsch, Perham, MN, requested permission to convey a parcel of land 110' x 200' out of a 2.01 acre parcel in the N^SEii of Section 22, Perham Township, without platting.
