Mr, § Mrs. Dallas Hagemeister
Route 1
Vergas,56587
Dear Mr. § Mrs. Hagemeister:
ORDER OF THE COflMISSIONER, APPLICATION 77-1094, LOON LAKE, OTTER TAIL COUNTY
The Department of Natural Resources has reviewed your application for a
permit to place about 566 cubic yards of fill for.road im.provement in
the public waters of Loon Lake, Otter Tail County, at your property located
in T 137N, R 41W, Section 35.
It has been determined that your application as proposed must be denied
based on the following findings of fact:
1. The proposed area to be filled is a bass-panfish spawning area
and Loon Lake does not have many good spawning areas.
2. The Otter Tail County Land and Resources Office is not in favor
of such fill.
3. The proposed fill would expand your private property holdings
at the expense of losing a public resource area.
4.The Department of Natural Resources discourages the placement
of fill in public waters if such fill is not designed to recover
shoreland lost to erosion or to raise developments constructed at
too loAv an elevation.
5. The present road still serves to provide suitable access, via
a single lane, to the land you own on the peninsula.
Minnesota Statutes, Chapter 105,45, quotes in part as follows: "In all
permit applications, the applicant has the burden of proving that tlio
proposed project is reasonable, practical, and will adequately protect
public safety and promote the public welfare." In view of our observations,
we cannot conclude that your proposal is indeed reasonable, practical, and
will promote the public welfare; therefore, the proposal presented in the
application is in all respects denied.
Sincerely,
DIVISION OF WATERS
