revealed that this fence does not conform with the Shoreland Ordinance.

locate the fence or alter it so that is is not a vision-obstructing.

OPINION
The above matter having come on duly before the
Court on the complaint of Ray Jenson, a Department of Natural
Resources conservation officer, alleging a misdemeanor viola
tion of M.S. 105.42 Subd. 1 and 105.541 Subd. 4, Working in
Public Waters Without a Permit, the alleged violation occuring
in the spring of 1977 in Lida Township and defendant being
represented by Fredrick Kraemer, Esq. and the State being
represented by Joseph Cade, Assistant County Attorney and
the Court having heard testimony and received exhibits and
having reviewed the memorandum supplied by counsel and being
fully advised in the premises. Finds that in the spring of
1977 the defendant undertook or procured another to undertake
an alteration in the cross section of the lake bottom in the
lake, known as Lake Lida in Lida Township, Otter Tail County,
by operating or causing or permitting to be operated, an exca
vation device adjacent to the dock located upon the defen
dant's premises and in an area immediately adjacent thereto
without first obtaining a permit as required by M.S. 105.42
Subd. 1 and 105.541 Subd. 1 and 4.
That the defendant is Adjudged Guilty of a viola
tion of M.S.105.42 Subd. 1 and 105.541 Subd 1 & 4.
IT IS THE ORDER OF THIS COURT That defendant appear

MEMO: The statutory mandate is clear and .the legislative
clarification by Minnesota Statute 105.541 Subd. 1 requires
that any person seeking to alter a public stream or lakebed
obtain a permit irrespective of whether the granting of
such a permit vjould be a matter of course by the Commissioner
and that a beneficial purpose would be served by such
alteration.
