He has indicated that he intends to convert the existing building that houses a repair shop and living quarters to an eating establishment and has requested that the Lida Town Board support his application for a liquor license for the new use of the building. Lida Town Board has been advised that there will be no “stand- up" bar. Lida Township has not adopted a zoning ordinance and therefore has no legal basis for either supporting or objecting to the request. Loghaven Resort, however, is within the jurisdiction of the Otter Tail County Shoreland Management Ordinance, so it would appear that the change of use of the building in question is sufficiently extensive to require a Conditional Use Permit. The building abuts Otter Tail County Highway 4 in an area where parking and access to abutting property from County Highway 4 are severely limited. The Lida Town Board would have no objection to the granting of a liquor license for the change of use for the building provided that the property affected by the change conforms to all of the requirements of the Otter Tail County Shoreland Management Ordinance, particularly in the areas of parking adequacy and traffic safety. Catoe Robertson Well Drilling Rural Route 1, Box 140 Ashby, Minnesota 56309 Dear Mr. Catoe and Mr. Johnson: Subject: Request for a Variance from Minnesota Rules, Chapter 4725, to Constmct a Water- Supply Well, Minnesota Unique Well Number 622173, on Keith Johnson’s Property in the SWl/4 of Section 11, Township 136 North, Range 42 West, Otter Tail County, Minnesota This letter is in response to your request for a variance from Minnesota Rules, Chapter 4725, to constmct a water-supply well approximately 33 feet from the ordinary high-water level of Crystal Lake. Minnesota Rules, part 4725.4350, subpart 1 requires that a well must be no less than 50 feet horizontally from the ordinary high-water level of a stream, river, pond, or lake. Inspections of the site were conducted by Mr. Jeffrey Gmgel of the Minnesota Department of Health (MDH) Fergus Falls district office on September 23, September 29, and October 18, 1999. Mr. Grugel reported that, due to the small size of the parcel and the location of the individual sewage treatment system, no location exists on the subject parcel which would satisfy all of the required isolation distances. During the inspection on October 18, 1999, Mr. Catoe and Mr. Gmgel determined that Mr. Johnson’s sewage drainfield appears to extend closer to the proposed well location than originally thought. This resulted in the proposed well location being moved to a distance of 25 feet from the ordinary high-water level of Crystal Lake. Also during the October 18, 1999 inspection, Mr. Gmgel became aware of a cesspool on neighboring property owned by Loghaven Resort located 63 feet west of the proposed well location. Minnesota Rules, part 4725.4450, subpart 1 requires that water-supply well must be no less than 75 feet from a cesspool, seepage pit, leaching pit, or dry well. Based on the results of Mr. Gmgel’s inspections, the information provided by you, and in ?accordance with Minnesota Rules, Chapter 4725, vour request for a variance is granted to locate the subject well along the east property liner63 feet from the cesspool on the Loghaven Resort^property and 25 feet south of the ordinary high-water level of Crystal Lake. The variance is'’gran ted because there is no location on the subject property to constmct a well which complies with all required isolation distances. Catoe Mr. Keith Johnson Page 2 October 28, 1999 Because the isolation distances between the proposed well location and the lake and cesspool are less than required in rule, additional construction methods and precautions are required in order to reduce the potential for contamination of the well and groundwater. The following list of additional conditions and requirements should provide the necessary additional protection for the well and groundwater. The variance is granted with the following conditions: 1.The well casing must extend to a depth of at least 50 feet or must penetrate at least 10 feet of impervious material (clay). 2.If the well is constructed using a method which creates an annular space, the annular space between the casing and the bore hole wall must be filled with neat-cement grout as defined in Minnesota Rules, part 4725.0100, or high-solids bentonite grout that is NSF approved and marketed as a well sealant. High-solids bentonite grout must be mixed to the manufacturer's specifications or must meet the minimum requirements of 15 percent by weight bentonite as specified in Minnesota Rules, Chapter 4725, whichever is heavier. Grout must be inserted through a tremie pipe from within 10 feet of the lower termination of the casing to the ground surface or the base of the pitless unit or adapter. 3.Any existing wells on the property must be permanently sealed by a licensed well contractor or well sealing contractor. 4.Mr. Grugel must be contacted at the MDH (218/739-7585) at least 24 hours prior to beginning well construction and before the pitless unit/adaptor is installed so that an inspector may be present. 5.All other provisions of Minnesota Rules, Chapter 4725, are in effect. Alternative measures or conditions attached to a variance have the force of law and effect of applicable rule. If a party violates the alternative measures or conditions attached to the variance, the party is subject to enforcement actions and penalties provided in the applicable law or rule. This variance is conditioned upon the applicable acceptance of and compliance with the conditions of the variance. Failure by the applicant to comply with the conditions prescribed in the variance will result in the immediate expiration of the variance. Mr. Randy T. Effective February 1, 1991, prior to the Shoreland Management Office issuing the required permit, you will need to provide them with a complete plan review form from the Health DepartmenC. The addition of permanent rooms and screened porches to recreational vehicles is not consistent with the Otter Tall County Recreational Caispground Ordinance, however this construction has been permitted by the Shoreland Management Office. This policy Interpretation error has resulted in recreational camping vehicles being altered to the extent that they no longer meet the definition of a recreational camping vehicle. This Department will work with the. campground owners in an effort to bring these structures into compliance with current regulations. Apparently you have a question regarding the use of the second story which was added to the Log Haven Resort store. Enclosed is a copy of the Site Permit issued by our office for the aforementioned construction. As you will see, on February 13, 1987 (date permit issued) the permitted use of the proposed second story was for storage purposes. On April 28, 1987, however the permitted use was changed to use as a dwelling. This change was the result of an agreement made with Paul Pfeifle by which he would remove two of the four permitted campsites on this property. In other words, we allowed one dwelling unit (above the store) in exchange for the removal of two dwelling units (campsites).
